At 8:30 AM the continued hearing for Edward Troy, 171 Ware Street, was opened. Mr. Troy
was still not present. Health Agent gave a report of events and a packet of correspondence to
each member. On June 18, 1998 an order was issued citing a violation of "discharge of
effluent to surface of ground ". Mr. Troy was ordered to pump daily or when necessary
Mr. Troy responded previously, by letter, that the system was pumped, Units 5,6,7, and 8 and
the lagoon due to an emergency. He also said that there is no requirement to repair the
system. Agent said that Title 5 law requires a system to be repaired upon failure. Mr. Troy
commented that water consumption has been reduced. Agent looked at water records and
found that on the average consumption is 28 gals /day /unit (12). He advised the Water Dept.
of the unusually small amount of usage.
Building Inspector can order the building vacated. Dept. of Environmental Protection will
join the lawsuit. They have inspected the property and will pick up a packet of information
and correspondence today. Member Jones asked if emergency, temporary repairs could be
