VOTED Board of Health - 4 - January 29, 1987 6. Carol Dunn, representing a group of concerned Mansfield residents, spoke beiefly about the trash -to- energy proposal. She asked the Board what criteria they would be using to make a decision on the site assignment, whether the Board of Health is required to grant a public hearing to anyone who does not own an interest in the land in question, that the Board consider hiring an independent consultant to address only Mansfield's solid waste problem, eventually finding alternative solutions. Her group was also concerned with the re- scheduling of the hearing to February 19, which is vacation week and many people would not be able to attend the hearing. Chairman stated that his personal criteria would be traffic, emissions and noise, but not limited to those three topics. His impression of Town Counsel's opinion was that it did not matter which was done first; that it was not illegal to proceed with a public hearing. He felt that the hearing would not be over in one night, especially if the Board does not feel it has enough information to proceed. Member Steele stated his first concern is the emissions, both visible and invisible, the traffic route, and can the company deliver on -going maintenance of the plant so that is is going to be operated in a safe and appropriate way, what happens when there is a breakdown of the plant, cohere does the trash go, are there back ups? Member Rosenberg reminded the group that Board members also live in the Town and are as concerned as everyone else. It may boil down to whether or not the facility is right for Mansfield. At some point DEQE is going to close the land- fill. The Town needs to be prepared, to have plans in place for that event. As laymen we all have to understand how these things work, what are the safeguards and technical problems? We'll go through many steps before a site assignment is even granted. Chairman Tartufo stated that he talked independent consultant should be hired it was the applicant's responsibility site. to Mr. Wallace and told him that if an it should be paid for by NEED. Also, to negotiate the lease or sale of the Air. Wallace invited anyone to his office to pick up information and to ask questions. He stated there are many steps to be taken before approval is granted by DEQE. A member of the group stated that once the Board has assigned the site there is is a 90 day appeal period, the focus is limited to that project and there is no turning back. Health Agent Leite wondered if the Board of Selectmen would have some policy or statement before the hearing regarding availability of the land. Motion: To reconsider the original motion for hearing date Rosenberg- Fontanini, all in favor. VOTED Motion: To hold the public hearing on February 26, with a postponement date of March 5, at 7:30pm. Rosenberg- Fontanini, all in favor. VOTED Board of Health - 5 - January 29, 1987 7. Tom Richards, North Attleboro Solid Waste Disposal Committee, discussed some of the work his Committee has done the last 5 months. He presented a copy of the annual report, and a memorandum the Committee prepared. He stated he would like to hold open the prospect of working with Mansfield. 8. The Board reviewed a proposed septic plan for property on Balcom Street at the Mystic Club. The Health Agent reported the water table rose about 60" from October to December. The applicant's engineer re- designed the plan to show an above - ground system. The applicant is requesting variances from Title V and Town of Mansfield Septic Regulations. The Health Agent felt this would be setting a dangerous precedent and recommended against it. Motion: To accept the system as it is drawn, with the Health Agent overseeing everything that is on the plan Fontanini- Steele, Motion withdrawn Motion: To table until a full Board is present Rosenberg - Steele, all in favor. VOTED 9. The Health Agent advised the Board of a problem with the repair of a system at Village II on Eric Road. He was directed to investigate further. 10.
