5. HEALTH AGENT'S REPORT
a. Hatheway - Patterson: Has received permission from the Conservation
Commission to go into the wetlands for the purpose of removing oil.
b. 10 Erick Road: Agent inspected the crack in the street where raw
sewage odor could be detected. A resident had complained. Member Austin
also inspected and could smell sewage. Member Fontanini inspected and saw a
gray oozing and could smell sewage. Agent will re- inspect and send a letter
to the management /condo association.
c. Versacare: Agent and COA Director, Gail Farrugia, met with
Versacare to learn about their various programs. Very informative and
willing to help in any way. Most of their funding comes from the State.
The quarterly report on types of care and services, promised to the Board,
cannot be done as quickly as thought. When Versacare merged with Youth
Family Service and Human Services of Attleboro, the computer systems were
different. Once they get on line with one system, they will be able to
create reports that are very definitive. Members will then be able to see
where the $5,400 donation is going and what services are rendered.
Member Steele asked about the social worker the COA is asking to hire.
Agent replied that they are looking for an outreach person. Member Steele
cautioned that he would not like to see duplication of efforts. The COA
will be asked to meet with the Board sometime in May to talk about their
needs and how the Board can help.
d. DEP Site Evaluator Training: April 16, 17, 30, 1993, Agent will
attend the Title V Site Evaluator Training sessions that are required to
witness percolation tests under the new Title V law.
e. Low Radioactivity: Police notified Agent that a small bottle of
tritium, a low radioactive material was found off Hope St. The bottle was
sent to Clinical Science Lab on Francis St., Mansfield, to be evaluated.
The result was that is was very low radioactive material. In was disposed
to DP
f. Wellness Fair: Members discussed topics for the fair. smoking,
hazardous waste collection days, oil tray with absorption squares, and the
relationship between Dept. Environmental Quality Engineering and Dept. of
Public Health - -the cycle of health issues.

6. OLD BUSINESS
a. Non- smoking Reg: Member Steele mentioned that in Woodstock, IL,
there is a by -law that controls access to tobacco products for children.
Mass. has a state law that prohibits the sale of tobacco products to
children under 18 years of age. Agent will contact Woodstock for the bylaw.
MOTION: To adopt and sign the non - smoking reg as written.
Steele /Austin. All in favor. VOTED.
b. Art. II, Sewer Connection Reg: Atty. Joe Hannon, who has been
advising with this reg, recommended a public hearing, which is scheduled for
April 15th. Applicant must submit proof to the Board that sewer is not
feasible. The whole reg could be tied up if someone contests that it is a
change to Title 5, since the Board is forcing sewer hookup.
Agent stated that the Board, by law, can charge the applicant for a
consultant to confirm the reasons why the project cannot be hooked up to
sewer.
c. Nonny Boys: Member Fontanini asked if bathroom was working? Agent
said that May 1st Dunkin Donuts may be taking over, and a new building may
be constructed. Member Austin is concerned about the condition of the
building and feels that the Board should not turn its head since the
business is being sold. It's the Boards job to inspect in the best interest
of the customers. If there are continuing violations, it is the duty of the
Board to close the restaurant.
d. Old Colony: Member Fontanini commented that the men's room door is
off and only hot water in women's bathroom. Agent will inspect. Old Colony
employees did take the food handler course.
e. Ladonna: Agent mentioned at this time that when he inspected
Ladonna he saw food stored in used soap buckets and food combined on one
plate.
f. Police Dept: Member Austin asked about the violations cited in a
letter from DPH. Agent explained that the local BOH does not have
jurisdiction over Police Dept. - -the State inspects. Violations in a
workplace, i.e., Codex, would be handled by the Dept. of Labor and
Industries. Violations in a public place, such as a restaurant, would fall
under the BOH.
g. Housing Inspection Fees: Member Austin asked the Board what their
wishes are as far as lowering the fee in reference to Mr. Forget's request
last meeting. Board agreed to maintain the $75.00 fee. A letter will be
sent to Mr. Forget.
Member Fontanini left at 9:00 PM.

h. 1 Villa Street: Members and Agent discussed the Villa St. issue as
related to the letters from Judy Daily and Jeanne Albertini as listed under
"Correspondence ". It was a complex situation whereas the young lady who
resided there did not cooperate with the Agent and that her situation had
to remain confidential. She would not allow him to make inspections, even
with a Police Officer. Agent contacted DSS when he had concerns for the
baby. There appeared to be a lack of communication between the manager of
the building and the other residents. Also, these people could have at any
time contacted the Agent or Chair or come to a BOH meeting to ask what was
happening. Member Austin asked if a similar situation arose, would Agent
handle it the same. He replied yes. Member Austin asked Agent to read the
three letters and help everyone, Board members and residents, to understand
the limitations of the Board. The writers of the letters should be invited
to hear the discussion.
Member Steele, after reading the article in the newspaper, was encouraged
to personnally write down some thoughts and concerns he has. Each member
received a copy.
i. Great Woods Vendors: Agent spoke with General Manager and told
him that if any vendors for food (besides Fanfare) sell at Great Woods, they
will need their own food service permit.
j. TB cases: Member Steele said he heard that there were four TB
cases of school —age children. Both Agent and secretary said they have not
yet received a report, since TB is a reportable communicable disease. A
list of the types of communicable diseases reported to the Board of Health
office will be given to each member at the first meeting of the month.
