3. LICENSES
Chairman Tartufo opened the hearing for Grant Enterprises regarding Mr. Grant's
Disposal Works Installer's Permit.
Present was Leon Grant, Warren Grant and Attorney Peter O'Brien, representing
Grant Enterprises.
( On February 12, 1987, Health Agent Leite notified the Board of a repair taking
place at 273 Chauncy Street on January 13, 1987. There was no application
for the repair. Health Agent went to the site and found Warren Grant with an
excavator, a flow diffusor, and crushed stone. The present septic system was
opened and being repaired. At that time, Health Agent recommended to the
Board that Grant Enterprises' license be revoked.
On May 8, 1987, Health Agent advised Grant Enterprises that the Board of Health
voted to suspend their Disposal Works Installer's License, at it's meeting of
February 12, 1987.
Attorney O'Brien could not understand how the Board of Health has the right
to suspend a license with no warning, prior to a hearing.
Health Agent read a paragraph from The State Environmental Code, Title 5:
Minimum Requirements for the Subsurface Disposal of Sanitary Sewage, 11 15.02,
as follows: Disposal works Installer's Permit - No person or firm shall
engage in the construction, alteration, installation, or repair of any indivi-
dual sewage disposal system without first obtaining a Disposal Works Installer's
Permit from the Board of Health. Such permits shall expire at the end of the
year in which they are issued unless earlier revoked for cause by the Board of
Health.
Attorney O'Brien also wanted to know what exactly constitutes a repair, what
is the procedure.

Health Agent Leite explained the process: When someone takes out a
license for a repair, he goes out to the site, they open it up and look
at the problem. Health Agent either makes a recommendation, or an
engineer may be hired. Then, installer can go immediately ahead, with
no waiting period.
Mr. Grant stated that they were trying to determine what was wrong with
the system; it was an observation hole only. He commented that he fully
intented to inform the Health Agent; he has never done an illegal repair
in 27 years of business.
Member Steele responded that digging a hole is one thing, but to bring in
gravel and other material, it is a potential repair.
Chairman Tartufo closed the hearing.
Motion: To reinstate the license of Grant Enterprises.

matter of record in the meeting minutes.

6. OLD BUSINESS
- Budget - Member Steele questioned why Board of Health secretarial position
is limited to twenty hours per week.
Health Agent explained that it is a part -time position and if we are going
to expand it, we must go to finance committee and justify more time.
Member Steele suggested that for the next budget, we should go for more time.
- Canoe River Aquifer Advisory Committee - Chairman Tartufo explained to the
Board that at the last meeting, the Water Superintendent from Easton, who
is the Chairman of this committee, gave each town a copy of the report by
I.E.P., the consulting firm hired that did a study of their Aquifer. Along
with this report was a list of recommendations I.E.P. felt should be implemented,
dealing with zoning, Board of Health, etc. Chairman Tartufo feels that we
should review recommendations from I.E.P. and see if there are merits; the four
towns should assemble their regulations, since we have a common goal with the
Canoe River Aquifer.
Regarding grant money, the Town of Norton will'be the lead applicant; one
community has to be the lead applicant and administer where the money comes
from.
