EPA took over the cleanup and now the second phase will be done by DEP. Agent spoke with Gerard Martin, DEP, and was told that he will be glad to attend a BOH meeting to bring Board up to date. b. 380 Mill St: Agent gave brief history of 380 Mill Street and its relationship to the Jameson Farm Subdivision, off Mill St. Agent will contact Attorney Sandra Vaughan for an update. Members discussed cost comparisons of sewer vs. septic, variance granted allowing septic if occupancy permit was issued before the sewerline installed. e. Workshop: Role of the Board of Health. Was particularly helpful to the new members. d. Household Hazardous Waste Collection: Agent reported that approximately $7,000 is leftover from last collection day and the $12,500 granted at 1995 Aimual Town Meeting has not been used as yet. Members discussed the possibility of having two collection days /year, expanding the range of materials to be disposed, full day collection vs. 1/2 day collection, collected certain materials on a regular basis, and finally, bow much to ask in the article for the 1996 collection. Agent will report back with options. e. Elms Subdivision. Agent gave history of Elms Subdivision and how the BOH denied the subdivision plan based on protection of public water supply due to its proximity to the proposed Ash Well in West Mansfield. Agent went to court with Special Counsel and other Dept. Heads, but trial was postponed. New date: February 20, 1996. f. Small Sewer Program: Policy adopted by Sewer Commissioners (Selectmen) must be revised. Assistant to Town Manager is compiling information for the Town Engineer. Agent reported that some of his comments were to develop a policy based on need, age of houses, soil conditions, groundwater levels. g. Tobacco Control Compliance Checks: NEMS Tobacco Control Coordinator asked Mansfield Public Schools permission to sent a letter and permission form to all parents PAGE 31 AGENDA, JAN. 4,1996 at QMS and MHS so that students can participate in compliance checks at various establishments to ensure that tobacco products are not being sold to minors. Both principals would not allow the letter to be sent home. Chair commented that the letter would explain the procedure and that a student would only participate with the approval of the parent. Board would like to see the letter and permission form before they comment. Agent feels that eventually smoking regulations will be Statewide to ensure uniformity. 6. Old Business a. Fluoridation: Chairman Martin gave a synopsis of the continuing saga of fluoridation, starting with the order from the BOH in June 1991 to fluoridate the public water supply. A Federal Block Grant may be available and if it comes to the State, Mansfield is at the top of the list for reimbursement of $73,500 which is the cost of installation of equipment for all nine wells. State Dept. Public Health engineer, Fred Barker, designed the system and gave the specifications to the Water Dept. for implementation. Agent will get a copy of them. About $5,000 /year will need to be budgeted, through the Water Dept. for the fluoride. Fluoride has been in the Capital Improvements budget for several years, and this year the Town Manager recommended that the BOH sponsor an article to fund fluoridation from the Stabilization Account. 1. It is not the legal responsibility of the BOH to fund fluoridation. 2. BOH order of fluoridation is a legal binding order. 3. If the funding is through the Stabilization Account and on a separate article at Town Meeting, it could be voted down. 4. Funding should be through Water Dept. budget. Chairman will meet with Town Manager on Wed. Jan. 10th to reiterate these facts to him. Board has been patient through the years, but now that funding is irmninent, the Town cannot take chances with losing it. 7. New Business a. Member for NE MS Tobacco Control Board: Since Carol Sosman is no longer on the Board and was the rep for NEMS TC, a replacement must be chosen. Agent will report back with how much time is required and meeting schedule. If a member cannot represent Board, Health Agent volunteered. b. Miscellaneous: Member Kowalczyk asked Agent to accompanying him on a tour of various places, i.e., sewer treatment plant, hazardous waste sites, well sites, etc. Any member is, of course, welcomed to tour. Chair commented that at times, members have accompanied Agent on restaurant inspections or percolation tests. PAGE 4, AGENDA, JAN. 4, 1996 8. Adjournment MOTION: To adjourn at 9:05 PM.
