Agent, May 28, 1991, re:
7:45 Phi: Rick Ficco, Partners Quality Lawn Service, Inc.; Don
McMahan, Brewster, MA; Michael Gallogly, Tuckahoe Lawn Care, Inc.; and
Ed McGuire, S. Yarmouth, MA. spoke before the Board to voice their
objections and concerns with the Board of Health Reg on Turf Care and
Plant Regulator Applicators. Their major concern was the formation

local reg which is a duplication of State law and FIFRA (Fed. law),
which they adhere to at present. One of these gentlemen also
represented MALCAP, Mass. Assoc. for Lawncare Professions. They came
to communicate- -not to be adverserial, and asked for the Board's
rationale in creating such a reg.
Response by Board: To create a more local source of into for Mansfield
residents, size and color of sign- -too small, possibility of leak or
spill (need for storm drain cover).
Challenge by lawncare people: Why not regulate exterminators and tree
care people? Homeowner, 75%, fertilize their own lawns (who protects
neighbor then? Costly to pay fee and create new sign when some
companies fertilize in up to 80 communities. Duplication for what's
going on now.
Member Rosenberg commented that Board has every legal right to
regulator more stringent then State law. Chairman warned that the reg
will have to be obeyed if they wish to continue doing business in
Mansfield.
5. HEALTH AGENT'S REPORT
a. Edgewood /South Main St. Area: Thirty wells in the area,
fifteen are still used seasonally. Everyone has been contacted and the
wells that are used have been tested. One resident refused to have his
well tested.
b. Bleachery: Agent and George Young, Health Agent, Foxboro,
inspected the bleachery in Foxboro. No sign of oil coming out of the
pipes. There was a containment area in the sleuceway behind the
building, which was heavily stained with oil. No signs of oil on
Rumford River, but did see a sheen, which is caused by wetland
breakdown.
c. Blane Chemical: Members Steele, Austin, Fontanini and Agent
visited Blane Polymers Chemical Co. on North Main St. and were given a
tour by the manager.
d. East Mansfield Sewer Hookups: Agent suggested that members
take a position re: sewer hookups for new and existing construction
when the sewer lines come to East Mansfield. After discussion, Agent
will present several sample motions at next meeting.
6. OLD BUSINESS
a. Flouridation: Secretary telephoned Martha Wood, DPH to ask
about contents of motion to order flouridation. Also, if Board orders
flouridation and funding is not available, could the Town be sued. She

replied that the possibility is there, but not probable. Approx. nine
communities, that ordered flouridation, are waiting for funding.
b. Fulton Pond: Blue /white pellets appearing on Fulton come from
the Bleachery and are made of polyethelene. They do not break down,
are not a contaminant and they float, Member Fontanini reported.
c. Great Woods Center for the Performing Arts: Member Rosenberg
reported that the first concert, May 26th, Styx, went well. Member
Austin commented that he has rethought the value of the sound survey.
Weather condition variables, few participants (25), expansion of lawn
planned for next year, expense of survey (postage and office time)
were his considerations to delay the survey until the 1992 season.
MOTION: To reconsider the Great Woods survey vote of
May 16, 1991.
Austin /Rosenberg. 3 -2 VOTED
If residents have a complaint, the avenue of telephoning in is still
