4. VISITORS
Stephen Benoit, who has had an installer's license for 10 -12 years,
claims that he has never had a problem, and now he is faced with revocation
of his license. Installing septic systems is his livelihood and he wants
and needs his permit back. Chairman Austin responded that Mr. Benoit did not
follow the proper procedures, and that a system had been installed without
reapplying for a permit. He had received the renewal form by mail and had
been reminded in person to renew, but he did not. Instead he installed a

a system, asked for an inspection, all without a permit.
Agent reminded the Board that last year Mr. Benoit installed a system with an
expired plan. As an installer, he installed an unapproved septic system. His
permit could have been revoked then, but the Agent attempted to give him a
chance. The last chance came; he did not renew his license, after being
reminded, and installed a system.
Board asked the Agent's recommendation. Agent responded same one stands,
i.e., to revoke the permit. Agent said he could have had Mr. Benoit remove
the system and start again when, and if, the permit was issued.
MOTION: To allow Mr. Benoit to re -apply for a permit with the
understanding that the first time he does not perform
to Title V and the procedures of this office, it will
be revoked.
Fontanini /Steele. 3 -1. VOTED
5. HEALTH AGENT'S REPORT
a. Lawncare and Senate Bill 933: Pesticide companies are attempting to
change the law from allowing municipalities from issuing their own regulations
on applying fertilizers. The name of the bill is 5933. Health Agent drafted
a letter stating that the BOH objects to this legislation, since local Boards
of Health should have the ability to protect their community's health and
groundwater resources (public water supplies). Members willingly signed the
letter.
Lawncare companies are beginning to apply fertilizers. Agent will do his best
to keep on top of them and make them aware of the license that is required.
b. Edgewood Condos: The repair to the septic systems will start next
week. The judge allowed the use of the septic systems until September, 1993,
at which time the condos hook up to town sewer or build their own small
wastewater treatment plant on site. J.J. O'Brien will be the company
installing the systems.
c. Elks: No word from them re: the variance, as discussed last meeting.
d. Medigen, Foxboro: Agent referred to the letters sent by members of
the Board of Selectmen and Planning Board and said that BOH could send a
similar letter. He felt, however, that those two had been sufficient to start
the MEPA process. Parts of the letter do not appear to be factual. Agent did
visit the town offices in Foxborough, but there were no new documents to
acquire.
e. Sturbridge Estates, Eastman St.: Agent has spent several days at
this subdivision witnessing the contractor's attempts to perc. He has
informed them that he will not witness peres until September, when the
watertable drops. The sewer line may be looking more attactive for this site.

The Elks proposed lodge is adjacent, therefore, the sewer line may be looking
feasible for them, too. In September, Agent will ask that two holes be dug to
ensure that the systems properly function. All dewatered peres should be done
in the wet season for a worst case test. If it cannot pass, then they cannot
build on this lot.
f. Peres and Plans: 19 peres and 79 septic plans submitted.
g. Household Hazardouse Waste Day: Scheduled for April 18th, 9:00 AM to
2 :00 PM and the Great Woods Center for the Performing Arts. Volunteers are
needed. Member Fontanini will try to be there.
h. Cholesterol Screening Clinic: Scheduled for April 16th, 4:00 PM to
6:00 PM, Town Hall. Focus on ages 18 -50.
i. FY93 Budget Reductions: Memo from Town Manager requesting that
department heads reduce their budgets for 4%, line by line.
6. OLD BUSINESS
a. Non--Smoking Reg: The model by -law was sent to each member. Member
Steele said much of what is in the by -law, communities are already doing,
i.e., designated smoking areas in restaurants and public buildings. Several
years ago, the BOH sent out a position paper that encouraged no smoking
at public meetings. Boards and Committees voluntarily prohibited smoking
meeting tables.
The controversial aspects of the by -law is limiting sales to minors, under 18
years old, forbidding free - standing displays more than 20 feet away from the
cashier, and controlling the use of cigarette machines. Selling to minors
rests with the store owners, and the BOH could license those stores (following
the Federal model by -law). If there were numerous complaints about selling to
minors, then BOH could revoke license to sell tobacco products. Machines can
be controlled by selling tokens for use in the machine, then the business
would know who is buying the cigarettes.
Member VanSplinter thought that this type of regulation could turn into an
enormous task. It is admirable, but not sure how practicable. He is very
much interested in limiting areas where smoking can occur.
There are multiple parts to the model by -law; how far should the Board go and
what parts are appropriate? If a reg is not produced, then an "advisory"
statement could be issued. Agent suggested the advisory could be sent
with food service permits in June. Member Steele would like copies of the
American Cancer Society newsletter distributed to members, and for secretary
to contact American Heart Association for any info they may have.
Next meeting all info will be brought together, and Board can decide which
direction to go.

if the subcommittee for Great Woods sound would be monitoring as they have in
the past. Consensus was yes.

the septic systems at Edgewood Condos (reconstructing and /or repairing).
Agent is asking for Board's approval. All references checked out fine.
