Continuation of Public Hearing for Lot 22B Bird Rd; file number received from the State
(SE211 -476); Motion (Powers/Sadowski to close the hearing; all in favor.
Public Hearing - -Gary Forget , West Street. Notice of Intent for the construction of single
family house; perc test for groundwater witnessed by Scott Leite. Site walk of the
commission postponed from last week due to the applicant being out of town. Plan shows
flag numbers; stone retaining wall will most likely be built to help reduce the amount of
fill in the back, Proposal to build walk out with garage under. Jack McDonald, DMG
Engineering, discussed the groundwater and the design of the septic system. Dick Lewis
asked about the 100 year flood line and whether it falls on the lot. Plan will be submitted
that shows the entire lot with an flood line shown. Commissioners Powers asked about
the separation between the septic system and the wetland line; Title 5 will, at a minimum,
have to be met. Commissioner Sadowski concerned with the driveway in proximity to the
wetland. Jack McDonald, DMG, says that septic and driveway can be moved to remedy
any problems and that drive can be pitched away from the wetland. Several West St.
abutters present. The Kiley's concerned with water shedding off of lot on the other side of
them, going across the front of their lot and through the culvert that the town put in under
their drive. Abutter Don Maxwell also concerned with general water issues in this area.
The question is what will happen when the fill for this proposed lot goes in place- -will it
back up any water on other properties? Agreed the the Commission's site walk will help
to explain these issues. No file number from DEP yet. Motion (Sadowski/Powers) to
continue the hearing till 8:00 pm on 8/8/94 with a site walk on 7/30/94 at 8:00 am; all in
favor.
Public Hearing for Lots 1,2 & 3 Stearns Ave, Request for Determination of Applicability
filed by Fort Realty Trust. The hearing for the three separate RDA's were opened at the
some time since the lots abut each other. Neither the applicant nor the engineer were
present for the hearing. The Commissioners discussed the lots; the wetland line
throughout was fairly generous and there were no real concerns raised with the proposed
activity on lots 2 or 3. Commissioners Powers raised some questions and concerns with

lot 1 relative to the wetland line and slopes in relationship to haybale line and stone wall.
It was felt that this issue needs to be cleared up before lot 1 is closed and voted. Motion
(Powers/Sadowski) to close the hearing for lots 2 & 3; voted 3 -0 -1 (Smith abstains).
Motion (Powers /Sadowski) to continue the hearing for lot 1 to 7:55 on 8/8/94; voted
3 -0 -1 (Smith abstains). Motion (Powers/Sadowski) to issue a Negative 3 Determination
for lots 2 & 3; voted 3 -0 -1 (Smith abstains).
Public Hearing, Maystar Realty, East Street. Notice of Intent for the construction of
single family house. Bill Buckley, Jr. of Bay Colony Group representing the applicant,
describes the lot as fairly level off the road with the steep drop -off to the wetland;
wetland line flagged by Dunn Engineering. There will be some grading to the rear of the
proposed house to accommodate the future garage (which is included in the permit
application); stone wall will also help with the construction of the garage. Groundwater
adjusted to 109 inches for the septic system. Commissioner Sadowski had question based
on site walk with the wetland line in relationship to the proposed haybale; felt that this
needed to be clarified. Commissioner Powers felt that wetland line was at the toe of the
slope; felt that a sturdy erosion control barrier (double row) would be necessary. It was
also asked whether gutters would be installed on the house; if so, drywells should be part
of the project. Several abutters/area residents present. Dennis Grady, Dustin Court, asks
about the separation between the wetland and the septic system, and about the trees that
will be kept on the lot; he also asks general question about purpose of the hearing.
Chairman Cauldwell explains the hearing process; Bill Buckley explains the setback issues
and says that trees will have to be cut to establish breakout grades - -trees that can be
retained will be. Marianne Grady asks about sale of lot vis a vis wetlands present; Mr.
Buckley explained that lot is pre - existing, non - conforming for zoning purposes. Paul
Fasoli, Shannon Lane, feels that wetland regime in this area is changing, and he has
general concern with the amount of development in the area. He also worries about the
cumulative impacts of this development. Commissioner Powers says that the cumulative
impacts cannot be considered on separate lot applications such as this. Abutters /residents
present say they wish that the big picture could be looked at. No DEP file number yet.
Motion (Sadowski/Powers) to continue the hearing to 8:15 pm on 8/8/94 with a site walk
on 7/30/94 at 9:15 am; voted all in favor.

water flows. Motion (Powers /Sadowski) to close the hearing; all in favor. Motion
