4. VISITORS
At 8:OOPM Lawrence Costa, 35 Southpark Lane, asked for a variance from the well
regulation, which requires a 100' setback from existing and abutting septic systems. Mr.
Costa's is 67'from his septic system. The well is already installed, hooked up to
underground sprinklers, about 15 feet deep, and at a lower grade than leach field. Mr.
Costa was not aware that a permit was required when he installed the well. Agent
recommends variance, and that it be recorded at the Registry of Deeds so that future
Page 2, Minutes, September 4, 1997
owners of this property know that the well does not conform to the regulation and that a
variance was granted.
MOTION: To approve variance as requested and that variance and
well plan be attached to septic plan file in BOH Office.
Forget/Leonard. 4 -0 PASSES
5. HEALTH AGENT'S REPORT
a. Community Septic Management Plan: The offer with this program is $200,000
for a low interest loan at 5 %. The Management Plan mandates that anyone who
has a septic system in Mansfield would have to have their system inspected at least
once in every seven years or pumped once in every three years. Concern is
managing the finances of the loan through our Treasurer's Dept. and cost to the
community if someone defaults. Concern also would BOH Office maintaining
records of septic systems, i.e., when pumped and/or inspected. The $100,000 loan
program is less stringent, but still not recommended by Agent. Mansfield is not a
community with neighborhoods with failing, expensive to repair, septic systems.
Consensus of Board was not to pursue.
b. Well Inspections, Non - Permitted Wells: Twenty -nine letters were sent out and
ten responded so far. Some were installed before 1982, some existing when house
was purchased, one submitted plan, one objected to doing a plan because he
thought it was considered "agricultural" due to the ambiguity of the regulation.
Board will allow Agent to inspect wells without permits and draw a plan showing
the distance from septic systems. Chairman commented that this reg must be
reviewed and clarified. Agent will present changes at October meeting.
c. Troy, 171 Ware St: Order has been sent to repair system. Return receipt has
been returned. September 6, 1997 is their due date. Design was okay; however, it
was for 12 bedrooms, not 24 that are actually there. System was installed in 1989
or 1990 and spills over the ground.
MOTION: To contact Town Counsel to file a court complaint.
Leonard/Forget. 4 -0 PASSES
d. GIS Needs Assessment, Senior Tax Program: Will get a couple of proposals for
a needs assessment before the special town meeting in October. Agent would like
to hire a senior citizen, under the senior tax program; this person can scan plans
into the system. Board agreed.
e. Air Conditioner at 6 Park Row: Continues to be too loud. Air conditioner may
be a unit suitable for industrial use, not in a residential neighborhood. Noise has
not been mitigated to run below acceptable levels.
Page 3, Minutes, Sept. 4, 1997
MOTION: To order the town of Mansfield to shut down the air
conditioner at 6 Park Row until it meets air pollution
control regulations.
f. Household Hazardous Waste Collection: Presently we have $12,069, plenty for
a Spring '98 collection. Member Forget suggested highway garage for next
collection. Agent felt that was closer quarters, harder to get people on/off with
East St. traffic, and sits on Canoe River acquifier.
g. Non - criminal Disposition: Will prepare with Karen Doucette, Tobacco Control
Coordinator.
h. Ash Property Trial: Trial in Superior Court, Fall River, Thursday, September 11,
1997.
i. Vacation: Agent will be out week of September 15, 1997.
6. OLD BUSINESS
a. Response to Karl Clemmey: Board discussed approach and contents of a letter.
MOTION: To send letter, as dictated by members present, to Karl Clemmey.
Leonard/Martin. 4 -0 PASSED
7. NEW BUSINESS
a. Complaint from Karl Clemmey: Mr. Clemmey telephoned Dr. Martin on a
Saturday evening during a Jimmy Buffet concert at Great Woods and asked Dr.
Martin to come to Mr. Clemmey's parking lot to view patrons of Great Woods
using a section of land for a bathroom, both men and women. This would lead
someone to believe that there were not enough portable toilets or bathroom
facilities. Dr. Martin commented that this may not be a health hazard, but it is
certainly a decency issue. Board agreed that Agent should meet with Mr.
Montgomery, General Mgr. Great Woods, view the site and ask him for a
solution. A letter will follow after the meeting between Agent and Great Woods.
8. ADJOURNMENT
MOTION: To adjourn at 9:05 PM.
