Communications Copy of a letter from DEQE to The Kendall Co., detailing the installation of three boilers at the fossil fuel utilization facility located at Kendall Health Care Products, Mansfield Corporate Center, One Hampshire Street, Mansfield. The Department agreed to approve the application provided that they are notified when construction of the boilers is completed and they are deemed operational, and The Kendall Co. provides access for combustion efficiency. Copy of a letter from The Southeastern Regional Planning and Economic Development District outlining thesoil erosion program. Copy of a letter from Bruce Montgomery of Great Woods, summarizing the activity at Great Woods through June 14, 1988. According to Mr. Montgomery, only one out of the five concerts observed could be classified as having high levels of sound(Depeche Mode). Copy of a letter from Alyson F. Burleigh, Project Manager on behalf of Catalyst Waste -to- Energy of Mansfield. Includes the Environmental Notification Form for the Mansfield Resource Recovery Facility. 4. Visitors At 7:53, Mr. Peter DeTrolio lodged a complaint about the noise level of Great Woods, specifically concerning the night of June 30,1988, when a comedien, Sam Kineson was performing. The comedien used a great deal of profanity in his performance, which was objectionable to Mr. DeTrolio. He called the police to ask them to do something about this, and was told that there was nothing that could be done. He called Great Woods, and claimed that Mr. Montgomery did not believe that he could hear any of the performance. Mr. DeTrolio does not believe that anyone should be subjected to material like that if they do not want to be. He said that if some of the concerts are inaudible, then all of them should. Mr. VanSplinter said that the weather often has a great deal to do with the audibility of the sound, and that The Board of Health, in conjunction with Great Woods, is trying to combine all of the factors involved in order to find the answer to Air. DeTrolio's question. Mr. VanSplinter also noted that the state regulations classify anything over ten decibles above baseline as unacceptable. Mr. Steele said that if artists won':t agree to the levels, Great Woods should be prepared to close down. Bruce Montgomery said that Great Woods is trying to cooperate, and they had no lawn speakers on the night of the Sam Kineson Board of Health -Z- July 7, 1988 performance. He also said that Great Woods recieved no other complaints throughout the concert. Mr. VanSplinter put forward some suggestions to try to resolve some of these problems. They include: Making Great Woods the recipient of all complaints, and having them put all of the pertinent information on record. Also, having Great Woods submit a summary of the decible ranges of concerts, and a summary of the complaints they have recieved. Also, having the Board of Health monitor potential problem concerts to respond to complaints and to see what goes on. Lastly, having an information program to explain decible levels to people. It is very misunderstood, and perhaps with some cooperation from the newspapers, some comparable levels could be shown for points of reference. Mr. Steele said that although the situation is not perfect, he feels that it is improving, and the fact that progress is being made is encouraging. Mr. Montgomery said that the difference between readings done in the pavillion (where the sound is controlled by the artist) and on thelawn (where it is controlled by Great Woods) is greater. He said that every artist has a different sound system, and that there is not a knob that can be turned down to lower the overall sound. Mr. Steele had a question about the John Cougar Mellencamp concert, where there were several complaints about the noise. Mr. Montgomery responded that it was a bit louder than it should have been, but the artist had threatened to leave, so it was decided that it would be better to let him play a bit louder than normal than to cancel the concert with the customers on the way. He does not think that this is going to become a trend, and he added that artists are sometimes difficult to deal with. 5. Health Agent's Report HA filed three more complaints about Edward Troy, and went to a hearing on July 7, 1988, at which Air. Troy was supposed to but did not attend. This did not please the court. HA suggested that perhaps it is time to condemn Mr. Troy's building. It was decided to request a formal written opinion from the town attorney as to what should be done about this. HA reported that Samuel Talevera was supposed to have the septic systems at 561 -561 Ware St. repaired by July first. His contractors were unable to meet this deadline, and promised to have it done by July thirteenth. If it is not done, the HA will go to SuperiorCourt. HA reported that the law firm of Ring, Rudnick, Grefe & Freed,P.C. is withdrawing as legal counsel on the Post case. HA reported a circus train behind Conlon and Donnely, which is a severe health problem. The residents dump their waste water onto the ground, and their living con- ditions are not acceptable. They were told to repair the problems or they would not be allowed to return next year. HA does not believe they will come back. HA reported that the town manager has announced the salaries for the new fiscal year and wants to do employee evaluations. HA reports to the Board of Health, not the town manager, so the board will do any evaluations of HA, not the town manager. It was decided to send the town manager a letter stating that the board will do any evaluations of HA, and will be willing to forward a copy to the town manager, if he so desires. HA reported that he, and many other people, did not get the full amount of the raise that was approved at Town Meeting. It was decided that in the letter will be a comment about HA being given the wrong salary, and the board will be glad to discuss it with the town manager. Board of Health July 7, 1988 1 6.Pending -3- Mr. Steele said that there should be a group of people around town from whom we can get response about the progress of Great Woods. He said that there is a benefit in keeping the issue alive. Mr. Zarek said that it is good that theGreat Woods Representatives and the neighbors are talking, because Great Woods is not going to go away. HA reported that Forest Park is being sold and broken up into smaller subdivisions. Mr. Zarek said that the board is supposed to go over subdivision plans. Mr. Zarek suggested that a follow up be sent to Broderick, since they were supposed to do a Water Study on Forest Park and hve not. 7. Adjournment MOTION: To adjourn at 9 :10 p.m. Zarek /Steele. All in favor. VOTED. Respectfully Submitted, Jennifer Af. Crotty, Recording Secretary Clerk Date
