Corp.- -Lot 43, Deer Path Lane -- Single family house, driveway, utilities, grading with 100 ft. of wetlands MOTION: In the absence of a number (they ,lust submitted to DEP), to continue to 8 -24 at 3:00 p.m. (O'Neill - Forbes; all in favor) VOTED DISCUSSION: Mr. Harry Blackey - Proposed subdivision on Branch St. Some formal presentations have been made to the Planning Board; Mr. Blackey requested an in-formal discussion with the Conservation Commission. Mr. Maloon was also present. Mr. Blackey represented New England Investors Trust, new owners of the parcel on Branch, St. which was formerly owned by Kelton Potter. The plan is to immediately file a Request for Determination to determine wetlands line. The proposal to Planning Board is under the cluster bylaw, which -requires that the applicant first establish density possible under a standard subdivision. The Conservation Commission is being asked how many lot=_. might be possible under the Wetlands Protection Act for a conventional subdivision plan. The applicant feels there will be significantly less impact to wetlands under a cluster- plan. The plan reviewed by the commission represents the applicant's effort to satisfy the Planning Board's concerns. Re: conventional subdivision plan - Dick suggested that the concerns would be to get wetlands delineated and deal with issues such as bank. replication for the two crossings, and loss of habitat. He suggested that plan could be redone to eliminate one of the crossings. Site will be re- flagged prior to commission site visit. Acting Chairman Powers noted that the size of the pond area would have to be calculated as wells if over 10,000 sq. ft., it would be classified as land under water body, subject to different regs. Commissioner=_ are also looking for the amount of filling proposed, and requested that the plan indicate the direction in which various areas shed. Re: cluster plan: parcel is about 48 acres; about 23 would be left open and controlled by an association. The plan would relocate pond and would require only one crossing. Other wetlands left undisturbed. The commission asked for a comparison of alterations required by both plans (in chart form). Drainage talcs etc. requested for conventional subdivision, since it would potentially impact amount of filling, replication required, etc. [Comm. Smith arrived.] Site walk: 3 -1; at 6:00 p.m. If enough progress.-. is made, hearing can be held on 8 -24 at 8 :05. Otherwise it will be continued. O'Neill requested better planting plan, better definition of soil, and wants the trash removed. The applicant was notified that pan under equipment is overflowing and was asked to remove it. MOTION: To continue to 3 -24 at 7 :55 with stipulation that debris be removed and oil pan be emptied and monitored regularly, with additional information about soil and clarification of planting scheme and construction sequence (showing completion of replication before construction) before that time.
