HomeMy WebLinkAboutBOS MINUTES 6-14-1989BOARD OF SELECTMEN MINUTES OF MEETING `, Jul 13i.,,5 JUNE 14, 1989( P. s-._'. PRESENT: Chairman Tartufo; Selectmen Dunn, Markt, Sarro; Town Manager; Selectman Harrington arrived at 6:50 P.M. The meeting was called to order at 6:40 P.M.in the new Library /COA facility. The Town Manager introduced Bill Mackey and Steve Rafferty, of Camp Dresser & McKee who were present to discuss their findings on the Life Care facility sewer extension proposal. Town Engineer, Bob Swanson was also present. Bill Mackey advised that most of their work on the Sewer Master Plan was done in 1970 and only updated in 1976. Flows used in their report are pretty much the same. The Spring Street interceptor capacity is adequate, and the South Main Street pipe line has not surcharged since construction of the intercep- tor. Based on this information, there is capacity for additional flow, but because it is an old line it is in unknown condition. Life Care's proposal for a pump station could handle their facility plus 8 -10 additional homes. CDM proposes that a pump station in the area of Judy's Lane would be easier to bring gravity lines down to that point and then pump it to Spring Street or South Main. Bill advised that a pump station should not be designed just for what exists or is proposed today. He said this briefly covers the writ- ten report the Selectmen had received earlier. Ted Kelley, of Life Care Associates, and Bill Carroll of Faye Spofford & Thorndike Engineers were also present. Ted Kelley said Life Care concurs with CDM's report, and they would like to stick with their design as proposed. He then read Life Care's letter addressed to Chairman of the Planning Board answering points as specified. Bob Swanson questioned Item #6, length of the contract - 5 years, saying CDM had mentioned 20 years. The Town Manager pointed out that staff wants the pump station structured so that it will be able to pick up any reasonable development. Selectman Dunn asked what elevation for the pump station at Judy's Lane; he was told essentially the same as that at the Life Care facility. Bill Mackey stated that if they were to make a study of the entire area for sewer service today, it would indicate a pump station at Judy's Lane at 15 -20 feet depth. Select- man Sarro asked Bill if it is physically impossible for Life Care to follow the Master Plan; Bill said it is possible. Bill said they looked at two ex- tremes - just Life Care and a few surrounding homes, or the entire area; there are several options possible. Bill said if this were a Town of Mans- field project, he would recommend a pump station at Judy's Lane. Selectman Sarro then asked Steve Mastrovich, Life Care's attorney, if he understands that if the permit is granted they still have to come before the Road Commissioners; he said they did. Al Willis asked where would the flow be pumped from Judy's Lane; it would require a study and be dependent on the condition of the South Main Street line. Chairman Tartufo pointed out that Life Care has stipulated that residents must decide to tie in within one year. Steve Mastrovich said if the laterals are put in, then it is not nec- essary. He feels they can be flexible on that. BOARD OF SELECTMEN MINUTES OF MEETING JUNE 14, 1989 PAGE 2 Bob Swanson said he feels it would be nice if the wet well is made deep enough for the golf course if it is ever developed. Selectman Dunn returned to his desire to adhere to the Town's Master Plan instead of what they "offer" vs. what is good for the needs of the Town of Mansfield. In answer to a ques- tion by Selectman Harrington, Bill Mackey said technically their proposal does work, but asking the developer to change to the Judy's Lane plan would be a significant cost increase. Chairman Tartufo reviewed the two or three choices discussed. * MOTION: To certify to the Planning Board that the Town has capacity for the Life Care facility. Harrington /no 2nd Selectman Dunn said he does not want to let the horse out of the barn. The Town Manager suggested certification with conditions: - Life Care has proposed a system to meet their needs only - The Board has proposed modifications in keeping with its Master Plan - CDM says a Town designed one should be put at Judy's or Fisher Lane, the Town should insist that if a gravity system is to be installed, make sure that residents can tie in, because that is what the Town wants, and the Town should insist that Life Care maintain the pump station for a set length of time for $1 /year. With these modifications, the Board has a proposal it can support for certi- fication. The Board must decide if these are reasonable conditions, then go forward with conditions. * MOTION: To take a look at the lift station and force main designed and recommended by Camp Dresser & McKee. Dunn /no 2nd Selectman Dunn said he would like to see the engineering work approved by Camp Dresser & McKee. Selectman Markt suggested giving certification with the eight points made previously, with one exception; i.e., the time of main- tenance specified as "in perpetuity ". The Town Manager advised the Board that Town Counsel stated the Board can approve certification with conditions. Selectman Dunn wanted conditions to meet intent regarding a design which would incorporate a lift station in the vicinity of Judy's Lane. Selectman Harrington said he felt it is not fair to say the developer is the only one who will benefit, nor is it fair to make the developer pay for the entire cost. A five minute break was taken here - * MOTION: Certification for capacity only with the draft conditions that the Board of Selectmen approved two weeks ago (except for certain changes which were mentioned - See revised copy attached). Sarro /Harrington VOTED: 5 -0 ft ! j NAN 1. -c y rt CONDITIONS FOR SEWER CERTIFICATION I . Lifecare should install a gravity sewer with lateral ties to the property lines up to the golf course north of the Lifecare Site. The gravity sewer would discharge to the Lifecare pump station. 2. The pump station would be connected to the Lifecare's emer- gency power source. 3. The Town should not take ownership of the pump station until a resident ties into the gravity sewer discussed in item # 1. When the Town does take ownership of the pump station the Lifecare facility would give the Town an easement which would only be for the property in the immediate area of the pump station and the force main on the Lifecare Site. This easement would not include the area where the emergency power line is installed. The pump station would be con- nected to the Lifecare's emergency power source. Lifecare would retain ownership of the emergency power line up to a junction box located at the pump station. There would be no charge to the Town for emergency power under any cir- cumstances. Because Lifecare would be the prime user of the pump station, Lifecare should contract with the Town for 25 years for complete operation and maintenance of the pump station. The contract should be for the minimum amount required by law 01.) 4. When the Town takes over ownership of the pump station it must be in good operating condition. Lifecare will also provide a set of recommended spare parts (as recommended by the pump manufacturer). Lifecare will also provide to the Town any special tools which are required to gain access to the pump station. 5. The pump "station shall be designed or be of sufficient depth to accommodate connection of a gravity sewer from the southerly portion of Willow Street. 6. The pumps should be constructed so that they could be easily modified in the future to accommodate the sewerage flow. The wet well in the pump station should initially be sized for this additional sewerage. The force main size should also be evaluated for this larger flow. 7. The proposed force main would be installed from the Lifecare site up to the sewer manhole on Spring Street. The topog- raphy of Willow Street near the intersection of Spring Street would allow gravity sewer to be installed in this section. The applicant should change from force main to gravity sewer wherever possible in Willow Street, prior to the Spring Street intersection. 8. The applicant should construct the existing road from the site to Spring Street with reasonably accepted construction acceptable to the Board of Selectmen. According to the applicant's traffic report, the existing traffic flow on Willow Street is 420 vehicles. This will escalate up to 1580 after construction, which is an increase by a factor of almost 4. The existing pavement structure is badly deteriorated and in need of repair. RS/pl. BOARD OF SELECTMEN MINUTES OF MEETING ( JUNE 14, 1989 PAGE 3 2. ISPO Sewer Extension Camp Dresser & McKee stayed for review of this request, which they had also been asked to review. ISPO representatives were present. Steve Rafferty, of CDM, reviewed the ISPO proposal, which the Board had previously turned down. * MOTION: To accept the Camp Dresser & McKee recommendtion for the ISPO pro- ject and accept under those terms. Markt /Harrington VOTED: 4 -0 (Selectman Dunn was out of room for this discussion) 3. Main Street Reconstruction /Downtown Merchants Bob Clinton and Hugh Neenan from the consultant firm, R.A. Cataldo, were pre- sent, along with Town Engineer, Bob Swanson and many of the downtown mer- chants. Cataldo's representative had a chart of the downtown area illustrat- ing their proposed changes in parking primarily. The Town Manager opened by reviewing the parking problems existing downtown and their effect on the mer- chants, as well as safety issues. The original plan suggested would have eliminated 22 parking spaces; the Town asked Cataldo to evaluate parking "zones ". The Town Manager had "Strategies To Increase Parking Availability North Main Street Reconstruction ", which listed 9 "mitigating measures" which he passed out; all these were discussed. The Town Manager advised that funding will come from Chapter 90 funds; these require the Town to meet State standards and meet State Department of Public Works requirements (these require 3 reviews at various stages of construction). * MOTION: To start process to have telephone lines put underground. Dunn /Sarro VOTED: 5 -0 * MOTION: Continue on with reconstruction of South Main Street, incorporate the revisions and move forward. Sarro /Dunn VOTED: 5 -0 The Town Manager mentioned the need for a thin overlay at least in the trench areas since reconstruction will not be started until the next construction season (1990). * MOTION: To approve. Sarro /Harrington VOTED: 5 -0 The Town Manager was asked to obtain a time table for putting the telephone lines underground. 4. Memorial Park Selectman Sarro mentioned a seeming problem at Memorial Park and read a peti- tion he had received with 241 signatures. The petition expressed particular concern for the "deplorable condition of the children's play yard ". Select- man Sarro reported he had visited the park and felt it was in poor shape; he said the King memorial is also in poor shape. He then read a letter signed by Linda Anteski and Maureen Dougherty enumerating broken equipment and other con- cerns, as well as steps they have taken to try to get some action. They said the Jaycees are willing to repair the equipment, but they have no connection with the petition. Maureen Dougherty advised that she had spoken to the Town Manager and one Selectman. The Town Manager said he feels the park is in good shape; there were two areas which needed attention when he had visited it and the Parks Director had had them taken care of. Selectman Sarro said he and another Selectman had visited the park about four weeks ago and both felt it was a disgrace, and he had re- ported this to the Parks Director. Selectman Sarro advised that he had attended the Recreation Commission meeting earlier this week. He went on to say he had two books of regulations (Federal) for parks, and he feels the job of Recrea- tion and Parks is too much for one person. As Recreation Director Ms. Fish is good, but he feels the Town needs a Park Manager or Supervisor. Selectman Harrington pointed out that the Parks & Recreation had been divided a few BOARD OF SELECTMEN MINUTES OF MEETING JUNE 14, 1989 PAGE 8 years back, but that was in violation of the Town Charter, so the Board had combined the two positions again. The decision was made for the Town Manager, Selectman Sarro and Chairman of the Recreation Commission to sit down and dis- cuss the problem. Don Daniels, 155 Church Street, was in the audience and said he lives close to the park. He said he has small children and likes to send them to the park; he has seen it in good and bad shape. He said he feels it should, and could, be a beautiful place for children, but lately the park presents a picture of total mismanagement. He went on to relate how "punks" with their vehicles, mis- use the parking areas, litter, etc. Selectman Markt commented that the park has too many entrances which makes it difficult to control; he sees drinking, cars racing, etc. any night he is there. 9. Old Business - Town Manager a) The Selectmen had been given information earlier concerning certification of the proper width for Paine Road between Central Street and Copeland Drive. An engineered plan was included along with a Memorandum to the Town Clerk requesting revision of the Town records to show this information. * MOTION: To approve the revision and have the Chairman sign the Memoran- dum. Sarro / Markt VOTED: 5 -0 Selectman Harrington said he will not vote for another extension. c) The Town Manager had a copy of the proposed design for the Jaycees' WELCOME TO MANSFIELD signs for the Selectmen to approve. The design designated population and the Board felt that should be omitted since it is constantly changing. Selectman Sarro said he thought the Rotary Club had ordered signs at one time for this purpose; he will check into it and report back to the Town Manager. 10. Old Business - Selectmen a) Selectman Markt inquired about the trench work on Rt. 106 and downtown. He was told the work will commence in the middle of July. The Town Manager was asked to write a Press Release on this. b) Selectman Dunn said he does not want to see Paul Folkman's recent extension request for Maple Street addressed until Jackson Court is completed to the Board's satisfaction. BOARD OF SELECTMEN MINUTES OF MEETING JUNE 14, 1989 PAGE 9 c) Selectman Harrington reported he had read an article in one of the papers in which the Police Chief stated he does not feel Mansfield has a drug and alcohol problem. He asked the Town Manager to ascertain whether or not this was a misquote. d) Chairman Tartufo reminded the Town Manager he had asked for a 'project list' some time ago. e) Chairman Tartufo asked about salaries and evaluations. The Town Manager ad- vised he is doing department head evaluations now. Discussion followed as to whether the Board can, or should, see the individual evaluations; consen- sus was it was not appropriate or necessary. The Chairman also suggested that the Board should start to think about the Town Manager's evaluation. Decision was his is due January 1, 1990. 11. New Business - Town Manager a) The Town Manager briefly outlined the Joint Purchase Agreement for health insurance. He has been meeting with a group from several towns, assisted by Insurance Cost Control, Inc. He asked the Board what degree it wanted to exercise in making a decision; did it want Insurance Cost Control to meet with them and review it. Decision was to refer any decision until the next Board meeting; it did not feel it was necessary to have the consultant come to a meeting. b) The Board was advised that Camp Dresser & McKee will meet with the Board at the July 12th meeting to discuss the sewer reports, cost alternatives, etc., they had been given copies of. c) The Town Manager reported the water meter grant, which Jerry St. Hilaire had done an excellent job of putting together in a hurry, was for naught; the authority for the grant has been revoked. 12.
