BOARD OF HEALTH January 5, 1989 -3- d. .Copy of letter to Town Manager from Board of Health commending Health Agent for a successful Household Hazardous Waste Collection Day. e. Notice from Study Hospital for "Family Support Group for Caregivers of Dependent Adults ", Jan. 11, 1989. f. Notice for "Take Charge" Workshops on Jan. 18 and 28, 1989, at Mass. Dept. Public Health in Lakeville. Health Agent will attend and invited members to join him. g. Proposed 1989 -90 Budget, "A Financial Plan of Services ", Town of Mansfield h. Chemecology, Dec -Jan, 1989 issue Chairman discussed Health budget with Town Manager briefly. Member Fontanini expressed concern with too much littering around Town. He is finding car batteries, tires, and many bulky items disposed of illegally. Health Agent has asked Select- men to permit an "automotive household hazardous waste collection day" in the Spring. There remains $7,000 in budget for that purpose. Concensus of Board is that Chairman should support with Finance Committee original requests, rather than settle for Town Manager's budget. 5. HEALTH AGENT'S REPORT January 6, 1989, 6 -man jury trial for Troy case, failed septic system. Smokey odor is still in air in North End of Town. Not sure where it's coming from. Health Agent feels it's a sweet, yet acrid, odor. He will continue investigating. Agent will speak with Town Manager re: additional insured amount on the Community Health Agency's contract with the Town. Perc tests are slowing down. Will be restarted in full in March. There are 8 -9, 55 gallon drums stored behind highway garage on East Street. Will find out what's in them and what the Town plans to do with them. Member Fontanini suggested that if a quorum is not achieved, then Board of Health should meet during the next week. No support was achieved. MOTION: To grant Health Agent authority to issue a temporary permit when a meeting is not scheduled in a timely manner. VanSplinter /Zarek. All in favor. VOTED. Non - Criminal Disposition for a Violation: This by -law would allow an agent of The Town to issue a ticket for certain violations for a predetermined fine, i.e., junk cars, animal control, etc. Once the ticket is issued, then it's in the hands of the court system. The court has the mechanism to deal with this action. This ticketing might save time with numerous inspections, violations might be dealt with expeditiously, rather than lag on for months. Chairman would prefer other boards and /or committees to join in sponsoring the article for the 1989 Annual Town Meeting. Health Agent will draft the by -law and contact other boards. BOARD OF HEALTH January 5, 1989 -4- Mr. Zarek remarked that this bylaw could be abusive authority, depending on the enforcing authority, and then the Town could be sued. Would rather see a stronger Town Counsel -type of authority rather than this type of bylaw. Board of Health could use this for junk cars and /or failed septic systems. Member Steele asked how it is working in other towns, i.e., Canton and Sharon. The success of the bylaw really depends on a person's attitude towards it. This bylaw would not apply to State law, just to local regs. Health Board members asked to see the finished by law, will read information given to them, and make a decision, whether to submit article at town meeting, at nest meeting, January 19, 1989. 6. NEW BUSINESS Selectmen's meeting on January 11th, consultant will give report on the "black water" problem. Chairman will attend. 7. OLD BUSINESS Member VanSplinter reported that the interim report from the Solid Waste Advisory Committee on the proposed recycling bylaw will be presented at the SWAC meeting. 8. PENDING a.
