Page 2, Minutes, February 15,1996 b. 171 Ware Street, Ed Troy: Agent informed Board of a pending lawsuit between Ed Troy, 171 Ware St., owner, and septic installers, Grant Brothers, Mansfield, and gave a brief history of 171 Ware St. Address is an apartment house with twelve units and 24 bedrooms. This system was repaired for the first time in Aug. 1989, after many years of coercing and many court dates. Mr. Troy charges that the Agent should have known that there were 24 bedrooms, because that's what zoning allows. No relevance, Agent warned. In 1989, an open hole inspection was asked for and made on a Friday, system installed over weekend and covered up. Agent never made a final inspection. The system is not overflowing on the ground; therefore, not considered a failure at this time. Since the system had not been working properly, it was determined by another engineer that the malfunctions were due to shoddy workmanship. Reason for lawsuit between Mr. Troy and Grant Bros., installers is to recover financial losses.. Member Leonard is concerned that the Board and Agent are aware that this system is underdesigned and that there has been no formal notification of that fact. Agent responded that the Board can do one of two things. Send a letter and order a repair of the system for 24 bedrooms or condemn 6 apartments to lower the number of bedrooms that are calculated in the flow. Board agreed a letter should be sent putting Mr. Troy "on notice" and that special attorney Joe Hannon review the letter. c. DDT Storage: Agent contacted Kirley's and was told by owner that there is no storage of DDT on site and hasn't been for 25 years. d. E 380 Mill Street: A new variance request dated February 15th and an attached letter was received by fax this afternoon. Agent summarized letter and disagreed with several items. Board asked that a specific variance sought be stated on variance form. Board will review the letter and discuss next meeting. 6. Old Business a.
