He suggested continuing to do minimal plowing until a road comes into full compliance. Eleven roads are not even close to meeting the criteria and eight roads have no occupants in the homes yet; nine are only lacking proper staking. He asked for flex- ibility in regulations. * MOTION: To make discretionary passes in Eastleigh Estates and Jacob Drive, but if Massapoag is in litigation don't plow it. Sarro /Harrington VOTED: 3 -1 Markt opposed The Town Manager advised that the other seven roads do not have a hold harmless clause and some fail to comply with technical requirements of staking, some have curbing. In two cases there is no one responsible to sign a hold harmless as the developer is bankrupt. * MOTION: That the five roads whose developer has not signed the waiver not be plowed. Harrington /Sarro VOTED: 4 -0 The Town Manager said there are two roads for which banks have assumed the responsibility for the development. * MOTION: Until whoever is responsible for those developments sign the hold harmless clause, they are not to be plowed and the resi- dents are to be notified of this. Sarro / Markt VOTED: 4 -0 The Town Manager asked the Board if the DPW may use its discretion for further roads to eventually be included? The Board responded it meets weekly. The Chairman stated the most important issue is the hold harmless agreement. b) Selectman Sarro asked if anything has been done about the nasty West Street curve. He said that Town Counsel was asked to look into it since there is possible litigation which may be resolved. The Town Manager is to look into it. 7. Chairman Tartufo reviewed why a full -time subdivision inspector has become needed and is, therefore, up for discussion. Selectman Harring- ton said he would rather have a full -time enployee in that position feeling it would provide alot more time and work for the Town dollar. The Town Manager reviewed the Town's financial situation at this time and said he supports the proposal of a full -time inspector, but he BOARD OF SELECTMEN MINUTES OF MEETING DECEMBER 27, 1989 << PAGE 4 would like the position placed in the Engineering office. Chairman Madan said placing the position in the Engineering Department willpresent a problem; the Planning Board is responsible for roadways and inspections. * MOTION: That the Board seek approval of the Finance Committee to go ahead and hire a Subdivision Inspector. Harrington /Sarro VOTED: 4 -0 Harrington Selectman /then suggested looking at a job description for the position, then decide on the department location.
