This lot will not be impacted by the Natural Heritage Program guidelines. New location for flag 14 marked on plan, but buffer zone line must be changed to reflect the change in flagging. MOTION: To close the hearing. (Weidner - Powers all in favor) VOTED WETLANDS PROTECTION ACT HEARING: SE211 -457 Natural Heritage, Program will want some restrictions for lots for the hearing following. Flagging will be finished probably by Saturday; site walk 7:30 4 -9. This hearing will be re- opened 4 -11. MOTION: To continue to 4 -11 -94 at 8:40. (Powers - Weidner; all in favor) VOTED The Natural Heritage Program is recommending conservation restrictions in this area; these require a fairly lengthy, formal process which follows the deed of the property. The program representative recommended that the commission put a four -month period of time during which the restriction must be implemented. _Comm. Powers recommended that the commission require proof of filing (for each individual lot involved) at Registry of Deeds before construction begins. [This information will be_ repeated at the meeting on the 11th.] REQUEST FOR DETERMINATION OF APPLICABILITY- -Lots 16 & 17, Patty's Road. The large pile of material is on lot 16 and is now shown on plan, rev. date 2- 28 -94. The pile, will be screened on site, with smaller boulders going to a crushing plant. Siltation controls have been pushed back. The lines that go M040494. WPS ,I- y-9N not approve plan as currently exists but needs to research jurisdictional aspects. In the swamp: can remove dead trees only (mark and have inspected by Dick when he inspects hay bale line. Between 124 and his existing limit of clearing: Comm. Sadowski would prefer to allow him only to place mulch and native lowland shrubs in that area, since he believes that creating a buffer strip which won't have pesticides, fertilizer, etc. is justifiable. Comm. Powers suggested a 20 -ft. buffer all the way around from edge of wetland which would be left alone. Comm. Weidner voiced the opinion that if Mr. Quinlan has to cut down a tree in the wetland so he can build a garage, there is a problem, Chairman Cauldweil supported the idea of a 20 ft. buffer all the way around. CERTIFICATE OF COMPLIANCE, 384 - Dana Colby Only three lots out of 27 have been released so far; wants release of lots 80 and 62 (Eastleigh Estates North) These are high and dry lots. MOTION: To release lots 80 and 62 from SE211 -384. (partial) (Cormier - Weidner all in favor) VOTED WADING RIVER DISCOLORATION: [Comm. Powers left meeting for this discussion.] Test reports done in March haven't revealed any problems, and the river is running clear now. Attleboro Superintendent of Water Dept. took water samples out of ponds at two locations, but nothing turned up. Comm. Weidner noted that DEP has an emergency response team and could be called for quicker action in this type of situation. ROAD ACCEPTANCE DISCUSSION: Tara Estates: Dick was up there last Monday and feels the problems are being dealt with. None of the affected lots were those about which the Commission had been concerned. Basin on Mystic is fine. Dick will check with Dan Clifford, but doesn't think there are Conservation concerns with any of the other roads up for acceptance. Meeting adjourned at 10:15.0 M040494. WPS
