PUBLIC HEARINGS 7:30 p.m. Mass. Highway Dept. -- Request for Determination of Applicabilty Re: Route 495 in Mansfield Reahabilitation and resurfacing of 485 feet of Rte. 495 with work within 100 feet of a wetland resource area. Toni Maguire presented plans for this project. Some improvements to drainage outfalls will occur. Motion: [Boyer /Cook] to close the Hearing. Vote: 4 -0 -0 Motion: [Burke /Cook] to issue Negative 3 Determination. Vote: 4 -0 -0 7:40 p.m. Maystar Realty Trust -- Continued Notice of Intent Hearing Re: Lot 2, Chandlers Way [off Branch Street] Construction of house with associated grading with work within 100 feet of a wetland resource area. Greg Spier reviewed the new plans. Slight changes in grade line shown on plans. The File Number is 211 -573. Motioi.c [Smith/Cook) to close the Hearing. Vote: 4 -0-0 Motion: To issue the Order of Conditions, with hay bales in place. Vote: 4 -0 -0 The ditch in this area was reviewed and the contractor will hand dig out and put rip -rap in. 7.45 p.m. Brian Kuras -- Request for Determination of Applicability Re: 37 Bird Road Construction of house with associated grading with work within 100 feet of a wetland resource area. Town of Mansfield Conservation Commission Meeting Minutes September 22, 1997 Page 2 Brian Kuras was present for this Hearing. Mr. Kuras supplied a set of plans extending some clearing of trees behind the house. He would like to clear an additional 30' to put in a swing set and sandbox. The closest this gets is 50' to the wetland. Motion: [Cook/Boyer] to close this Hearing. Vote: 4 -0 -0 Motion: [Cook/Boyer] to issue a Negative 3 Determination. Vote: 4 -0 -0 7:50 p.m. Willowdale Golf Course Installation of well and pump system for irrigation with work within 100 feet of a wetland resource area. Hay bales will be in place and work should only take one day. Motion: [Smith /Boyer] to close the Hearing, and issue a Negative 3 Determination. Vote: 3 -0 -1 (Mark Cook abstained.) 8:05 p.m. Town of Mansfield -- Continued Notice of Intent Hearing Re: Fulton Pond Dam Remedial repairs, including replacement of spillway, tree removal, and associated work, to the Fulton Pond Dam. No file number has been issued. No information has been received from D.E.P. Motion: [Boyer /Cook] to continue this Hearing at the October 6, 1997 Meeting at 7:45 p.m. Vote: 4 -0 -0 8:20 p.m. Balcom Realty Trust -- Continued Notice of Intent Hearing Re: Lot 1, Steams Avenue Construction of house with associated grading with work within 100 feet of a wetland resource area. Chairperson Hanlon would like to put in the Order that if any changes are made, they must bring it back before the Commission. Siltation was also reviewed. Motion: [Cook/Boyer] to close the Hearing. Vote: 4 -0 -0 Motion: [Boyer /Cook] to issue the Order of Conditions (double siltatation control along where sewer wells were.) Vote: 4 -0 -1 (Bill Ottiavani arrived and abstained from the motion.) Town of Mansfield Conservation Commission Meeting Minutes September 22, 1997 Page 3 8:30 p.m. Bolcom Realty Trust -- Notice of Intent Hearing Re: 242 School Street Construction of office buildings with parking areas and associated grading within 100 feet of a wetland resource area. Ralph Maloon discussed this project. The Storm Water Managment Form has been filled out but the person at D.E.P. in charge of this was on vacation and they have not received approval at this time. Mr. Maloon still has questions concerning the 100 year storm plan. Motion: [Boyer /Cook] to continue Hearing to Monday, October 6, 1997, at 8:05 p.m. Vote: 5 -0 -0 8:45 p.m. Hub Folding Box Co. -- Notice of Intent Hearing Re: 45 Norfolk Street Construction of building and parking lot additions with work located in, and within 100 feet of a wetland resource area. Roy Schiff was present to review the site plan with the Commission. Mr. Lewis will review this site. There will be someone on site to do the site walk with the Commission. Motion: [Boyer /Cook] to continue this Hearing until October 6, 1997 at 8:20 p.m. and a site walk to be held on October 4th at 7:30 a.m. Vote: 5 -0 -0 9:05 p.m. Robert Bullock -- Request for Determination of Applicability Re: 181 Essex Street Construction of House with associated grading with work within 100 feet of a wetland resource area. Mr. Bullock was present at the Hearing. They have moved over the driveway at Mr. Lewis' request. Mark Cook and Bill Ottaviani walked this site. Mr. Lewis did not see any problems with this project. Motion: [Smith/Boyer] to close the Hearing. Vote: 5 -0 -0 Motion: [Cook/Boyer] to issue a Negative 3 Determination. Vote: 5 -0 -0 9:10 P.M. Siobhan Fitzgerald -- Request for Determination of Applicability Re: Lot A Essex Street Construction of a house with associated grading with work within 100 feet of a wetland resource area. Motion: [Ottaviani/Ccok] to hold a site walk at 8:15 a.m. on Saturday, October 4, and to continue the Hearing on Monday, October 6th at 8:30 p.m. Vote: 5 -0 -0 Town of Mansfield Conservation Commission Meeting Minutes September 22, 1997 Page 4 Certificates of SE211 -444 Lot 7,113 Balcohn Street Motion: [Cook/Smith] to issue a Full Certificate of Compliance. Vote: 5 -0-0 SE211 -545 Joseph Guarino, 1000 School Street Motion: [Cook/Smiih] to issue a Full Certificate of Com fiance. Vote: 5 -0 -0 New Business September 8, 1997 Meeting Minutes: Motion: [Cook/Ottaviani] to accept Minutes as amended. Vote: 5 -0 -0 Police Station Parking Lot — Certification of Emergency Motion: [Ottaviani/Boyer] To authorize issuance of Certification of Emergency regarding clean- up of contaminated soil in parking lot area. Vote: 5 -0 -0 Town Counsel -Deeds The Town Counsel is preparing the Schulz property in the Great Woods . The closing will be held on September 30th. School Street Some excavation is being done for footings. Special Town Meeting There will be a Special Town Meeting on November 17th. The Conservation Commission has submitted one article. They need to get Town Meeting vote for Conservation Restriction Language in the Warrant Article. Chandlers Way Mr. Lewis will look into the Drainage Ditch work that is being proposed.
