VISITORS Steve Bankert, Sue's Ice Cream, addressed the Board accusing Palagi Brothers, Inc. (ice cream truck) of violating Minimum Standards for Food Establishments State law, specifically, scoop ice cream. His concern is bad publicity for Sue's Ice Cream if the alledged violations for Palagi become a public issue. Agent will inspect Palagi's truck and discuss the proper procedures with the driver. 5. HEALTH AGENT'S REPORT a. _ Troy, 171 Ware St.: Attended Court again to give the monthly progress report. Septic system has been designed by RIM Engineering. Agent informed RIM that the variance request must be in writing in order to hold a hearing. Neighbors and tenants will be notified. The question is whether to leave the three tanks or abandoned them and install one large tank. Member Giangarra asked the benefits of three vs. one. Agent replied economics, retention of effluent. Mr. Troy has refrained substantially, but continues to speak to the Judge. b. Hatheway & Patterson/EPA/NPL: Two sheds burned down on Tuesday, May 4`h. DEP anticipates no environmental affects. Gerard Martin, DEP, informed the Health Agent that the Brownfields grant will only stop people from interacting with the surface. It does not allow for groundwater remediation. Therefore, DEP would recommend to turn the site to be included on the National Priority List, which recognizes that there is a problem. The concern for the town is the perception of having a hazardous waste site on the NPL. MOTION: To ask the Board of Selectmen to request from the State that the Hatheway Patterson hazardous waste site be put on the National Priority List, as recommended by DEP. Giangarra/Martin. 5 -0. PASSED c. Memorial Park: Hazardous waste under the basketball court may remain and asphalt over. Product is not water soluable. d. Household Hazardous Waste Collection: Brisk until about 10:00 AM. Slow till closing. Spent about $5,600. Has been declining last two years; maybe have collected the bulk of resident's hazardous waste. Still have about $14,000 in account. Member Giangarra asked if Recycle Park could take tires? e. Rumford River Dioxin: Department of Public Health has not completed its report as yet. A draft report is available, but not for public. EPA will review draft and contact Agent with draft results. It appears that the "fish warning -do not eat" will be permanent. Page 3, Minutes, May 6, 1999, Board of Health C Sugar Spill: The turned -over trailer truck last week on the Rt. 140 ramp has left us with 30,000 lbs. of embargoed sugar, to find a home for. Unfortunately, no company is claiming it. It came from Domino Sugar to Sysco in Norton (never made it to Norton). DPH came to Mansfield to handle situation. g. Great Waves Pool Plan: Agent received call from Forest -Emory, Karl Clemmey's engineer. He wants Agent to call him when the BOH reviews the pool plans for Great Waves. Mr. Emory discussed bathing loads and impact on sewer system. Agent said that until plans are submitted, no comments at this time. It. Edgewood Condo Semi - Public Swimming Pool: It has been discovered that the owner of the pool is not the condo association, but the original owner of the complex, namely Malcom Post. Therefore, Agent cannot approve pool permit to Edgewood Condo Association, because they are not the owners. He can, however, address permit to the Certified Pool Operator. It was also discovered that there is approx. $13,000 in back taxes owned on the parcel of the pool. This has to be straightened out by the Association. 7. OLD BUSINESS a. Review of Sewer Connection Reg: Agent will prepare a draft for review for next meeting. For new construction (septic systems) standards of Title 5 have changed, zoning has changed, also (larger lot sizes). Rather than abolish the regulation, it should be reviewed. "Transfer of Ownership" section should be abolished. It a system fails, must hook up to sewer if sewer is feasible. If someone sells their house, no hook up required. b. 380 Mill St.: A couple of years ago, an agreement was made with homeowner that if sewer came first, house would be hooked up. If not, septic system would be installed. Septic was installed. House is being sold. Question is: Should sewer be hooked up or in light of the future amendment or elimination of "Transfer of Ownership" in Sewer Connection Reg, should hookup to sewer be waived at this time? MOTION: To dismiss any future and /or pending legal action against 380 Mill St. Forget /Gangiarra. 4 -0 PASSES 7. NEW BUSINESS a. Food Establishment Fee Policy: Members discussed the rationale of charging a reduced or prorated fee for food service applications for a change of ownership which occur within the year. Present policy is to charge full amount of fee for any change of ownership at any time, even if it is within days. Policy is no fee for Page 4, Minutes, May 6, 1999, Board of Health change of name of the establishment with the same owner. Board members agreed to think about the new policy, i.e., monthly prorated to '/z fee after six months. 8. ADJOURNMENT MOTION: To adjourn at 8:20 PM.
