Lambos, former commissioner and conservation constable. RESIGNATION OF COMMISSIONERS -- Comm. Forbes has resigned as of 4- 26 -93, and an official written letter of resignation has also been received from Comm. James Owens. GREAT WOODS LAND UPDATE -- Dick Lewis reported that Tom McShane is no longer working in EGEA. Trudy Co;;, the new Secretary of Environmental Affairs, will be assembling new staff. The meeting scheduled for Thursday is being postponed until some time in May; Dick felt that the new undersecretary will have an overwhelming task dealing with current budget cycle, which may cause the Great Woods land issues to take a back seat for a time. MINUTES: MOTION: To adopt the minutes of 4- 12 -93 as amended. (Sadowski - Cormier; all in favor) VOTED TRAINING SESSIONS -- sponsored by SRPRDD (Dick has additional info): May 10: Title V; May 24: Grant writing. WETLANDS PROTECTION ACT HEARING James Epstein - -900 Maple St.-- Dwelling, driveway, utilities, etc. within 100 feet of wetlands Robert Colleran from Hutchins - Trowbridge, 'represented the applicant. No wetlands to be filled; roof gutters to be connected to drywells. Hutchins- Trowbridge flagged wetlands; lot not yet staked. The owner requested the proposed house location. Comm. Sadowski asked about the state +s definition of a class 5 injection well and asked Dick to clarify. MOTION: To continue to 7:00 at MHS cafeteria 5 -3 -93 and to site walk 7:30 a.m. 5 -1 -93. (Sadowski - Powers; all in favor) VOTED DEAN ST. -- Drainage ditch; Commission felt that the owner should put forth a Request for Determination of Applicability. REQUEST FOR DETERMINATION OF APPLICABILITY CONTINUATION Robert Mattice - -2.38 Branch St.--Remove/grind existing stumps and loam/seed/plant with shrubbery a backyard area Site walk revealed no problems. Comm. Powers noted original orders restricted back yard size for two reasons: houses were pre -fab and didn't require as much construction equipment around; they were also on sewer; commissioners wished to discourage maximal development I of backyard area. Chairman Cauldwell also wished to discourage use of l fertiliser, as part of Determination. Commissioners also wanted a condition requiring a hay bale line to be placed at the limit of MANSFIELD CONSERVATION r_.OMMISSION MINUTES MONDAY, APRIL 26, 1993 -- PAGE 2 clearing. MOTION: To close the hearing. (Sadowski - Powers; all in favor) VOTED MOTION: To issue a Neg. #3 determination with above conditions. (Powers - Sadowski; all in favor) VOTED WETLANDS PROTECTION ACT HEARING CONTINUATION - SE211 -414 Christian & Feck Devt.- -Lot 32, Fieldstone Dr.-- House, associated work within 100 ft. of wetlands New plan submitted, rev. 4- 25 -93, based on Karl Drown's flagging resulting from the site walk. on 4 -24. Mr. Brown had not, in fact, flagged the site as previously stated in 4 -12 minutes. MOTION: To close the hearing. (Powers - Cormier; all in favor, Smith abst.) VOTED WETLANDS PROTECTION ACT HEARING CONTINUATION - SE211 -374 MAC Homes; Inc. -- Between Eastman St, and Stearns Ave.- - Subdivision road /utility construction within 140 ft. of wetlands; 2200 sq. feet wetland filling WETLANDS PROTECTION ACT HEARING CONTINUATION - SE211 -417 Jess Realty Trust- -180 acres between Eastman St. and Stearns Ave. -- Subdivision road /utility construction (Stearns Hill) within 100 ft, of wetlands Hearings opened simultaneously. Mr. Malcon 'represented the applicants. Mr. Paul Folkman represented both Jess and MAC Homes, and introduced Dr. Paul Aldinger of a geotechnical firm in Providence, RI, to talk about 'research done and recommendations made. - D'r. Aldinger had evaluted the proposal for construction of dike from geotechnical standpoint., to ascertain whether the proposed configuration was feasible and to report on what control measures should be used. He presented his report to commissioners for the record. His biggest concern was that the outwash plain west of the basin might have peat or organic soils, which would not be a good base for dike. Test holes were dug, but the backhoe broke because of density of material. Test pits revealed very little organic soil, approximately 1 foot thick.. Qutwash material underneath, very competent for dike. General subsurface conditions described in report - sand /gravel. "No question" that a stable dike can be built at a 3 -1 slope. Asked whether a concrete cutoff wall should go around the dike, Br. Aldinger responded that the amount of time water stays in dike will be very limited (a maximum of 12 hours). Calculations indicate that there shouldn't have been any significant flow through the dike; therefore cutoff wall is not necessary, though it would be a good idea in the area of the weir structure. His recommendations were to strip off all organic material; topsoil and silt layer before building dike. After excavation for basin and dike, material must be compacted and geotextile fabric placed over, with porous material on top of that (washed stone /riprap). Cutoff wall should be founded on natural sail. Compaction testing criteria included in report. Recommendations on dewatering also included in report. Paul Folkman spoke about supervision by Dr. Paul Aldinger in the field. Dick recommended including in the order stipulations about MANSFIELD CONSERVATION COMMISSION MINUTES MONDAY, APRIL 26, 1993 -- PAGE 3 supervision; this basin is critical to the site, and must be watched carefully. Dick will submit info to Mike Powers who has indicated willingness to review. Comm. Powers concerned about subsurface flow joining surface flow in basin. All parties agreed that this design is "new territory" and must be carefully monitored. MOTION: To continue to 5 -17 at 8:00. (Powers - Cormier; all in favor, Smith abst.) VOTED WETLANDS PROTECTION ACT HEARING Exclusive Realty- -Lots 1 -4, East St. - -800 sq. ft. wetlands to be disturbed during construction of houses_., grading, utilities Mr. Ralph Maloon represented the applicant. This project involves a four -lot compound. The largest wetland to be disturbed will be that under the sewer line during installation. The plan notes that roof leaders will tie into dry wells. Hay bales are shown. Commission has walked the site. Dick asked whether any test holes or borings have been done in the area of the sewer crossing. Mr. Perry DiMascio, applicant, replied that one hole has been done and revealed gravel material (in the area of the first lot serviced by driveway). The applicant will encounter groundwater in putting sewer line in. Dick asked for construction sequencing, dewatering processes, silt control processes, etc. Process will take 2 days, according to Mr. DiMascio. It was noted that the location of a spring behind the house at 721 East St. was not marked on plan (commissioners observed spring on the site walk). The applicant was asked what measures will be taken to prevent infiltration, and whether the planning board knows about this spring. Comm. Powers suggested that another site might be considered for that sewer line. Comm. Sadow /ski noted that hay bales :indicate limit of clearing. However, the hay bale line is at the absolute limit of the easement; if clearing will be limited within the 20 -foot easement, the hay bale line can be moved in. Comm. Powers asked that a limit of clearing line be shown on plan at the point where there is no hay bale line. Nothing on the plan indicates dewatering plans - Comm. Sadowski asked the applicant to supply this information. Lois McCasland, 711 East St., abutter, asked about what will be done regarding a drain located near the site. She objected to the drive, and asked whether the Conservation Commission is aware of the town's easement in the drain area. MOTION: To continue to 8:45 on 5 -17. (Powers - Sadowski; all in favor) VOTED WETLANDS PROTECTION ACT HEARING CONTINUATION - SE211 -420 Folkman p, Zola Builders- -Lot 9, 19 Serena Allen Way -- Single family dwelling, driveway, related grading within 100 ft. of wetlands Ralph Maloon represented applicant. Mr. Folkman was also \ present. A new plan submitted, dated 4- 26 -93, showing the house moved forward approximately eight feet as a result of the site walk. Some silt fence must be moved to accommodate changes on plan. Proposed dry MANSFIELD CONSERVATION r- OMMISSION MINUTES MONDAY, APRIL 2E, 1993 -- PAGE 4 well added to plan. 1 The area to be cleared on this lot is in the range of 17,000 sq. ft., including where piled material is. It was noted that the Commission usually specifies 7500 sq. ft. of lawn in this district. Include in order a requirement, for a revised plan showing how area west of the driveway will be treated. MOTION: To close the hearing. (Powers - Cormier; all in favor, Smith, Sadowski abst. VOTED WETLANDS PROTECTION ACT NEARING CONTINUATION - SE211 -421 Exclusive Realty- -Lot B, East St.-- Dwelling, grading, driveway, " utilities within 100 ft. of wetlands Ralph Maloon presented on behalf of the applicant. Plans (house relocated) changed as a result of site walk. New plan, rev. 4 -2E. MOTION: To close the hearing. (Powers - Sadowski; all in favor) VOTED WETLANDS PROTECTION ACT HEARING CONTINUATION Remus Realty Trust - -Lot 84A, 37 Donald Allen Dr. Ralph Maloon represented the applicant, who requested a change to the plans. New plan Submitted-. leach field has changed, house has moved to be more square with street, garage has been 'removed, driveway has been moved uphill to a flatter area. Driveway pitched out to street, so no berm or extra dry well will be needed. Dick Lewis considered the changes an improvement, but must view the site. No file number; state asked for 100 -year flood line. Info has been sent. MOTION: To continue to 5 -3 at 7 :15 p.m. at MHS cafeteria. (Powers - Sadowski; all in favor) VOTED WETLANDS PROTECTION ACT HEARING New England Investment Group Trust - -Hay Brook Farm, Branch St. -- Roadway construction for 42 -lot cluster subdivision Ralph Maloon represented the applicant, Mr. Blackey, who could not be present. Proposal is for a 40+ -acre cluster subdivision of 42 homes; it came before the commission (in basically the same configuration) as Request for Determination about a year ago. Currently before Planning Board as a special permit hearing. Pre- and post - development flows for the site: five areas: (1) open field sheds to Rack Bay Brook, through most water will go into the Class A soils. Area 2: isolated wetlands. Area 3: southerly/ center sheds to the south. Area 4, east end, has fairly large wetland which sheds to behind the new school; area 5 sheds southerly. Wetland compensation area proposed and shown nn plan. Some area to be filled. Area 1: .water will be put into a centrally - located pond on site. Crossing Back Day Brook, filling about 3000 sq. ft. of wetlands. Isolated wetland to be filled as well. Compensating for flood storage capacity of this. Question asked by Engineering Dept.; Ralph submitted copy of his response to them, regarding the pond. Dick raised issue of connection between isolated wetland and other wetland. Issue has not been resolved; being looked at by Maloon and Engineering. Wendy St. Aubin, 69 Branch St., was present. MANSFIELD CONSERVATION COMMISSION MINUTES MONDAY, APRIL 26, 1593 -- PAGE 5 Sadowski: Has concerns about the "pond" - Ralph is using it as replication. Comm. Sadowski asked whether it will, in fact, be replication for a wetland, a pond, a swamp, -Dv-- noting that if it dries up, it isn't wetland replication. Mr. Clemmey asked asked whether more water will get into the Rack Ray Brook (no additional water). Mr. Clemmey urged the applicant to clean out Rack. Ray Brook in that area. Comm. Powers asked for a plan showing planting density, species, regime; she also asked about bank replication. Commissioners want to see the area staked to show what will be done in replication area. The roadway Determination of Applicability stipulated that the back lots would be flagged at a later date. Site walk: 5 -1 at about 8:15. MOTION: To continue the hearing to 5 -24 -93 at 8.00. (Sadowski - Cormier; all in favor) VOTED ORDER OF CONDITIONS: SE211 -421 (Lot B, East St.). MOTION: To issue orders as written and discussed. (Powers - Sadowski; all in favor) VOTED SE211 -419 (Lot 32, Fieldstone Dr.) MOTION: To issue orders as written and discussed. (Powers - Cormier; all in favor, Smith abst.) VOTED NEW BUSINESS: ---Dick suggested that the commissioners do a site walk: for Mansfield Oil prior to making a determination about how to proceed. -- Chairman Cauldwell directed Dick to get approval as soon as possible for use of special town counsel with regard to Mr. Nelson's situation. --Neil Driscoll, Beta Engineering, pump station'Mill St. has indicated that a final plan will be submitted showing contours, etc. as 'requested. -- Commission' =_ - stance of Brook St. area must be considered.
