HEALTH AGENT'S REPORT a. Brugliera, Goward Drive: Agent spoke with Attorney Joe Hannon who feels that the Town has a case. He would like to defend the Town; however, he also does not want to insult Town Counsel by taking over the case. Member Fontanini asked for an estimate of cost from Mr. Hannon. MOTION: Due to the environmental nature of this case, offer it to Attorney Joe Hannon subject to Town Manager's approval of funding for a special attorney. Fontanini /Steele. All in favor. VOTED Board of Health Page 3 August 5, 1993 b. 170 Tremont St: An enforcement order was sent to J.P. Smith, July 15, 1993, re: illegal dumping ground for construction debris. He is complying with the cleanup and his attorney asked for a 30 -day extension to September 22, 1993. Agent granted extension. c. 21E Conference.: Amendments to the law will streamline the process for a 21E investigation. Smaller spills can now be cleaned up faster and more efficiently. Very informative. d. Conlon & Donnelly Fire: Agent has received many calls re: horrible odor emanating from the site. After an investigation, the odor is coming from the grain and pet food fermenting from the water on the ground. The person who rented the building for storage has been evicted so that the cleanup can begin on August 11th. e. Mill Farm Estates: Massachusetts Historical Society has asked for an archeological dig as recommended through the MEPA process, that occurred since the sewerline is being extended for an exceptionally long distance to reach this proposed subdivision. State reps will be contacted to help in speeding up the process, because the Flints are under the impression that the sewer reg ties into Planning Board regulations. This subdivision plan was approved before the sewer reg, but the plan was voluntarily modified to include sewer. f. Elms Subdivision: Mr. Morse sued the Planning Board for denying his subdivision plan and was denied his motion in court. So Mr. Morse withdrew his plans. g. Smithfield Estates: Located off Balcom Street, J.P. Smith owner. Two out of eight lots passed percolation tests. h. 17 Essex Street: A check for $1,200 was held for a sewer connection coinciding with the passing of the house to new ownership. Agent did not want to hold up the closing of the house because of the timing of the connection, so a check was held. When the work is completed to the satisfaction of the Town, the check will be returned. g. Peres and Plans: 50 Peres and 89 plans. 6. OLD BUSINESS a. Honey Dew Donut Variance: Newport Heating and Ventilation Co. submitted calculations and Agent contacted Pat Newport for an explana- tion. More air exchange requires more fresh air and more fresh air will give less activity with the air conditioning. A larger a/c or "smoke eater" will be preferable. Chair VanSplinter commented that he is uncomfortable with the smoking area preceding the non - smoking area (patrons must walk thru smoking area to get to non - smoking area). Board of Health Page 5 August 5, 1993 the grant is to educate the community about the dangers of tobacco use and long -term goal is to create a smoke -free environment. e. Heimlich Maneuver: Chair continues to be concerned about the policy at restaurants and other food service facilities as to trained personnel in the heimlich maneuver and /or CPR in case of someone choking. He is aware of a laminated -type poster showing the procedure for the heimlich maneuver which he would like to see in all food service facilities. Secretary will contact Heather Champigny, Pupil Personnel Director, MPS, to see if she is aware of how many of her staff are trained in CPR. MOTION: Since it is 9:30 PM, move to continue meeting until business is finished. Steele /Sosman. All in favor. VOTED f. Ethics Commission: Member Steele notified the Board that he and Member Fontanini are business partners and that Member Austin will be renting from them to open a food business. Member Steele contacted the State Ethics Commission re: conflict of interest involving food permits, closures of restaurants, etc. He was told that potential conflict depends on the number of restaurants in Mansfield. The most potential problem would be with Member Austin, where he would be the one actually owning the food service business. Since the BOH is appointed - -not elected - -the Board of Selectmen could then make the ruling, based on fact and advice from the Ethics Commisssion, to re- appoint new members. Chair suggested that the ruling from EC be done in writing. Member Steele agreed. g. Supervisory Union: Agent explained what the Supervisory Union stands for and why it is here. He said that even though he reports to the BOH, the Town of Mansfield is his employer. The Union was form because employees did not have an up -to -date personnel policy. Under the former town manager, pay raises, merit increases, vacation and compensatory time ranged from employee to employee, hence the union was formed to ensure employees fair and equal treatment. Agent said that his allegiance is to the BOH, and he does not nor will not hide behind the Union. He is the shop steward and to date there have been no grievances filed. 8. WORKSHOP A workshop (Standard for Housing) was scheduled, but postponed to later meeting. V Board of Health Page 6 August 5, 1993 9. ADJOURNMENT MOTION: To adjourn at 10:10 PM. Steele /Sosman.
