4. Visitors - Public Hearing
At 8:OOPM a variance hearing was held for Mary Jameson, 380 Mill St., under the
Sewer Connection Reg. Present and representing Mrs. Jameson was Attorney Sandra Cordes
Vaughan, members of Mrs. Jameson's family, daughter Ellen Brown, son -in -law, David
Brown, 370 Mill St. Reason for variance is as follows: "Sewer inaccessible at the time of
construction. Approved sub - surface waste disposal system installed at substantial cost in
reliance upon February 16, 1995 Board of Health variance. This variance is requested
pursuant to Article III of said Regulation as connection to the sewer line would do "manifest
injustice" to owner /occupant. In addition, relief requested from provisions of original
variance requiring connection at time of conveyance so long as system continues to comply
with provisions of the State Environmental Code."
Atty. Vaughan said that the first variance granted was recinded due to Mrs. Jameson's
( occupancy coming after the sewerline at Jameson Court Subdivision was installed. House
was basically finished, but electrical problems delayed the occupancy permit, which was
issued August 1995. Sewerline installed July and completed in August. She continued to
say that the request for variance is for equity reasons, i.e., septic system is new and Board
allowed the construction of it. Plumbing is in back of house (would only perc in back of
house) -- costly to bring to front.
A package of info was submitted as requested, but the Means Catalog could not be found to
get dollar amount. Estimates from a contractor were submitted. Overall Construction:
$10,500 for sewerline construction and hookup. Member Forget asked why septic was
installed when it was. Attorney replied that Mrs. Jameson's house was a separate project
from the Jameson Farm Subdivision.
Agent questioned the distance for the sewer extension. Member Leonard asked w}ien the
septic system was installed. Response, June. Sewer, end of August.
Attorney asked that Mrs. Jameson remain on septic until the system fails. Member Forget
asked what else she would accept. Response, remain on septic until transfer of ownership.
Hearing closed at 8:20PM.

c. Variance Deliberation: Agent gave history of 380 Mill St and sewerline for the
Jameson Farm Subdivision. Board reviewed date of septic installation, sewer installation
and issuance of occupancy permit. Member Kowalcyzk said that the conditions of hardship
and circumstances will permit him to consider a variance until transfer of ownership.
Member Forget commented that Mrs. Jameson variance request is not within the spirit of the
Sewer Connection Regulation.
