month's lead time to install the system (one house in Forest Park), and that
he has learned his lesson not to have the customer come before the law.

5. HEALTH AGENT'S REPORT
a. 340 South Main St: One of the tanks containing PCS's has been pulled
out. Air stripping is on -going on site to remove contaminants from the water
and to recycle it to the sewer system to be cleaned again.
b. Village II Condos: Agent was scheduled to meet with the condo assoc.
to discuss a water conservation program to help alleviate the septic problem
they are having. He was told by chair of trustees not to come, since the
association meetings are generally a time for everyone to vent issues. Agent
replied that he would expect the association to disusss the suggestions he had
and to report back to him by April 23rd. They did not respond.
Agent read a letter from AGT Financial Computer Services, Management Co.,
for Village II. There were numerous innuendos and accusations and each was
addressed by the Agent at the meeting and in writing to Ann Grenier- Taylor.
Agent said a notice is in the building stating that the BOH has shut down
washing machines - -BOH never issued that order.
MOTION: To send a letter to Management Company and to Board of
Trustees ordering that certain correction be made and
that the Board is prepared to start the condemnation
process if order is not obeyed.
Rosenberg /VanSplinter. All in favor. VOTED
Both Management Co. and Chairman Board of Trustees were invited to attend a
BOH meeting.
c. Edgewood Condos: A temporary septic system is presently being
installed. Brian Firman, Water Pollution Control, will visit site on Friday,
May 7th.
d. Mr. Parsons, Goward Drive: Hugh Hurley, Freeman Engineering, has
submitted the septic plans for Mr. Parsons. The plans requires a variance
from local regs, i.e., 5' to 4' above groundwater, construction of retaining
wall since breakout grade cannot be achieved, and declaration of an emergency.
Agent recommends approval.
MOTION: To grant the variance as requested and declare project
an emergency for Mr. Parsons, 15 Goward Drive.
Rosenberg /Steele. All in favor. VOTED.
e. Peres and Plans: 26 peres and 91 septic plans submitted.
f. Household Hazardouse Waste Day: Very successful, as usual. Bill
from Triumvirate was $9,610. Eighteen drums of hazardous waste was collected

g. Yarworth Engineering: Agent spoke with Chris Yarworth re: Ware St.
septic repair (installer Tim Boswell). Mr. Yarworth told Agent that Mr.
Boswell did not understand what he was telling him. Agent said that Mr.
Boswell is a very good installer and it could have been a misunderstanding.
Agent gave Mr. Yarworth a verbal warning not to begin a project without BOH
approval.
h. Community Visiting Nurse Agency: A MMR (mumps, measels, rubella)
clinic has been arranged with the Qualters Middle School 6th graders. State
law requires all children entering 7th grade a MMR booster. A report as to
how many were innoculated will be asked for.
6. OLD BUSINESS
a. Non - Smoking Reg: No discussion.
b. Hathaway and Patterson, County St.: Member Steele asked for an
update. Agent replied that the recovery system is activated. Agent will
contact Bill Haynes at H -P and ask for a progress report.
c. Sewer Questions: Will be discussed next meeting.
d. Turf Regulation: Chairman reported that the BOH held a meeting on
Wednesday, May 6th at 6:30 PM, to decide whether or not to appeal the decision
on lawncare reg. Board voted 2 -1 not to appeal. Chairman asked four members
present if they wanted to reconsider the vote tonight. Agent said that town's
attorneys felt that sign would not win, and if the town did win the appeal,
then the lawncare companies would appeal that decision. It could become too
costly for the town, somewhere between $2,000 to $10,000.
Member VanSplinter commented that since we are part way into the process,
we should continue with an appeal, because there's no going back months later.
Member Steele asked if we should have had a specialty attorney? Agent com-
mented that the judge was concerned with the inability of lawncare companies
complying with a variety of local regs. Member Rosenberg questioned if the
correct route is at the State level?
Mass. Aububon could be of no help and Conservation Law Foundation maybe
could help. Attorney Sally Newbury and Agent conversed on the telephone for
nearly an hour. Attorney costs could range from $2,000 to $10,000.
Member Steele felt the route to go is through an educational effort and
conducting lawncare workshops. Member VanSplinter commented that since Member
Fontanini voted against the appeal on May 6th, it would not be fair, without
him present, to reconsider the vote. He also felt that it should be make
clear that the decision not to appeal was based on financial reasons - -not
because the Board feels they were wrong.
