Agent reported that housing hearing for Carmine Lorusso, 46 Cottage St. has been postponed
to October 3rd. According to State law, all occupants in building must be notified of hearing
Page 2, BOH Minutes, September 5, 1996
and it must be done by the Health Dept. That did not occur; therefore, hearing must be
postponed.
5. Health Agent's Report
a. Health Agent's Vacation: September 19th week. Meeting will still be held.
b. Fall Household Hazardous Waste: Quotes have not yet come in. Will be one of
these Saturdays, Oct. 26th, Nov. 2 or 9th.
c. Schedule for Review of BOH Reg: Agent will develop schedule and make
recommended changes. Each member has a book of regs.
d. Oct. 3rd Workshop on Housing: Agent will begin BOH workshops. He will
also attend a seminar on Housing Enforcement on Oct. 2, 9 and 22.
e. Stump Dump at Plymouth St. Recreation Fields: Have had no correspondence
from DPW. Will send enforcement order to have one dump site removed this Fall, one next
Spring and one next Fall.
( f. Road Salt Study/Policy: Sodium levels in wells are slowly creeping up.
Selectmen want State to declare a "no salt area" on certain portions of Rt. 95. John Buckley
is developing a water conservation plan to be accepted as a policy by Water Commissioners.
6. Old Business
a. Compo, Branch St.: Member Kowalczyk contacted DEP, Bureau of Waste Site
Cleanup, Mr. Jablowski, to ask for an update of the Compo cleanup. As we know, the
blowers have been shut off. Since no notification was given, theoretically it puts this cleanup
in noncompliance. Phase II long -term plan must be approved. Member Kowalczyk would
like Health Agent to follow up. Mr. Jablowski, licenses site professional, said report is due,
but has not yet been received. Agent will make on -site visit.
b. NEMS Update: Chairman Martin reviewed the Tobacco Control Grant and came
to the conclusion that Mansfield, as the lead community, should be taking a more supervisory
lead over the TC staff and the day -to -day operation. NEMS board has no power whatsoever,
and the Mansfield BOH should be meeting with the program director monthly. A meeting
with the Mansfield Town Mgr., State tobacco person, Sarah Sabourin and Mansfield BOH
was to be held to determine the scope of the grant and Mansfield's role. However, through
discussion, Board members felt this meeting was not necessary and that the grant specifically
states Mansfield's role. A letter will be sent to Ms. Sabourin canceling the meeting.
Page 3, BOH Minutes, Sept. 5, 1996
Since Charlotte Scozzafava, Director TC, is a patient of Dr. Martin's, he will abstain
from all votes and decisions. Board expressed the following concerns: personnel issues,
compliance check procedures, budget justification, have goals and objectives of the grant been
met, transitional plan for when grant funding ends should be developed, program assessment
should occur, three other towns must be notified that Mansfield will now take a leadership
role as addressed in the grant.
MOTION: To direct Health Agent to oversee the day -to -day operation
and provide guidance and supervision to the HEMS Program
Director for the next 45 days, and to ask Program Director to
report to the BOH on the 45th day with a plan that this effective
to the BOH concerns.
Leonard/Forget. 3 -0 -1 Martin abstained. VOTED
c. Community Septic Management Program: Agent recommends responding to
this program and saying that Mansfield is interested. $20,000 could be awarded to the BOH
to develop a plan. Something creative should be looked at. For example, overlays and layers
of maps showing soil types and groundwater levels and Zone II's. A salt and road study
could be considered.
d. TAG Grant: We should be notified sometime in the Fall.
e. Water Issues: Member Kowalczyk referred to the discussion with John Buckley,
Ass't DPW Director and his report on water management for the town. The board should
maintain a proactive approach to water quality as it pertains to public health. As Water
Commissions, Selectmen are focusing on all water issues.
f. Goals: Chair suggested Board measure BOH goals and evaluate their status.
7. New Business
a. Kennel Barking: Member Leonard received a call from a neighbor of Alladin
Kennels, West St. with continued concern over barking dogs. Residents in this area will
attempt to deal with the nuisance of barking through the Kennel's permitting process with the
Board of Selectmen. Agent feels that this a civil suit between residents and kennel.
