Board members.
6. HEALTH AGENT'S REPORT
- Ed Troy - Judge has set court date to September 30th. Health Agent Leite
asked the Board members if they want to continue with the court, or wish
to condemn. If the Board chooses to condemn, they'll have to put people
up until the system is repaired and the town recovers money from Ed Troy.
Board members agreed that since the judge has set the court date, to let
the courts take care of it right now.

The Board members discussed their concern regarding the pending lawsuits
of Ed Troy and Malcolm Post, and the lack of legal action being taken by
Town Counsel John Dwyer.
Motion: To send letter to Board of Selectmen requesting additional Town
Counsel and legal assistance. Due to extraordinary workload of the
existing Town Counsel, these cases have not been handled expediently.
Edward Rosenberg /Peter Fontanini. All in favor. VOTED
- Soarses Sanitation - In January, the Board approved application for
Cesspool Cleaning and Pumping Permit, pending approval of truck inspection
by Health Agent. Soarses now has decided they do not want to pump in
Mansfield, requesting their $75.00 application fee to be refunded.
Health Agent informed Scares Sanitation that $75.00 fee paid in nonrefundable.
- Health Agent informed the Board of his upcoming vacation, September 14th
through 18th.
Motion: To request that Town Manager, Rande Wilson, allow the Board to
appoint Bert Cook as Acting Deputy Health Agent. This appointment is on
an emergency basis only.
Peter Fontanini /Edward Rosenberg. All in favor. VOTED
7. OLD BUSINESS
- Closing of the Landfill. Member Zarek and Member Fontanini are very upset
that the Town of Mansfield closed the landfill at this time. They strongly
feel there was no justification for it and would like to know on what basis
was the landfill closed.
Member Steele is concerned that no written engineering reports have been
received.
Member Rosenberg suggested that the Board should find out what is happening
with these engineering reports.
Chairman Tartufo agreed that the first step is to request an update on
what is taking place; the Board of Health should receive copies of any corres-
pondence the Town is getting from Engineers.
Again, Member Zarek could not stress enough his concern that the Board has
not seen any documents stating the landfill should have been closed.
Motion: To send letter to the Board of Selectmen advising them that the
Board of Health would like an update on the progress of the closing of the
sanitary landfill, and forward information regarding all testing and their
timetable for closure plans by September 15th.

8. NEW BUSINESS
- Underground Storage Tanks for Household Oil in the Water Protection District.
Member Fontanini feels that the Fire Department should have a record of
where these tanks are, and these tanks should be inspected periodically (like
tanks at gasoline stations).
Health Agent brought out literature herecently received on this subject from
the State of Massachusetts.
Member Fontanini will review this book.
9. Motion: To adjourn at 9:50 p.m.
