Board of Health Page 2 February 18, 1993 Heimlich: Mr. Button reported that the employees at Jimmy's Pub have all taken the "chokesaver" course. He encourages all restaurant employees to be trained. Members thanked Mr. Button for his presentation. 5. HEALTH AGENT'S REPORT a. Title 5 Revisions: Agent gave everyone a copy. Now in draft stages. Acted on and enforced mid -to -late summer. Some sections make little sense, no sense, burden on local boards of health, is political, more stringent in some areas, some things we are already doing, some is land -use by soil determinations. In sum, its a hodgepodge of difference things. b. Composting Area /DPW Garage: Agent sent a memo and gave DEP till March 19th to clean up illegal debris, stumps, etc., and to cease dumping unsuitable material. c. DEP Site Assessment: Since regulations will be changing drastically in July, Marcel Bolitz, DEP, suggested that he meet with the board after July sometime. d. So. Main /Edgewood St., Cleanup: Textron has invited board to view the recovery /cleanup system on Friday, at 2:30 PM. Agent will attend. e. Sewer Hookups: Village I and the first Edgewood Condo building will be hooking up to sewer. f. Housing Inspection Fee: Agent suggested that for multiple inspections in the same location, for example, the Depot, that fee be $75.00 for first, $25.00 for each multiple. He reminded Board that his original recommendation had been $35.00 for each inspection. Board asked how much time he spends on an inspection- -40 -60 minutes with no violations. With violations, it gets very involved. Board's concensus is to keep at $75.00. g. Human Resources: The young lady who needed help has not returned Agent's calls nor responded to West Side Benevolent. Agent will send her a letter stating that if she still needs help to call him. h. Graphic Printers: Agent went to site and could not find traces of hazardous dumping. Agent commented that without probable cause, he really should not be inspecting private property. He suggested that any accusations of this sort be in writing, and the BOH should have a written policy saying so. f. Peres and Plans: 11 peres and 39 plans. Board of Health Page 3 February 18, 1993 6. OLD BUSINESS a. Sewer Reg: Member Steele asked about the second part of the sewer reg. Attorney Joe Hannon faxed the draft today at 3:00 PM. Agent gave everyone copies to review for next meeting. He also asked if owners are hooking up to sewer before tranfer of ownership. Agent had no idea, but agreed to come up with a plan to determine who is transferring ownership. b. Restaurant Inspections: Agent does them when he's in the area with no pattern or schedule. Member Austin wondered if the Agent needs help and suggested that he keep statistics to support the need for part -time help. Member Sosman said that it may be time to prioritize his duties and accept the fact that some of them may be falling to the bottom. c. VersaCare: Board agreed to give VersaCare the opportunity to send detailed reports re: kinds of services with /without insurance, client needs, and the distribution of the $5,400 yearly contribution before a decision is made whether to go out to bid with other agencies. d. Smoking Reg: Over an hour's discussion occurred as to which by law to adopt, North Attleboro's or the model law from the Commonwealth. Agent cautioned that the smoking reg cannot tie into the food service permit, (revocation of food service permit if smoking occurs), which fall under the sanitation code. Martha Wood, DPH, did tell Agent that some towns do include in the smoking reg reference to the sanitation code. Board then discussed how to impose fines when the smoking reg is violated. The non- criminal disposition appeared to be the best vehicle, rather than filing a complaint in district court. MOTION: To incorporate the non - criminal disposition into the smoking regulation. Austin / Sosman. All in favor. VOTED. Health Agent recommended that the Board adopt the State model, which is less complicated and establishes the same thing. MOTION: To adopt a smoking regulation modeled after North Attleboro's. Austin /Steele. All in favor. VOTED. Is the smoking reg enforceable? It will take time and effort, but it can work. Member Sosman asked that as in the State reg, it be optional to smoke by performers on stage, provided that smoking is part of the theatrical production. Board agreed effective date of reg will be thirty days after publication of a summary in the newspaper. Variance request will be made in writing to the Board of Health. Town Counsel will be asked to give an opinion re: revocation of a food service permit if the smoking reg is violated. Board of Health Page 4 { February 18, 1993 MOTION: To include the amendements (effective date 30 days, theatrical clause, variance in writing) and request for town counsel opinion, in the smoking reg.
