Mansfield may receive maximum award of $5,946.23. Health Agent Leite explained to the Board how this program is run. The program will take place in April or June of 1988. SRPEDD will hire a con- tractor that handles disposal of hazardous waste. A designated area will be set up where people will bring the material. The contractor will have a chemist there that will do all handling of hazardous waste material to be placed in drums, and then will be carted away. Chairman Tartufo wanted to know how the total cost of this program will be controlled. Health Agent responded that when maximum amount is reached, the program is shut off. Member Fontanini is concerned about what will happen to the rest of people ( bringing their material when program is shut off. Health Agent feels there has not been a first time program run in the past that hit anywhere near capacity; many people do not participate. Member Fontanini asked if we had enough money in.our budget in case amount set is exceeded, for a contingency plan. Scott will look further into this. Clerk Rosenberg asked the Health Agent how the Town will come up with the required matching funds of $3,500. Health Agent explained that it could be done through a special Town meeting, or solicite private donations. Clerk Rosenberg also wanted to know what is considered a hazardous waste. Health Agent responded that the chemist will determine this. Clerk Rosenberg feels that educating the public on what is a hazardous waste should be part of this program. - Copy of letter dated August 20, 1987, from Vaughan Steeves of D.E.Q.E. to Compo Industries, acknowledging receipt of application concerning the proposed permit restriction to maintain classification as a non -major source of V.O.C. emissions. - Copy of letter dated August 19, 1987, from D.E.Q.E. to Michael McClanahan of 76 Bellavista Avenue, acknowledging receipt of application filed in accor- dance with the wetlands Protection Act. - Membership application for Massachusetts Association of Health Boards, Inc. HEALTH AGENT'S REPORT - Health Agent Leite informed the Board ofafew oil spills. One was at the old O.I. Plant. The spill was from two fuel tank drums which were pumped dry three years ago. Health Agent is not sure how this happened. D.E.Q.E. will be cleaning spill on Monday, September 14th. One drum of waste oil. was found on Nick Harris' property at the end of Jewell Street. Another drum full of unknown material was also found. D.E.Q.E. will investigate. Board of Health Minutes Page 4 September 10, 1987 - Health Agent recently attended a Power Recovery Systems Conference in Cambridge, with the Solid Waste Committee. He found the conference extremely informative. What made it most interesting was that the speaker was actually in this industry and in technology, in comparison to a saleman trying to sell this project (which the Health Agent has heard at a previous conference). Health Agent discussed what he learned at this conference and answered questions the Board wanted to know on this topic. - Clerk Rosenberg asked the Health Agent for a status on the repair of Sam Talavera's septic system - 561 -563 Ware Street. Health Agent Leite responded that he went to location were deep hole was dug on the right. He looked at the soil which is the same. The water line goes down the middle of driveway. Motion: To approve septic system with watertable at two feet. Peter Fontanini /Frank Zarek. All in favor. VOTED - Clerk Rosenberg also wanted to know what is happening with-Ed Troy. Health Agent informed the Board that Ed Troy is in District Court. A conference is scheduled for September 30th, between Ed Troy, Scott and the Judge. Ed Troy must tell the Judge why he has not repaired the septic system. Chairman Tartufo made note of this date; he would like to attend meeting. - Results from water samples taken from 793 Ware Street were received from Eastern Analytical Laboratories. No asbestos was found in this water sample. 7. PUBLIC DISCUSSION Peter DeTrolio - 92 Rumford Avenue, Bob Ledger - 50 Lantern Lane and another resident of West Mansfield appeared before the Board to express their concern about the noise level at Great Woods. The residents want to know if the Town has rules and regulations on sound; are there State laws; is Great Woods violating the law? Clerk Rosenberg responded that there are no local regulations, but there are State regulations and laws. Member Zarek explained that the sound level cannot go ten decibels above the background noise. Mr. Ledger showed the Board members the sound monitoring device he has been using to monitor the sound levels at Great Woods. His sound readings indicate the sound exceeding the ten decibels. Board of Health Minutes Page 5 September 10, 1987 Clerk Rosenberg explained that oneof the problems with making a regulation is enforcement. The Board is well aware of the situation. Reports and com- plaints have been received from the Town Manager's office; the Board of Selectmen have had several meetings with Steve Lombardi, General Manager of Great Woods. Clerk Rosenberg feels the Town should take more control of performers who are performing. Residents responded that the contract with Great Woods is not written to that affect. Clerk Rosenberg feels that there is no reason why the agreement with Great Woods cannot be amended. Member Zarek stated that the problem should be addressed to the Board of Selectmen, the licensing authority. The licensing authority should set the ground rules. If there is a health problem, sound levels over the ten decibels, then the Board of Health can get involved. Health Agent Leite stressed that he has told residents of Norton to complain to their local Board of Health, about the noise going over the Town boundary. D.E.Q.E. can then take action. Again, Clerk Rosenberg explained that it is easy for any Board who has juris- diction to pass a regulation; the problem is enforcing the regulation. Mr. DeTrolio asked if it would be feasible, over the winter, to try and figure out a way of enforcement. Chairman Tartufo assured the residents of West Mansfield that this problem is something that has not been dismissed and put aside. It has been discussed on numerous occasions, to try and find a method of accomplishing a way to implement and enforce a regulation to protect the public health, which is basically what the Board of Health has put in a recent letter to Steve Lombardi. 8. Motion: To adjourn at 9:15 p.m. Frank Zarek /Peter Fontanini. All in favor. VOTED Respectfully submitted, Beverly Rooney Recording Secretary K / /Y / Edward Rosenb rg, Clerk Date
