At 8:00 PM John Samia was present to discuss the violations at his restaurant called Nonny Boys, Chauncy St. On August 18, 1992 he submitted a letter stating that he fully intends to comply with the Health Agent's order of August 17, 1992. He outlined all that had been completed and stated that he will close the restaurant down at noon on Sunday to paint. Board members cautioned him that these violations are reoccurring. It was made clear by the Agent that the violations are primarily cosmetic and not related to the food handling end of the business. The Board reiterated that one more order of violations could result in suspension of his license. Board of Health Page 3 August 20, 1992 MOTION: To approve the food service license for Nonny Boys subject to compliance with the law upon the Health Agent inspection. VanSplinter /Steele. All in favor. VOTED. 5. HEALTH AGENT'S REPORT . a. South Main St. /Edgewood St., Groundwater Pollution: Agent spent two evenings with Bill Braille, Textron, and met individually with the neighbors on Leonard Street and Circle who have polluted wells. Purpose of the meeting was to reinforce the severity of the groundwater pollution problem and to answer any questions that they may have. In the Fall, wells will be drilled in the two streets to test groundwater. This is a pilot program to look into the heavy metals on site. This is a second summer of this discovery. Half residents do not use their wells, three use them continuously and two have used them in the beginning of the summer. Those who use their wells use them in the late evening when there is less risk of someone drinking the water. Hopefully the Town will not have to take legal action to stop the use of these wells. b. Edgewood Condos: Will soon be on -line since the State has agreed to let them hook up to the septic systems, for a max of two years. The sewer will hopefully be functional sometime in November 1992. c. Town Manager Assignments: The Town Manager has assigned Health Agent to serve on the personnel policy committee and the annual report committee. Agent has not yet responded and wishes not to serve on these committees since he spent a lot of Health Dept's time on the annual report last year. A personnel policy committee was formed about two years ago and the policy never came to fruition. Agent stated that the policy is for non -union personnel (about six people). It was noted that the Health Agent reports to the Board of Health - -not the Town Manager, and that it would have been appropriate for the TM to ask the BOH. MOTION: To invite the Town Manager to meet with the BOH to discuss Agent's participation in these committees. Steele /VanSplinter. All in favor. VOTED. d. Brugliera /Parsons: Two years ago Mr. Brugliera asked permission to install a monitoring well to measure groundwater. Since the Board said that the well would not be factor in the case of the septic system having been installed in violation of Title V, Mr. Brugliera did not install the well, which could have given him groundwater levels for his case when it reached trial. Mr. Parsons is living in North Carolina, his house in rented and the system is being used. Mr. Parsons might motion to delay the trial until October 20, 1992. 1 Board of Health Page 4 August 20, 1992 e. Inspection Procedure: There is an option when Health Agent is out on vacation. Agent could notify installers six (6) weeks in advance of his vacation so that the applicant can hire his own inspector at his own expense. Member Rosenberg suggested that since East Coast Development offered to hire their own inspector in the Agent's absence, he can do so. However, he feels that the policy of the Board should be decided discussing it with the Town Manager when a full Board is present. Town Manager will be invited to September 10, 1992. 6. OLD BUSINESS a. Non - Smoking Reg: Member Steele suggested holding off for at least three months. North Attleboro's BOH regulation should set the precedent. b. Sewer Tie -In Proposal: Agent distributed draft of Walpole's reg and one that he had written. He suggested a public hearing be held since the reg will affect a lot of people townwide, but Board felt a public "information" night would be more appropriate. Final decision could occur in November 1992. Agent commented that economics will be the issue, but Board feels water quality should be. Discussion continued re: location of dry sewer lines throughout town, requesting sewer commissioners to waive $40.00 tie -in fee, and Art. 1, Sec. 1 that says the hookup must occur no longer than five years after completion of sewerline. Some members felt eighteen months was long enough. Agent will revise draft reg and send each member a copy to be discussed at next meeting. 7. NEW BUSINESS a. Member VanSplinter asked health codes. He said that fungus weather. Agent will look into. if the State has any barber and /or beauty parlor infections are prevalent in this kind of b. Agent informed Board that the Zola Family Realty Trust submitted applications for three lots in the Sturbridge Estates Subdivision that in the Agent's opinion have poor soil, need to have an island created and pump water in the moat. Agent will not allow a perc to be done the normal way because of these conditions. This method will cost the developer more money, but the Agent is concerned that the perc be done the proper way. 8. ADJOURNMENT MOTION: To adjourn at 9:10 PM. Steele /VanSplinter. All in favor. VOTED. R Respectfully submitted, Dianne Royle Recording Secretary MEETING: SEPTEMBER 10, 1992 Date Z,
