Mr. Lenny Flynn read to the commission a copy of letter from Town Counsel
Mangiaratti; parcels LT2 and LT3 will be returned, with the remainder to be held by the
DPW for future highway construction. B0 s. Mr. Flynn recommended that the town
accept what is being offered, along with retaining the right to use all of the land (including
that being retained by the state) for conservation land. Mr. Flynn also requested approval
from the commission to notify Greg Bialecki at the Conservation Law Foundation to
appeal Mr. Kerasiotes' decision to, begin the process of getting back the additional parcel
of land. Mr. Flynn has talked to people in the right -of -way division and the highway
design group; they have no involvement in the matter, which is being controlled by Mssrs.
Kerasiotes and Corcoran..
On related matter, Mr. Flynn wants to set up a meeting with the Beagle Club, to
discuss how their land can best be protected.
It was agreed to send a letter to the Board of Selectmen accepting the land return as

the property. where the Back Bay Brook (in the form of a buried culvert) runs. An
existing garage will be removed and a new one will be constructed, which will be further
away from the easement. The resource area'is across the street from the work; and Dick
sees no problem. .

Bob Stupes from Camp, Dresser, & McKee represented the applicant. Even though

2outside of the 100 -year flood plain: The 126 and 127 contours have been expanded to
provide for compensatory storage, resulting in a net gain instead of a net loss of flood
storage. Regarding the isolated depression on the south side of Balcom St., calculations
have been provided to show that the area holds 0.013 acre feet of water; an amount which
is not regulatable. Regarding chlorine tank maintenance: there will be inspection once
every 10 years, and it is unlikely that it will be taken out of service any more often than
once in.twenty years. A maintenance plan has been submitted. regarding hand cutting of
vegetation, removal of shrubs, grasses, etc. along the roadway. In emergency situations:
most alarm signals go back to the West St. facility in Attleboro, which is manned 24 hours
a day. Mansfield would then be contacted. Fire alarms are automatically routed to .
.Mansfield. De- watering plan has been submitted. Regarding amounts of water which can
legally be withdrawn; a _copy of the permit has been submitted, as have water use records.
Sedinientationlerosion control measures around stockpiles: no changes proposed.
Never would two ponds be drawn down at the same time.
Comm: Powers requested a copy of the consent Order, as well as. a copy of the -
construction schedule. The schedule may be developed.by the contractor, as part of the
bid. Include in the orders a condition about notifying the office about pre- construction
meetings etc.*
No word received from Natural Heritage program.
In response to Comm. Sadowski's lack of comfort with the itude a contractor might .
have, the applicant's representative suggesting setting performance standards in the orders.

WETLANDS PROTECTION ACT HEARINGS (FIVE - NOTICES OF INTENT)-
Creative Housing Co., Ina- -Lots 1 -5, Wagon Wheel Way (Bay Brook Farm,.
Branch St. area) -- Single family houses and related grading within 100 ft. of
wetlands
Mr. Ralph Maloon represented the applicant, Mr. Harry Blackey, who was also
present. The five Notices of Into were filed for the five lots on left side as you enter the
site, backing up to Back Bay Brook. Since the lots are not in water protection district, no
dry wells are proposed. The road is substantially up to sub - grade; the crossing is done and
pipe' are in. Grading lines shown on plan for houses is conceptual only; box is where
construction activity will take place, but does not represent an accurate plan for house.
Walk -out rear pitching toward brook, front drains toward street. All types of houses
proposed will fit in the boxes shown. Closest point of alteration in b.z.: within five feet of
wetlands. A lot of the area has been stripped or scarred from previous activity; so the
back yards need to be stabilized in some way; that is why the limit of work shown is rear
lot lines. Comms. Powers and Sadowski noted that Lots 3 and 4 are especially
problematic with lawn proposed that close to wetland. They suggested some other type of

vegetation which will not foster further encroachment by a future homeowner. Mr.
Blackey suggested beach grass as a possibility, since it is low maintenance, not
comfortable to walk through, and would require no additional topsoil. Include condition -
about limiting extent of lawn area, keeping lawn at least 25 feet from the edge of wetland;
Comm. Powers noted that she would rather have the builder than the homeowner grade
the area and do the planting. .
