4. VISITORS
Elks: (Member Rosenberg left the meeting for this dicusssion.) Elks
representatives, Conrad Lajoie and Malcolm Smith, addressed the Board with
their concerns that the septic plan for the Elks Lodge, Eastman Street, has
not been approved and they question the need for a variance. Health Agent
reported that he told their engineer, RIM, that the extraordinary
size of the retaining wall they designed requires a variance since the system
cannot be constructed within the confines of Title V; therefore, a variance is
required. Agent then read directly from the regulations.
Mr. Lajoie said that the 30 -day delay that is required for the appeal
period for the variance is outrageous. He said that this is a costly project
and that there have been too many problems; this project is for the town of
Mansfield, Mr. Lajoie continued. Agent said he had no problem with the wall,
but in order to adhere to the law, a variance is required. Mr. Lajoie asked
if monitoring pipes could be substituted for the wall. Agent suggested he go
back to the engineer. It's not the health board's or agent's postion to
design the system; it's the engineer's.
Agent reminded everyone that DEP also has to approve the variance. Board
recommended that the applicants start the process now for the variance, since
they are concerned about the timeframe. They said they would apply for the
variance. (Mr. Rosenberg returned atfer the discussion at 8:07 PM).
Medigen, Foxboro: Chairman Austin reported that he and Chairman of
Planning Board, Bill Madan, attended the BOH meeting in Foxboro to hear the
discussion about the Medigen proposal (expansion of the incinerator on Summer
St., Foxboro). Same discussion occurred at the Mansfield Selectmen's meeting,
March 18th. It was agreed that the Selectmen will coordinate all the info
collected by the BOH, ConComm and Planning Board. Town Counsel will also get
involved on the ground floor.
Three Foxboro residents briefly stated their concerns. They were David
Stevens, Rob Swails and Betty Callahan. Residents within 20 yards of the
incinerator presently there have private drinking wells. The present
operation is proposed to increase in size, from 480 lbs /hr. to 1950 lbs /hr.
The smokestack increased from 24' to 80'. The present site is adjacent to a
dense residential neighborhood, less than a mile from a Foxboro elementary
( school. These residents, quite frankly, would like to see the both towns join

c. Vendor for Household Hazardous Waste Day: Bids were opened on March
5th at 10:00 am at the Town Clerk's office. Based on a projection, laidlaw
came in at $405 less than Triumvirate. Dollar amount can only be based on
projections, since no one knows what and how much hazardous waste will be
collected. Health Agent recommends Trivumvirate, since the town has worked
with them before and knows what kind of a job they will do.
MOTION: To award the bid to Trivumvirate, for the household hazardous
waste collection day, who was a responsible bidder meeting bid
specifications.
Rosenberg /Vansplinter. All in favor. VOTED
The collection is scheduled for April 18th at Great Woods Center for the
Performing Arts, 9:00 am to 2:00 pm.
7. NEW BUSINESS
a. Tifdan Co.: Mr. Benoit, owner of Tifdan Co., recently installed a
septic system without re -apply for a permit. The application had been sent to
him over a month ago. He was reminded to apply and has not been cooperative.
Agent recommends not awarding Mr. Benoit an installers license. He has a
partner, Herb Finley, who was awarded a permit earlier this meeting.
l MOTION: To support Health Agent's recommendation not to renew
Mr. Benoit's installers license due to an uncooperative
past history.
VanSplinter /Rosenberg. All in favor. VOTED

MOTION: To adjourn at 9:20 PM.
