Present to appeal to Board to hear their grievances pertaining to Bristol Arms. It appeared that "their" biggest concern is the leaching fields. Leaching field is within 20 feet of Lot #3, Eric Road. Pictures were presented by Ronnie Buck. Accoring to the plan, it is 56 feet from retaining wall to wetlands. Plan was approved 16 years ago, original approved plans showed no wetlands. Mr. Buck feels engineer could be guilty of fraud. The brook is no longer there. Connie Pietrafetta feels work should be stopped on the building and the whole thing reviewed to see if "they" are telling the truth. Ronnie Buck would like Board to see for themselves. Chairman Tartufo stated that Board can only approve information that is in front of them. Residents wanted to know why Conservation doesn't know ponds and wetlands are being filled in. Frank Zarek expalined to audience that a "Bond" is for the completion of a road, has nothing to do with buildings and septic systems. Ronnie BUck stated that Bristol Arms septic systems have failed. Building was built on pre- existing wetlands. Health Agent Leite stated that until it bubbles over the ground and he sees it, he can do nothing about it. Once again it was stated to audience that Board has to go by plans that are submitted. According to Department of Environmental Quality Engineering, until effluent comes to surface we can not say system has failed. Health Agent Leite agreed that there is a problem with older existing building. As soon as anyone sees or smells anything, he will be there. Frank Zarek further stated that everyting is a potential health problem. Ronnie Buck stated that he feels there has been something shady with this all along. According to Connie Pietrafetta, on April 18, 1986, 23,000 gallons of septage were pumped from Village II Condos. . Mr. Cal Vizedom, antique dealer, reiterated to the audience what Health Agent Leite had said, "we need to build a concrete case and then something can be done ". Chairman Tartufo stated that even with a "concrete case" we still have our back against the wall with the court systems. Mansfield Board of Health Minutes May 14, 1986 Page 5 The audience still felt that the proof is at Bristol Arms, the whole thing. Health Agent Leite state, "all I can enforce is the Rules and Regulations ". Mrs. Gerad of 764 East Street wanted to know if "we" (the Board) could not use past experience from Bristol Arms Apartment to aid in making a decision for the new systems. Once more Health Agent Leite stated, "I agree, systems are failing, but until they bubble to the ground, I can not do anything ". Chairman Tartufo commented that the only true way to protect ground water is with sewer, not septic systems. At this point, it was the general consensous of the audience that there appears to be no solution. Health Agent Leite state, "everyone feels the Board of Health is on the side of Bristol Arms, this is not so ". People feel Board of Health should be able to do something about it. Conclusion is: Board of Health has to stay within the law. Roger Vickery, Vickery Motors addressed the Board concerning his being refused a dump sticker. He resides on School Street, Mansfield. His vehicle is regis- tered with dealer's plates, according to Regulations, vehicle must be privately registered. Motion: To waive #8 of Landfill Regulations for Mr. Vickery to have dump sticker. (Frank Zarek - Peter Fontanini - All in favor) 7. Old Business Health Agent Leite spoke to Board pertaining to 18 Webb Place: There is not adequate water, no heat, unsafe, unsupervised children, unsanitary. Health Agent Leite is working with Social Services. Memo to be sent to Bert Cook, Building Inspector to do an inspection. Pertaining to Samuel Talevera: Still no response, appears to be dispute over money between Mr. Folkman and Mr. Talevera. Either way, Mr. Talevera has to be forced to do something. Health Agent Leite asked Board what they want to do, money is stumbling block. Motion: Lwetter to Mr. Talevera informing him he has until next Board meeting to inform Board as to what his intentions are. (Peter Fontanini - Frank Zarek - All in favor) Mansfield Board of Health Minutes May 14, 1986 Page 6 Pertaining to Bristol Arms: Motion: Send letter to Ronnie Buck and Connie Pietrafetta thanking them for coming, explain specific items that are Board of Health issues they can bring to Board.
