CERTIFICATES OF COMPLIANCE:
Releases requested for lots 6,779,9 from SE211 -434. Drainage is
in but not functioning because it has not completed to the street.
Lot 7 has work on drainage remaining, but most can be done within
easement. Work also remains on Lot 6 (for example, house must be
taken down). Comm. Powers suggested issuing a partial release, to be
held until the house is down. Lots 8 and 9 are out of the buffer zone
entirely.
MOTION: To issue a partial on SE211 -434 on lots 8 and 9, with
the status of 6 and 7 to be reviewed next week.

WETLANDS PROTECTION ACT HEARING
Remus Realty Trust - -Lot 83, Donald Allen Drive -- Single family
dwelling, driveway, septic, grading within 100 feet of wetlands;
compensation for previous filling
Michael Trowbridge represented the applicant on behalf of Ralph
Maloon. Seventy -five foot minimum adhered to for septic. Roof drains
to dry wells, siltation controls shown.
Comm. Sadowski has concerns about the nearness of the corner of
house to the edge of wetlands. Limit of work is about 15 -20 ft. from
edge of wetlands. Add note to plan specifying silt fence and hay
bales as well. Mr. Trowbridge was not able to tell the commission
whether the wetland line is taken from the original subdivision plan.
Comm. Powers feels a field inspection is necessary, and is
dissatisfied with one done in winter under the existing snow cover,
given the problems which have occurred on this site. Dick asked that
the wetland line 1e fla ed (as it was for lot 844) on the original
line. R%Wold RC we- ands were according to original subdivision
plan. Questions 'remain about how and when and by whom the replication
will be done. Plans should indicate that the filing is for house
alone, not for the replication work shown.
MOTION: To continue to 2 -14 -93 (with site walk on 2 at 7:30)
at 8:00.

Mansfield, over 100 in N. Attleboro, and many more in Attleboro are
served by the system, which is currently under orders from the state
to improve the facility. Over the years four chemicals stored and
used at the site. One more may be added, if mandated by the state.
Existing gravel beds function well but are being classified as not
providing enough filtration; succeeded in having area classified as
alternate filtration, but disinfection capabilities must be enhanced.
A certain percentage of certain size particles must be removed;
disinfection balances the imperfection of the filtration process.
Disinfectant processes include ozone (too expensive), pre -
chlorination, and chlorine dioxide (eliminated by the state as a
possible use). Aqua - ammonium could be used with chlorine, if
regulations become even more stringent.
Limitations and constraints exist as to size of tank (27 ft.
high): contact time, footprint on a tight site, etc. New process
building will replace old building. Old building will remain intact,
inside will be renovated. Submersible pumps will be used. New access
roads will be required. Existing sanitary system will be eliminated,
new system has been approved by Mansfield Board of Health
(2500 gal. tight tank). Miscellaneous site work: better, safer
access, some tree planting, restoration of vegetation. Security fence
around whole site. Fence around whole settling pond. Some lighting,
between structures. Gates. Some cleaning around surface intake
(which is a silted -up area).
Resources affected: Majority of site lies within 100 -year flood
plain. Extensive areas of bordering land subject to flooding, bank,
( and land under "water body will be disturbed. Mitigation to the
maximum extent possible has been planned. No work within bvw.
The applicant does not believe that the pond is significant to
wildlife. Submission to Natural Heritage, no response as yet. Four -
toed salamander is species in area, requires sphagnum moss, which was
not found on site. Asked that Dick review areas cited by DEP. Dick
asked for copy of revised plan showing diagram of intake structure.
Issue in flood storage is cubic footage: came to about 600 cubic yards
of fill /positive displacement. .1" represents the increase in the
100 -year storm event. Compensatory flood storage: applicant's
attitude is that it is up to the regulating body to decide whether
their submission is adequate (they ran out of room to do any more than
that shown). Powers asked for written info re cubic ft. capacity of
compensation allowed for as well as an explanation as to why it is not
feasible to add any other compensatory storage.
Bob S(PrVA4 abutter in area, present.
Large trucks would regularly deliver chemicals to the site.
Typically unmanned, automated facility. Currently building is heated
with oil burner; new structure will have same system (also above
ground, interior tanks). No external alarms.
Comm. asked that calculations re isolated land subject to
flooding be = ubmitted for review; Comm. Powers requested that town
engineering dept. review them. Comm. Powers also requested a
maintenance plan so the commission would know what types of regularly
scheduled -activities would take place on the si.te.
Special pormi!: hearing scheduled with Planning Board for Feb. 3.
MONDAY, JANUARY 24, 1994 -- PAGE 4
Mr. Leonard Flynn asked to see set of plans submitted, locus-,
etc. Intake structure and dam not to be affected, just the silt. No
plans to make changes to Flake's Pond. Consultant will provide
documentation as to the number of gallons per day Attleboro is
permitted to draw.
Mr. 501'0 asked about maintenance of gravel, given that sand and
silt are dumped there now, within the buffer zone. Commissioners will
sulk the site.
The commission also requested dewatering information details.

LOTS 1 -3 JENNIFER DP.. SE211 -355; -336.
Mr. Foutas has requested an extension to 10- 15--94 of the
replication work deadline which was included within the Orders of
Conditions. Comm. Sadowski suggested requiring the applicant to
submit a schedule, with miles -tones for completion.
Commission wants an estimate confirmed by someone willing to do
the work, acceptable to the commission. Comm. Powers noted that
passbook accounts_- must be kept by town treasurer, and only with full
vote of commission can the account be released. Commissioners are not
comfortable with the lot being sold and/or a foundation put up
before 'replication is done.
Construction sequence with milestones plus cost estimate would be
required for any extension of the condition in the order.
MOTION: To issue the extension of the order with bonding as
discussed above and as 'recommended in Dick's memo.
