VISITORS Steve Benoit presented the Board with a "conservation plan" of 31 Nelson Way, Lot 16 and asked that a variance be granted to install a septic system that will be approximately one foot from the side property line. A variance is also needed for the front property line. The Conservation Commission had delineated the wetland boundary closer than Air. Benoit had originally planned, therefore, reducing the side requirements of 75 feet away from the property line. Agent recommended that a plan be drawn and submitted showing exactly what Mr. Benoit wants to do. Discussion ended at 8:12 PM. MOTION: To deny the variance since it is too close (1 foot) to the lot line. Steele /NO SECOND. MOTION: To ask Mr. Benoit to submit plans showing his proposal and delay any action until such time. Steele /Fontanini. All in favor. VOTED. 5. HEALTH AGENT'S REPORT a. There's a strong possibility of court action against Air. Rettman, Sharon, who owns land on Bird Road. He has not complied with the orders of the Health Agent or the Conservation Commisssion. b. There have been reported three cases of fifths disease in the last two weeks. c. Agent compiled a septic report to give to each member monthly showing subdivision, perc test location, approved septic plan, approved as -built plan. d. The Board of Health deleted effective May 1, 1989 jurisdiction of junk car violations. The 1989 Town Meeting approved junk cars to be under the jurisdiction of the Police Department. However, there has occurred a timeframe where no department has jurisdiction, since Town Meeting occurred after May 1st. Agent will put any requests for junk car violations on his "to do list ", until such time the town meeting article is approved by the Attorney General's office and officially under the jurisdiction of the Police Dept. e. Town Manager telephoned Agent and told him that since the Board of Health rescinded the fees, the reduction in revenue has caused a shortfall in the FY90 budget. f. Agent received two requests for stump dumps. One is on the Hallett II Crossing Subdivision on Fruit St., and the other on Bird Road. Agent also said that he telephoned a company that takes stumps and mulches them. The cost is approximately $200.00 a trailer truck load. MOTION: To deny the requests for stump dumps since there is an alternative to dispose of them in a more environmentally safe manner than burying them. Steele /Fontanini. All in favor. VOTED. BOARD OF HEALTH -3- June 1, 1989 g. Agent will tell Mr. Donut, Chauncy St., to close their doors until the restaurant and kitchen area is cleaned up. Agent has made several inspections; the owner cleans, but allows the shop to become unsanitary soon after. The permit appproved under Consent Agenda will be held until Agent inspects the restaurant and it passes inspection. h. Peter DeTrolio, West Mansfield Variety, called Agent and complained about the oil disposition bylaw and the detrimental effect is has on the small oil seller. Agent suggested to the Board that he will allow up to 35 gallons to be disposed by small businesses that sell oil at the annual automotive hazardous waste collection day. i. The Lead Law has a new regulation that will be in effect on June 15, 1989. Agent must be licensed by July 1, 1990 to test lead paint for Mansfield residents and the Board of Health must purchase the tester. 6. NEW BUSINESS a. Member Fontanini expressed grave concern of the gasoline pumps at Cumberland Farms on Chauncy St. The water flows directly to a catch basin opposite Crocker St. in front of Cumberland Farms. He asked if there are gas or oil traps that will prevent a spill from traveling through all the street catch basins directly to the center of Mansfield and possibly blowing up the center of town if, in fact, there was a gas spill? Agent will look into it. b. Member Fontanini was also concerned with the future construction of homes on Branch St. across from Compo Chemical Co. He feels these homes should be on Town sewage- -not septic - -due to the high watertable. Agent said that Mike Trowbridge of Hutchins and Trowbridge had called him regarding this development. Agent suggested to Mr. Trowbridge that he request from the Board of Health an opinion on the feasibility of septic systems. The Board of Selectmen denied sewer hookups for these homes. 7. OLD BUSINESS a. Secretary Royle asked if the Board wanted the articles on waste -to- energy that they requested back in September of 1988 and that were never received from the Public Library. Concensus was no. 8. ADJOURNMENT MOTION: To adjourn at 9:15 PM. Fontanini /Steele. All in favor. VOTED. Respectfully submitted, Dianne Royle, Recording Secretary C erk Date
