First I would like to have the Clerk read the letter to Mr. Grant regarding a Cease and Desist. Clerk Rosenberg: This is dated April 15, 1983 to Mr. Leon Grant, 440 Ware Street, Mansfield, MA. Excuse me this is dated March 10, 1983 a Cease and Desist for Assessors Map 35 Lot 15 Ware Street. You are hereby ordered to discontinue activity at this location. (copy of entire letter is attached) The next letter is dated April 15, 1983 from the Conservation Commission lifting the cease and desist order so that he could remove the unsuitable fill as ordered the Board of Health. (copy of letter attached.) The next letter is dated April 279 1983 from the Board inviting Mr. Grant to meet with them on May 4, 1983 for a hearing. (copy of letter attached) Chairman Tartufo: First of all I would like to have the Health Agent tell us what he found when he went to this property. Health Agent Drown: There was a lot of dumped wood, shingles, concrete, etc. in a drainage area. Chairman Tartufo: At that time you did what? Health Agent Drown: I wrote out an order for the dumping in that area. Chairman Tartufo: And you mailed this letter to Mr. Grant, which was certified mail and signed and received by Pat Grant. Did you speak to Mr. Grant personally about this ? Health Agent Drown: Yes I did and he said he would clean it up. Chairman Tartufo: Does anyone on the Board have any questions? About the letters themselves. Leon would you please identify yourselve and where you live. Leon Grant, 440 Ware Street: Basically I don't believe there are any shingles and there are only a few boards in the water. That piece of property was originally excavated about'1970 to fill in the lots adjoinging, in order to clean out a town ditch. Over the last several years I have been filling it in. Some of the building debris did spread into the water area. I had planned to fill it in. Frank Zarek: Where did the material come from. Leon Grant: There was about a quarter of a load dumped there from the Ford garage. It was a cement floor. It was photographed from the other side. It will be oleaned -up. Someone went down there and dumped on my property. I have taken out six loads. Health Agent Drown: It would take fivepdump trucks to get rid of it. Peter Fontanini: I would like to see the pictures of the site. Leon Grant Hearing Page two Clerk Rosenberg: You were notified on March 10, 1983. Chairman Tartufo: Was it a little bit of a load or was it six to eight loads? Leon Grants There was six to eight loads of concrete and dirt. Chairman Tartufo: Within the six to eight loads there was other material? Leon Grant: No there was partial - -it was a small amount. There was other stuff dumped from the Housing for the Elderly. I have been trying to get into it with a loader that would get up and over. If you look at the back side all you see is cement and stuff. Frank Zarek: There is quite a bit of wood in there. Leon Grant: This is just stuff that was on top. Health Agent: A phone call was received on this. The Conservation Commission had gone out there first. Edward Rosenberg: When do you plan to clean this up. Leon Grant: Because of the rain there has been a problem in cleaning it up. 7o m7✓ Frank Allen, 795 Ware Street: I would like to say the *won wes a -#Uwe IP&V quite a bit of rock in there and they reconstructed the drain. They put fill in the low areas. Health Agent: When is he going to clean this up? Edward Rosenberg: I feel the Board 'expects him., to do it and it will be done. Chairman Tartufo: We will give hime a suitable amount of time to clean it up. If it is not cleaned up the Board will take suitable action.
