condition of the lot at the corner of Brook Street and Robinhill Road. He
advised the Board he had dumped leaves, etc on the property but would now
refrain from doing so. Also he had not observed any alleged rats or snakes
on the lot. He felt that if the lot was considered a health hazard because
of the dead trees than any lots that firewood stacked on them should also
be considered a health hazard.

Sewage Disposal Plan was reviewed for 11 Gale Lane, ABC Trust. Town Engineer
recommended plan approval. Town Engineer did note that the test pits are not in
the test hole areas but the material throughout the lot is uniform clean coarse
gravel. Also a future town sewer connection will be more convenient. Town
Engineer stated normally he would not approve this but because the area is all
gravel he did not feel there would be a problem. Clerk Gasson questioned where
the pits are in relation to where the test holes were taken. K. Clemmey stated
that the rules and regulations of the town of Mansfield state septic systems
must be installed where one of the test holes were done and Title V states that
also. It should be sent back to the engineer to be re- designed to comply with
the rules and regulations and title V. Discussion was held on having another
test hole dug in the area of the pits.

plan.
4. Visitors Agenda
Mr. & Mrs. McKinley of 9 Robinhill Road and Mr. & Mrs. Omer Lajoe regarding
a vacant lot on the corner of Robinhill Road and Brook Street, met with the Board.
Mr. McKinley asked the Board what their reply will be to the letter from the
Building Inspector. Chairman Tartufo noted that the Building Inspector had
made an inspection of the property. Definition of rubbish was read. He noted
it was up to the Board to now determine if this is a health hazard. It was noted
a letter was received from one of the abuttors. L. Diamond questioned whether
concrete and trash are a health hazard. Mr. McKinley noted that the lot is used
by children going to school even thought that is not its purpose. It was noted
by members of the Board this would be considered trespassing but Mr. McKinley
stated there was no sign. He also noted that the letter the Board has admits
abuttors are dumping on the lot. Also that he was not objecting to the rubbish
but the concrete and stumps.
Mr. Lajoie requested that the letter from Mr. Fitzgerald be read. Letter was
read.
Chairman Tartufo noted that the Board did not receive another letter from Town
Counsel and that if he disagrees with what the Building Inspector said he would
hope he would send the Board another letter. Chairman Tartufo advised the Board
he had talked with Town Counsel and he did not feel it was a zoning violation
after making the inspection. Therefore the Board must make a decision if it is
a health hazard.
Mr. McKinley stated he was talking about the building material and said that
Chapter 111, Section 122 -125 gives the definition.
Chairman Tartufo asked the Board what their decision would be if it is a
health hazard. Does this affect the health and safety of the residents.
Motion: To adjourn.
(Chairman Tartufo -no second.)
Mrs. McKinley felt the Board was afraid to make a decision. Mr. McKinley felt
the Board response was different because the owner was present.
Chairman Tartufo disagreed as he felt the Board was
sides. Also he resented the fact that the McIC'nley

K. Clemmey suggested that the McKinleys and the Lajoies go out of the room
and try to come up with a solution between themselves.
Mr. Lajoie requested that the Board tell him what he must do as he would not
do something just because someone told him they don't like it in their
neighborhood. He requested that the Board send him a letter advising him
what to do.
Mrs. Lajoie felt that the complaint had been brought to the Board of Health
and they should make a decision if it is a health hazard.
Chairman Tartufo requested that the Board take some action.
Mrs. Lajoie advised she didn't like it being said they had a health hazard on
a lot owned by them. Mr. Lajoie requested that the whole thing be dropped.
Mr. McKinley stated he would like to see the concrete and tree stumps removed.
F. Gasson asked Mr. Lajoie if the Board were to send him a letter asking that
the stumps and concrete be removed would he be agreeable.
( Mr. Lajoie requested that the Board send him a letter.
Mrs. Lajoie advised that on July 12 they became the owners of the lot and
had inherited the problem.
Chairman Tartufo asked if the Lajoies and the McKinleys would be able to work
the matter out for themselves. '
Mr. McKinley stated he would be willing to drop the issue if Mr. Lajoie would
remove the concrete and the stumps.
K. Clemmey advised he would be willing to go up there and clean -up the lot
if that would solve the problem.
Mr. McKinley advised he would be willing to help.
Motion: That Mr. Lajoe has given permission to K. Clemmey and Mr. McKinley
to clean -up the lot.
(K. Clemmey -L. Diamond, all in favor.) Rest of board free and clear of issue.
Mr. McKinely advised the Board he was satisfied and withdraws his complaint
from the Board.
Dr. Sohn left the meeting and was not present for the following discussion.
Chairman Tartufo advised the Board that he had been advised by the Town Clerk's
Office that out of eight people contacted to renew their pig permits only two
had responded. All members of the Board had a copy of Zoning By -law.
Leon Grant noted he was exempt from the Zoning Regulations as he has a farm.
Farmers with five acres or more are exempt.

Chairman Tartufo noted that what Mr. Grant was saying is that he does not have
to have a license. Also that would be according to the Zoning By -law and has
nothing to do with the Board of Health Rules and Regulations.
Chairman Tartufo and K. Clemmey did not feel that Mr. Grant was exempt.
Mr. Grant felt the Board should be more concerned with the hauling and storage
of grabage. He noted his pigs are grain fed.
Chairman Tartufo noted that the Grants had previously held a license for pigs.
Motion: To send letters to the people on the list that have not responded
stating the Board is requesting if they still have pigs at this time that the
license has not been paid and it is necessary for them to have a license. A
copy of the Regulation 1, permit to keep pigs, will be sent and asking that
they please advise the Board if they still have pigs on their property.
(K. Clemmey -L. Diamond, all in favor.)
Secretary will obtain a copy of the article on pigs.
K. Clemmey will bring everything he has on pigs to the next meeting.
Discussion was held on sending the letter, making an inspection and if they don't
respond to take them to court.
Dr. Sohn returned to the meeting.
Old Business
Chairman Tartufo advised the Board that the Town Manager tried to get in touch
with the Foxboro Board of Health. Chairman and Town Manager met with the Foxboro
Board of Health and they are not interested in a Regional Sanitarian. They did not
feel that one person could do the job for both towns. They need a full -time person.
Chairman called Howard Winsley and he said if we regionalize we would have to split
that one person. Otherwise we wculd not be eligible for the state funding. Foxboro
also do not like the idea of regionalizing with anyone. The Board in Foxboro said
Hedy Surly is in charge of the program. She advised the Board in Foxboro they could
get the funding even if they don't regionalize. A second approach would be the
Federal Grant Money. The article for the Sanitarian has been inserted as a line item.
Howard Winsley will not be able to attend the Town Meeting. The Finance Committee has
not decided at this time what they will recommend.
Chairman Tartufo advised that on the Chokesaver Regulations he had checked with the
Fire Department. At this time they are not sure they can teach the course as it
comes under the Red Cross. They are trying to determine if they could certify the
people that would take the course. They will be writing a letter to Slyvia Queen.
Secretary will contact Slyvia Queen by phone.
K. Clemmey requested that, a one day special permit for the landfill be issued to
Mr. McKinley so that the lot on Brook Street & Robinhill Road can be cleaned.
Motion: To grant Mr. McKinley a one -day special permit.
(Dr. Sohn -F. Casson, all in favor.)
f;. Clemmey requested that the Board meet one night with the Town Engineer to tell
him exactly what the Board wants on the plans that are submitted. K. Clemmey felt that
