RIM Engineer and a new set of plans dated 9/26/94. The new set of plans showed the
house situated in the fiont of the lot which eliminated the crossing of the wetland.
Commissioner Sadowski stated that this plan was much more satisfactory. He commented
on the need for additional siltation control around the existing foundation, if the
foundation was to be removed. Ms. Powers stated that the notation of a 48x28 footprint
2
of house was a good size and she felt that this was a good use. She was also concerned
with the siltation control around the existing foundation. The commission and the owner
discussed the possible removal of the existing foundation. It became apparent that the
notation of the plans were left from the previous plan. Mr. Jerome will relay this
information to Mr. Maloon and have the notation removed. Now that the house is being
situated on the front of the lot there is no need to remove the foundation. Amotion was

ABBREVIATED NOTICE OF INTENT HEARING: (continuation) Andres
Gazzolo - -10 Reservoir Street -- regrading of approximately 50 square feet of site
adjacent to parking area within 100 feet of a wetland. SE211 -485.
It was brought to the Commission that there was a situation that occurred and the
regrading area had expanded from 50 square feet to approximately 2700 square feet. Mr.
Lewis had discussed this with the engineer from Bay Colony Group and also with
representatives from the D.E.P. Mr. Lewis informed the Commission about this
conversation with the D.E.P., he stated that the review process for an abbreviated notice
and a full notice of intent were identical. The D.E.P. recommended that to eliminate any
confusion that a new file not be opened and to proceed on with the File SE211 -485. A
note would be made in the file that the applicant had submitted an application for a Full
Notice. Chairman Cauldwell stated that he was concerned at the situation and would like
an explanation of how this happened. He also told the Commission that he had recently
viewed the area and noticed that the siltation fence was secured, as requested, and the
slope was cut so that any run -off would shed towards the parking lot. Mr. Bill Buckly
presented the plan for the applicant. He told the Commission that he was unsure how the
area was enlarged and clearly it was an error. The revised plans were dated 9- 14 -94. He
stated that other than the grading there was no additional work to take place in the buffer
zone. Mr. Karl Clemmey, South Main Street, an abutter, had some comments. He was
concerned that there was not an additional notice to abutters sent regarding the grading
change. He also stated that Shirley Hanlon was not a member of the Conservation
Commission at the time the project was filed. Chairman Cauldwell assured Mr. Clemmey
that Ms. Hanlon had attended site walks and was familiar with this project. Chairman
Cauldwell also stated that he was concerned that the grading area was enlarged without
notification to the Commission prior to the commencement of work. Mr. Clemmey also
brought up some other questions and he was directed to talk with the other boards or
committees that deal with those issues. Chairman Cauldwell stressed that the
Conservation Commission is concerned with the wetlands and the impact that the work
may have on them in accordance with the Wetland's Protection Act. A motion was made
to close the hearing. (Powers /Sadowski) The motion passed unanimously. 4 -0 -0.

he would like to pave his driveway. He mentioned that since Maple Street was repaved
that there is no runoff into the wetland in his fiont yard. Commissioner Sadowski stated
that on the sitewalk he was concerned with the accuracy of the plan measurements. He
expressed his concern over the possibility of there being a hydraulic connection with the
wetlands on the adjacent lot at the rear of the property. Commissioner Powers stated that
in her opinion this wetland was an Isolated Land Subject to Flooding (ILSF) and that this
project was not a buffer zone issue. Chairman Cauldwell wanted to know why the
driveway paving was not allowed originally. According to Mr. Lewis no reason was
given. A motion was made to close the hearing. (Powers/Hanlon) The motion
passed 4 -0 -0. A motion was made to issue an RDA with a negative 1
