Visitors At 7:45PM Mike Trowbridge, Hutchins - Trowbridge, presented a request for a variance from BOH Title 5 reg for his client Sandra Franey. (See Correspondence #1, Action Items). Mr. Trowbridge stated that the lot at 1020 West St. is 90,000 sq. ft. and that the 50' setback complies with the State law Title 5, but not the BOH reg. There were many concerns and questions re: PAGE 2, BOH MINUTES, MARCH 16,1995 groundwater elevation, flooding and slope of the lot, proximity to Wading River and if a perc had been done years ago. Mr. Trowbridge offered to meet any conditions that the Agent may require if the Board grants the variance. Agent had no recommendation at this time since he has not yet done a site evaluation. Board agreed to meet onsite, Mon. March 20th, noon, to inspect certain conditions and witness a test hole for groundwater. Member Forget joined the meeting after this discussion. 5. Health Agent's Report a. Sturdy Hospital Luncheon: Agent and CVNA Nurse Chris Delano attended. Dr. Davis, Director of Occupational Health at Sturdy, organized the luncheon. Agent enjoyed the interaction among health agents, public health nurses and doctors. Next meeting June; at which time, local smoking regs will be exchanged. b. Title 5: Repairs have been busy. Agent cannot design after March 31st. Valid rumor is that the Lt. Governor may put halt to the implementation of Title 5 until such time that DEP develops alternative technology. e. Town Meeting: April 10th. Household hazardous waste day article, $12,500. d. Noise Zoning Article for 95 Town Meeting: Agent recommends that Board, if asked at Town Meeting, does not support the proposed noise zoning bylaw for the following reasons: not enforceable, no valid methodology in measuring sound, impossible to monitor, background sound a factor. Agent will mail a copy to members for their review. e. Fee for Repair of Septic System: Agent recommended that the fee for the repair of a system be $100 vs. $300 for installation of a new system. He feels that the homeowner will have other expenses, i.e., backhoe, certification of system, and a $300 fee to the town could be a lot of money for the homeowner. There was little support from members to reduce fee. MOTION: To take under advisement. Fontanini/Martin. 3 -0 -1 Forget opposed. L Industrial Development Commission: Ken Parsons, Chair, IDC, and Agent spoke about a concept the IDC has in formulating a land development law seminar free to members of boards and committees and a fee for others to educate them if they wish to change the laws for development. g. CVNA Request for Additional Funds: Can we ask Town Manager for $2,000 or split difference to support CVNA request? Agent suggested that at end of fiscal years, whatever expense money remains can be sent to CVNA, if they bill us for additional services. d. Smoking Reg Review: Delayed for future date. e. Title 5: Continuing with the review of the present BOH Septic Reg and the newly proposed State Title 5, the following changes were discussed that should be included in the BOH reg that are not in the proposed Title 5. 1.
