Chairman Rosenberg expressed concern re: Town Counsel's opinion for Siting Approval as far as which takes precendent- -State law or Town Meeting vote. Board of Health must know for sure which way to go when they receive the application from Catalyst Waste -to- Energy Corp for site approval so that the best interests of the Town of Mansfield are protected. Letters will be sent to DEQE, Bureau of Solid Waste Disposal, asking if Town Counsel's opinion would be in conflict of 310CMR16.00 and a letter to Town Counsel asking what takes precedent - -State Law, 310CMR16.00, or Town Meeting Vote, Article 9 of the 1987 Special Town Meeting within the Annual Town Meeting. 4. VISITORS Bruce Montgomery, General Manager, Great Woods Performing Arts Center, was in attendance to update Board members re: noise complaints. Weather conditions have a significant impact on noise levels. A clear, cool evening will allow . noise to travel faster, whereas a hazy, hot and humid evening will prevent that. Mr. Montgomery feels that Great Woods will never reach a point where it is not audible to the neighborhoods. A helicopter has been used to check the inversion Minutes Board of Health 2 September 1, 1988 layer and break up noise, performers have been asked to maintain a 95db level, a phone line has been set up to receive complaint calls, log will be maintained and data will be looked at to relieve those areas that hear Great Woods frequently, performers, who flagrantly exceed the maximum db level, will not be asked to return, architectural changes of the pavilion will be looked into to encompass the sound more effectively (acoustical clouds lowered), and overall cooperation from Great Woods have been on -going this past year to resolve the noise problems. Larry Harrington, Chairman Board of Selectmen, stated that the Board is concerned with the lateness of concerts and would like an assurance from Great Woods that a concert will begin on time and end at a reasonable hour. He also questioned why DEQE measures sound on "A" scale, rather than "C" scale. Health Agent responded that A scale is the averaging scale and an actual assimilation of what we can hear. C scale would be used in a sound studio where there is no background sound or interference, a confined and controlled environment. John Sullivan, 15 Village Road, Peter DeTrolio, 496 Elm St., and Robert Anton, 70 Oak Street, were present and quite displeased that the sounds they hear vibrate the walls of their houses and are a constant annoyance. Even with windows closed and air conditioners on, they hear Great Woods. Mr. VanSplinter stated that if people do not call Great Woods when the sound annoys them, then there is nothing Great Woods or the Board of Health can do. A mechanism has been set up, logs will be maintained, Board members and Bruce Montgomery are willing to cooperate; however, residents must call in to Great Woods. Discussion ended at 8:45 p.m. 5. HEALTH AGENT'S REPORT - Health Agent telephoned Maryanne Powers at the Mental Health Clinic to discuss with her what the benefits are for the Town of Mansfield for the $5,400 per year contracted fee. He will contact Ms. Powers. - Health Agent reported that Compo still owns property on Branch Street, even though the chemical operation is moving.
