MINUTES: 4 -28 -94 - PAGE '2 WETLANDS PROTECTION ACT H_ EARING CONTINUATION_ -. LOTS .82A AND 83A, Massapoag Estates. - SE211 -468 Ralph.Maloon was present, as was Ron Bonvie. Paperwork for file number not yet received.. Mr. Bonvie asked if it could be closed subject to DEP file number. receipt, since he has been given the number by telephone. Dick explained he can get an order ready for May 9 and close the hearing on that night. Two catch basins planned as a result of planning board.hearing request. Current filing is for drainage easement itself, there is already an existing order for lot 83A = the area including the drainage outlet and stone Swale: Comm: Sadowski suggested hay bales around the catch basins until area stabilizes. - Final treatment of the bottom: stone, loam and natural seeding (more like a meadow). MOTION: To continue to May 9 at 7:49.' (Oberlander - Sadowski; all in favor) VOTED WETLANDS PROTECTION ACT HEARING CONTINUATION -SE21 -465, Patrick and Eileen Walsh, Deer Path Lane -- Construction -of Deer Path Circle and related utilities Within -100 ft. of wetlands. Site walk was held. -Concern was stabilizing slope without interfering with habitat. New plan presented showing riprapped slope for stabilization purposes. Mr. aloon, representing the applicant, stated, that he is .open to proposals other .: than that represented by the plan submitted -for example; he could put matting down as well.' : Comm: Weidner approved of the idea of matting, as did the rest of the commission. No other .questions. Consensus: as long as stabilization is achieved,_ matting maybe used:but is not required. ,Acting Chairman Powers raised the question'`of whether the drainage ditch itself is considered a resource area, or is being stabiliied for the purposes of protecting water quality. It is a. long drainage ditch which is vegetating as wetland; there is standing -water at ` base of channel, but little vegetation on the slopes.. Consensus: primarily a water quality issue at this location at this time. MOTION: ` To close the hearing. (Sadowski - Oberlander; all in favor) VOTED WETLANDS PROTECTION ACT HEARING CONTINUATION - SE211- 457: Remus Realty Trust, Lots 19,24,.64-.67, & 100, Patty's Rd. & Elyse Rd. -- Houses, driveways; related grading. .Mr. Bonvie has cooperated with Pat Huckery of the Natural Heritage Program in drawing lines protecting the habitat within these lots; these lots include some MANSFIELD CON. COMM..MINUTES: 4 -28 -94 - PAGE 3 Upland. lvlr Bonvie wih submit the plan for her approval.:. The applicant stated that he n6 longer proposes to build on lots 66 and 67 at this time.. The red line . on the plan shows the actual restricd nat the rear of certain lots which will be deeded in perpetuity: Some lots will only have a 30-40 ft. back yard that is usable.. This whole section of Massapoag'Estates is surrounded by Zola land; Dick reminded the commission that it needs to keep that in-mind in terms of future development. Lot 19, and 22 to a lesser degree, is dght., Dick . asked that he be notified of future meetings with Pat so he can speak with her too: The restriction will be on record, so any potential buyer will be informed about the restrictions. Bounds will also be placed there. The conservation restrictions allow nothing at all to be done._ Inmost cases, there is no limit of construction inside the restriction area; lot 19 is the closest: 'Comm. Sadowski wants to, make sure restriction lines appear. on the house plans as well and would prefer that the orders be conditioned so that the applicant must provide the commission with new plans for individual houses showing the restriction and the limit of work (as approved by the state's Natural Heritage Program) to be drawn upgradient of -the restrictions,, Conservation restriction: should be recorded within four_ months of issuance of order; Comm. Powers feels it should be recorded prior to construction. Dick suggested that no partial certificates would be issued until that.conditibnis met. Lots 66 and 67 Could be conveyed to the commis"sion.for consideration of $1, according to Mr .Bonvie.._Dick Lewis suggested including a finding that due to a change in wetland line relative to conservation restriction, . the- applicant.is withdrawing-from consideration lots 66 and 67: MOTION To close.
