VISITORS (This portion of meeting was conducted after the Health Agent's Report since the scheduled hearing was for 8:15 PM.) Hearing opened at 8:15 PM by Chairman Austin for the revocation of the food establishment permit for Old Colony Diner. Present were James Appel, owner, and Charles Mulcahy, Attorney. Health Agent cited a portion of the regulation for food establishments and gave a history of re- occurring violations (cleanliness and food handling), which were cited on June 22, 1990, Sept. 5, 1991 and January 16, 1992. Attorney Mulcahy informed the Board that he and Mr. Appel have addressed what has to be done to comply with the regulations. A cleaning company has been hired to clean the restaurant on the five busiest days of the week, i.e., Wednesday through Sunday, and Mr. Appel will clean on Monday and Tuesday. Mr. Appel is well aware of the seriousness of these violations and realized that one more time could warrant the revocation of his license, namely, his livlihood. He will speak to the waitresses and the cleaning company and make them aware of the severity of the violations and the imperative need to maintain the facility. Mr. Mulcahy stated that "if the license is suspended for even one day, the reverberations throughout Mansfield will be catastrophic ". He continued that Mr. Appel should be on notice that the health agent be allowed to make inspections at any time, and if any of these violations reoccur, then the agent will have the right to recommend to the Board of Health to suspend his license. Member Rosenberg asked if Mr. Appel had ever taken a food handler's course. He had not; therefore, Mr. Rosenberg recommended that he does and that the stipulation become part of the order from the Board. Member Steele asked Mr. Appel what his committment will be? Mr. Appel replied that the hiring of the cleaning company and the fact that he will take a food handler's course will help the situation. Agent recommended that certain tasks be scheduled on certain days for the cleaning company to do. That then becomes Mr. Appel's checklist to ensure that the tasks are being done and done to his satisfaction and according to the regulation. MOTION: That the Board place the Old Colony Diner on probation for 30 days during which time the Diner is subject to inspections by the Health Agent at any time. At the end of this period, a determination will be made to revoke the license. Rosenberg /Steele. Board of Health Page 4 February 6, 1992 f. Brugliera /Parsons, Goward Drive: Mr. Parsons' house has an interested buyer, who is working with him to repair the septic system. g. Edgewood Condos: Attorney General's office is working with Guaranty Trust Bank to construct a system in order to occupy the condos, or if that cannot be done, to consider an on -site small treatment plant. Agent feels that the BOH should not take part in this until such time as the State wants them to. The big question is: If the permit has expired, should BOH require the bank to pull out the old system (under the old reg), which has never been used, and re- install the system under the revised reg? The BOH originally stopped the construction and occupation of the system and condos and then reported it to the State to shut them down. (Member Steele arrived at this time, 7:55 pm). Agent did not expect a response tonight, but asked the Board to think about the question. Member Rosenberg asked for the State's decision in writing. 6. OLD BUSINESS a. Restaurant Inspections: Member Rosenberg asked if they were going okay? Agent said they were. b. Non - Smoking Reg: Member Steele said end of month he will have a report. 7. NEW BUSINESS a. Nonny Boys Donut Shop: Member Steele asked if Agent knew that a bathroom does not function at the restaurant. Agent was aware. b. Agent's Workload: Member Steele has concerns that the Agent does not have the time to handle the workload in the office with the rapid growth of development occurring. 8. ADJOURNMENT ro MOTION: To adjourn at 8:45 PM. Rosenberg /Fontanini. All in favor. VOTED. Respectfully submitted, Dianne Royle, Recording Secretary NEXT MEETING: February 20, 1992. See you then.
