Call To Order at 7:30 PM by Chairman Sosman in the Town Hall. 2. Workshop A workshop was held with Charlotte Scozzafava, INEMS Tobacco Control Coordinator from 7:30 to 8:20PM. 3. Visitors At 8:30PM, a Public Hearing was held for Allen L. Willis, Jr. for his Request for a Variance, specifically sought from the Board of Health Sewer Connection Regulation, Article 2, to waive the requirement that the residential subdivision "Cobbler's Comer" be sewered. Present for discussion was Mr. Willis and Atty. Garen Bresnick (arrived at 8:55 PM). One hour of the hearing was tape recorded (on file in BOH Office). Copy of tape was offered to Mr. Willis. Chairman Sosman informed everyone of the purpose of the hearing and Mr. Willis corrected her by stating that the Request for the Variance is the Board's request —not his. The Board asked Mr. Willis to submit the Request for Variance form. Mr. Willis stated that his subdivision plan approval did not require sewer; in fact, there was no formal communication at the time of subdivision review from the Health Agent nor the Board of Health. Chair responded that the Agent's March 14, 1994 letter to Mr. Willis, was, in fact, his notification of the Board's Sewer Connection Regulation, specifically for new construction, and that the exploration of sewering must be done before permits are granted for septic systems. Nearly 35 minutes of discussion occurred between the Board and Mr. Willis, with dialogue as to who did or did not communicate with each other. It was finally concluded and agreed that there was a definite misunderstanding with communication, in writing or verbally, with both parties. With that resolved, discussion continued, with Atty. Bresnick present, re: various costs to construct a sewerline approx. 2270 ft., 6" forced main with grinder pumps vs. gravity line with lift station (to be eventually maintained by the town), the fact that no abutters along Willow Street can physically hook up due to the type of line, and the comparison of costs for septic systems. Question to be considered: Is sewering Cobbler's Corner Subdivision economically feasible as it relates to technical and access issues? The burden was on Mr. Willis to convince the Board that it is not feasible to sewer. PAGE 2, BOH MINUTES, SEPTEMBER 21,1995 Mr. Willis explained that the soil conditions are excellent to maintain an environmentally safe septic system, and that the distance of construction of the sewerline (along with other factors mentioned above) does not make it feasible. Public Hearing ended at 10:00 PM. MOTION: To grant a variance from the BOH Sewer Connection Regulation, Article 2, for the 19 lot Cobbler's Corner Subdivision. Martin/Forget. 2 -1 Sosman opposed. VOTED After the vote was taken. Atty. Bresnick commented that Mr. Willis would consider constructing the system under the new Title V, but that legally he is only required to meet the old Title 5. eels Mr. Willis responded that if the new Title V allows for a better system, then he will put in a better system. 4. Adjournment MOTION: To adjourn at 10:22 PM. Martin/Forget. All in favor. VOTED Respectfully submitted, Dianne Royle, Recording Secretary NEXT MEETING: OCTOBER 5, 1995 @ 7:30 PM.
