as stated in Minutes July 3, 1985, "to approve the percolation tests for
Lots 23 -28, Maplewood II Subdivision subject to the water being 18" ...
In 1985, holes were dug from 6.8' to 8.5' and water was never hit. Watertable
in back lots was at 8'. Mr. Baker stated that he believes the intention of
the motion was to adjust the watertable 18 "- -not to set it at 18 ".
Chairman Tartufo replied "'that the error could have easily been a typographical
one or unnoticed when the minutes vere approved.
MOTION: That the owners of the property dig test holes to be observed by
Health Agent, who is authorized to determine an adjustment in the
field regarding the watertable level.
Frank Zarek /Donald Steele. All in favor. VOTED.
6. Health Agent's Report
Health Agent reported that he is preparing the budget for next year. He will
include cost of a new typewriter, advertising money for proposed changes in
septic system regulations, and a change in the classification of his job
description. Health Agent is classified in the same category as the DPW
Office Manager. Scott's responsibilities are far different than those of
the DPW Office Manager. Chairman Tartufo suggested that Health Agent gather
whatever information is required to substantiate the change in classification.

6. Health Agent's Report Cont.
Septic System repair, Edward Troy, Ware Street, has been settled out of
court. Mr. Troy has agreed to submit repair plan within 30 days and complete
repair within 60 days.
Malcolm Post, Erick Road, Lot 2, (not built on yet) Bldgs. 4,3, and 2 are
all on one lot under a master deed and are discharging more than 15,000
gallons per day, according to DEQE. Therefore, local Board of Health does
not have jurisdiction; however, Health Agent does not have any written
correspondence from DEQE to that effect. Chairman Tartufo advised Mr. Leite
that he request in writing from DEQE a written opinion. Health Agent will
proceed as normal, i.e., observe test holes, until DEQE (or Attorney General's
Office) responds in writing. Health Agent has 45 days from date of submittal
of plan to make a decision. If he does not make a recommendation, then plan
is automatically approved.
7. Old Business
An old oil tank is present on Old Colony Way.
Noise levels at Champion have not yet been monitored.
8. New Business
None presented at this time.
9. Adjournment
At this time, Ed Broderick, Broderick Corp. asked if his request was approved
(read "Letter from Broderick Corp. "under Correspondence). He said he is not
asking for a final determination, just that the soil test be done-- ground-
water is at least 15 feet down. Chairman Tartufo responded that hopefully
some pipes will be installed by next meeting, which is November 19, 1986.
Mr. Broderick replied that he has paid for these perc tests, they were
scheduled for sometime in November and exceptions should be made. Health
Agent offered his fee back, but Mr. Broderick said he did not want it.
Member Steele said he could not reconsider his vote at this time, since
there are other marginal cases. In two weeks, when Members Fontanini and
Rosenberg are present the policy will be reviewed. Mr. Broderick asked
to be on the agenda at that time.
MOTION: To adjourn at 8:55 p.m.
Frank Zarek /Donald Steele
