Bottom of page, last paragraph, last sentence - add "donation would include the fee interest in the contemplated road." CERTIFICATES OF COMPLIANCE: Scott Fuller, Worldwide Devt. Lot 5 Piasecki Dr. (SE211 -339 - Subdivision; SE211 -351 - lot). Landscaping done, loamed, seeded recently. MOTION: To partially release lot 5 from SE211 -339 and SE21 -351. (Powers - Sadowski; all in favor) VOTED Releases from SE211- -55 and -65 sought for Lot 7, Branch St. A certificate was issued for SE211 -65 (Branch St., relocation of Back Bay Brook) in the early 1980s. No certificate was ever issued for SE211--55. MOTION: To issue Certificates for SE211 -65 and -55. (Powers - Sadowski; all in favor) VOTED Some portions of the original order were never carried out; however, the property has changed hands; portions of the property are under Orders for the Baybrook subdivision. CORRESPONDENCE: Letter from Paul Folk.man re Keli Green and the proposed compensation/ replication area, which was supposed to be completed about year and a half ago (but wasn't due to Bonwood's financial difficulties). Orders are valid until March '94. Comm. Powers suggested sending a letter to fir. Folkman indicating the Commission's appreciation of the effort to complete the compensation area but noting that the orders will be expiring and suggesting that extension will he difficult unless substantial work has occurred. The commission will request a progress report by the end of September indicating current status of work and eventual completion date. MOTION: To send letter as discussed. (Powers - Weidner; all in favor) VOTED WETLANDS PROTECTION ACT HEARING CONTINUATION . :File- Avmbar)&S $e °„ reeerVe4e Karl Clemmey-- Perkins Ave. Lots 1- 3-- Construct roadway and three dwellings, associated grading & utilities, within 100 ft. of wetlands Richard Merrikan, Mr. Buckley (Bay Colony), Mr. Clemmey present. Approximately 12 abutters present. The proposed project includes a portion of Perkins Ave. and three lots. Land slopes away from Perkins Ave., in a westerly direction, towards a pond. September 'SS and April 189 were the dates given for two different elevations of the pond. Wetlands vegetation lines shown on plan as well. Leaching galley system proposed. Three houses to be constructed, minimum setback (30 ft.) to avoid disturbance of flood plain or wetlands. Calculation methods used to determine the 100 -year storm since no FEMA or town data were available. The elevation estimated by the engineer was 164. Based on that estimate, the lots would be graded and no disturbance resulted on lots I and 3. For the Lot 2 house, again based on the levels estimated by calculation method=_., the flood plain gets to about 60 ft. from street; a compensatory storage area is proposed to handle the volume from this lot. Grading of each lot is planned to be independent of the others. MANSFIELD CONSERVATION COMMISSION MINUTES MONDAY, AUGUST 23, 1993 -- PAGE 2 Siltation fences proposed. Siltation control line is limit of work. Some alteration had already taken place; Mr. Drown had done a number / of soil borings (about 10 -15 inches) which didn't show any hydric soils; Comm. Powers felt line (with one exception) was accurate, and that inaccuracy is marked wetland but may be upland. Comm. Powers Asked whether the compensation area had been calculated to the 164 elevation on a volume basis, or calculated to the line on the plan. [Answer: volume basis.] At its deepest, the compensation area is two feet. Concern was expressed by the commission that when homes are conveyed, there is a tendency for owners to fill such areas. A notation should be made in order to maintain in perpetuity. The town engineering dept. has reviewed calculations for the subdivision regarding drainage and leaching galleys. The accuracy of calculations regarding the 100 -year flood is dependent upon the professional who has stamped the plans and talcs. The pond has no outlet. Comm. Sadowski expressed concerns about rate of runoff into pond post -devt. and asked what type of vegetation existed under original conditions. The engineers responded that they were contacted after re- grading was done, so they have no info. Karl Drown say_; flagging was essentially the way it is now. Slope change will contribute to more rapid runoff; concern about flash rainfalls etc. Mr. Merrikan Suggested that the pond bottom is a "gravel area, with pretty good soils; pond probably reflects groundwater ", and he felt that the speed of the runoff is not important. He doesn't think a Swale or pathway would contribute anything positive. The watershed for the pond is about 3.6 acres; these three lots represent about 1 acre. Dick. Lewis requested more analysis to show that wetland regs. have been satisfied in figuring flood storage capacity for the filling on lot 2. Ed McCalski, 28 Noonan St., submitted dated photos to the commission. Rod Stearns, 74 Union St. and Sel Stearns, 37 Chilson Ave., presented an old Mansfield News photo (from 1955) to help in establishing flood levels. Rod Stearns noted that there is a' natural spring at the north end of the pond which can be seen in dry seasons. He observed that water routinely comes up to where the foundations are proposed, every spring. He feels the water seems to rise higher and stay longer since the woods have been reduced and the area has been changed. He feels the area is much too flooded to build on. James Garland, 277 Central St., has lived in neighborhood since 1935. His property goes down from the road; water collects in his yard and feeds the pond. He expressed the opinion that building houses in this area would be risky, and that "a lot of wetland has been destroyed in that area over the years." He asked what effect such a substantial cutting of trees would have on the amount of water in the area. Marybeth Maclntyre, 253 Central St., lives behind lot 3 and expressed concerns that if the pond swells, water will run off onto her property. Mr. Merrikan reiterated that the only way they could calculate the flood plain was by formula, because they had no historical data or observations. He stated that it is up to the commission to decide whether historical and on -site observations should change those calculations. Mr. Merrikan suggested that the commission will have to sort out the pictures and how they correspond to the flood plain determined by the calculations. One of the pictures submitted had a test hole with an elevation; some Pictures and observations submitted by abutters were made available to the commission and to the applicant's representatives. Ed McCann, 7 Noonan St., submitted pictures from December 192. I MANSFIELD CONSERVATION COMMISSION MINUTES MONDAY, AUGUST 23, 1993 -- PAGE 3 Mr. McCalski asked to identify some of the locations of the pictures. Rod Stearns: Storage has been squeezed as a result of development and that may be why water is routinely coming up so high. Looking at the bank from Mrs. Stearns' property might give the commission the elevation lines needed for more accurate calculations. She gave permission to the commission and to the applicant and his representatives to go onto her property for this purpose. Day Colony will go out on the site and try to correlate pictures with site talcs. MOTION: To continue the hearing to site walk on 9 -11 at 9:00 a.m. and 3:00 p.m. on 9 -13. (Sadowski - Powers; all in favor) VOTED WETLANDS PROTECTION ACT HEARING CONTINUATION - SE211 -433 Balcom Realty Corp. - -Fruit St. (Map 34, Parcel 51) -- Grading, driveway, utilities within 100 ft. of wetlands Ralph Maloon presented a revised wetland line on plan. Gave more room for grading in back. Soil types notation added. Note added re finger -like projection. Rev. date 8- 23 -93. Alan Drown also present. MOTION: To close the hearing. (Powers - Sadowski; all in favor) VOTED MOTION: To issue orders as written. (Powers - Sadowski; all in favor) VOTED WETLANDS PROTECTION ACT HEARING CONTINUATION - SE211 -434 Dalcom Realty Corp. - -S. Main St. Plat 14, Parcels 20-22, part of 13 -- Within buffer zone, construct detention area /swale & remove house /garage Ralph Maloon and Alan Drown present. Revised plan presented. Removed Swale, put 12" pipe, extended hay bales, added contour lines etc. as requested at the last meeting and at site walk. Note added to plan: trees to be saved whenever possible, in detention area. Dick suggested a grate on the 12" pipe, because of its location. He asked whether this epresents a new outfall to the Rumford River which would require a NPD stormwater discharge permit; a special condition should be added 'regarding this possibility. [new conditiMVOTED Include a condition about appropriate oil tank and/o soil removal from the house being taken down: add to con MOTION: To close the hearing. (Powers - Weidner; all in favor) MOTION: To issue the orders as discussed. An old tin shed has been removed; the applicant proposes to replace it. Tree cutting was done and loge stacked; the branches should be spread around, according to Chairman Cauldwell. Because of the quantity of branches etc., Comm. Powers suggested removing them altogether. The applicant would like to fill in a "finger" of wet area but was advised not to include that work in this filing. Such filling would be problematic j under a Determination. An enforcement letter describing cleanup work should accompany determination. Other commissioners can see tree clearing area. Walk site at 4:30 p.m. 8 -24. MOTION: To close Hearing on shred construction. MANSFIELD CONSERVATION COMMISSION MINUTES MONDAY, AUGUST 23, 1933 -- PAGE 4 (Sadowski - Powers; all in favor) VOTED MOTION: To issue a negative #3 determination, allowing only shed construction and noting that no filling is proposed. \. (Powers - Sadowski; all in favor) VOTED MOTION: To send letter -requesting that the applicant work. with Dick to appropriately remove branches etc. with possible commission re- inspection. (Powers - Weidner; all in favor) VOTED SITE WALKS: Conrod Court 3 -28 at 7:30 a.m.; Deerpath following at 8:00 a.m.; South St. on 9 -11 at 7:30 a.m. CERTIFICATE OF COMPLIANCE: SE211 -130 ERICK ROADIDONNEY LANE. Any work on lots 1 and 2 will require additional filing. Brook has been cleaned nut and graded; Dick. is satisfied with, grading and cleaning. MOTION: To'issue a partial release for SE211 -130 for Erick Rd.' and the stream cleaning only. (Powers - Sadowski; all in favor) VOTED MILL POND: Apology received from Town Manager. FULTON FOND DAM: MOTION: To issue letter requesting that emergency measures be taken to protect wetland interests (flood control and fisheries) etc. with an eye toward replacing the structure appropriately so that this problem of deterioration does not recur. (Powers - Sadowski; all in favor) VOTED LETTER FROM BOB MORRISON, OVERALL CONSTRUCTION, regarding Mill Pond offering to deepen the pond at no cost to the town. Comm. Powers suggested acknowledging letter with thanks, with a cc to the Board of Selectmen, and also noting that before such work could be done, an assessment Must be done, permits must be secured, etc. with thought given to amounts of gravel to be removed, effects on pond, etc_. Dick Lewis suggested that given the low water- levels, this might be a good time to do some borings for the Mill Pond work. Commission gave go- ahead to do test borings. Dick will mention it to Bob Swanson. MOTION: To send above letter as discussed. (Powers - Sadowski; all in favor) VOTED RE- ORGANIZATION: The Town Manager has announced that effective 9 -7 Dan Clifford will be head of the Highway Dept. and Dave Archard will be in charge of the Water Division; Bob Swanson will be in charge of engineering. Comm. Powers suggested trying to get a maintenance plan from DPW, Water, Sewer. All three need some understanding of what is expected of them in maintenance issues. The commission will send a letter- requesting the Town Manager's cooperation in getting those three division treads to prepare such maintenance plans and discuss them with commission as above. MOTION: So moved. (Powers - Sadowski; all in favor) VOTED Carl Nelson: Chairman Cauldwell urged Dick to get Atty. Mangiarotti moving on this matter. The meeting adjourned at 11:15.
