MINUTES OF EXECUTIVE SESSION
JANUARY 4, 1989
PRESENT: Charman Harrington; Selectmen Dunn, Markt, Levine; Town Manager
The Town Manager said he wanted to give Board members an update on the Nicholas
Harris land swap, adding that Selectman Dunn did a fine job on this. Nick Harris
advised Tom that the Board's proposal of a few weeks ago was acceptable.
Selectman Dunn then reviewed what he had discussed with Nick Harris. The Board
would like to have the lots that abut the road. If Nick Harris receives the
right to go through Town -owned land, he will get six (6) buildable lots. The
Town will not get, and does not want, the other land offered. If the Town wants
to sell the six lots, they will conform with certain covenants and Nick Harris
will be given right of first refusal at market price. Selectman Harrington
wanted to learn if they are percable lots. The Planning Board wants a letter of
understanding from the Selectmen to Nick Harris.
Selectman Dunn commented that he put this through by pointing out economical
benefits.

Guerrini Case - The Town Manager advised Board members that the attorney rep-
resenting the Town in this case feels Guerrini may not be particularly helpful
in representing the case. Tom said the attorney could make Guerrini look bad
because of prior knowledge from a former case (1984). There is to be a hearing
next Wednesday to determine whether there is any problem in the representation
and if the law firm should withdraw. If it does, it is to the Town's detriment.
The insurance company does not want the attorney to withdraw, but without the
hearing the judge could end it. Vincent Guerrini needs counsel; he wants to
know who will pay for his counsel; the insurance company is willing to split
Guerrini's counsel feel with the Town. All parties would be represented inde-
pendently at the hearing. The Town Manager said he told Buerrini to find an
attorney and have him contact the insurance attorney. Consensus of the Board
was "no problem ".
ASH Property - Attorney Gelerman has had contact with Attorney Tweedy and the
Hovnanian Company. The water is being tested and property being surveyed, and
there is an article on the Town Meeting Warrant for Eminent Domain approval.

FEBRUARY 8, 1989
PRESENT: Chairman Harrington; Selectman Dunn, Tartufo, Markt, Levine; Town
Manager
Clerks' Contract - The Town Manager said he had concerns with the step scale;
the increase is pretty high; he would like to reduce the size of the incre-
ment. If there is a merit arrangement, then the Board must be prepared to go
above the regular 6 %.
Chairman Harrington said he would like to keep the present steps plus 4% cost -
of- living. Consensus of the Board was to leave steps as they are with a 4?%
cost -of- living.
The Town Manager said he wants something concerning probationary employees and
sick leave accumulation and sick leave "banking "; he wants "banking" to be de-
fined. The Board told him to go forward and research.
The Clerks want tuition reimbursement and the Town Manager said he approves
as long as marks are acceptable, with an employee controbution. The Board sup-
ported this. The Clerks requested overtime.
ASH Property - The Town Manager explained there will be a special article on
( the Town Meeting Warrant for "taking" of property by eminent domain. He had
a map showing the portion of the property cut out for the Ash home; the Board
supported this. He reported the consultants recommend additional water quality
testing; surveying is being done and flagging the wetlands.
Reporting on a meeting with the Hovnanian Companies of Massachusetts, Inc.,
the Town Manager said what they want to do will have an impact on schools,
water, sewer, etc.. They want the Town to extend the sewer line and they will
pay the cost. They want to charge a fee to other developers to hook up. They
are saying the Selectmen support them to have the area zoned for 260 homes on
10,000 sq. ft. lots (178 acres, a percentage of which is wetlands). They are
looking at access on Elm Street, with the Town allowing them an easement across
some Town -owned land (dry land), a wedge behind Benoit's property.
Attorney Dalton advises the Board to not be against it, let the people shut it
down at Town Meeting. Advise Hovnanian to go forward to Planning Board and
ask them to please not present the Selectmen as being anything but neutral.
Attorney Dalton feels it will have to be eminent domain.

PRESENT: Chairman Dunn; Selectmen Markt, Tartufo, Harrington, Levine;
Town Manager
The Town Manager had sent a Memorandum to Board members sometime ago regard-
ing Non -Union Salaries and Positions. He asked tonight if the Board was ready
to endorse these positions or is it willing to look at the bottom line of the
increases (a certain percent). The Town Manager said the bottom line increase
is only 5$ %; most department heads 7 % -712%. He said he believes the Town should
treat non -union personnel as well as, or better, than union people. He pointed
out he has reclassified two positions; i.e. the Council On Aging Director and
the Assessors Office Supervisor.
MOTION: To approve the salaries as proposed in the Town Manager Memorandum
dated January 24, 1989, each subject to performance evaluation.
Tartufo / Markt
Selectman Harrington said he had reservations on the Community Development
Director and Environmental Planner; he also commented on the Fire Department
secretary receiving a higher percent level increase than the Board of Select-
men secretary.
The Motion was withdrawn and due to the hour, it was decided to continue dis-
cussion to another night.

ASH Property - The Town Manager reported that Anderson & Nichols is proposing
a series of computer wells. They recommend obtaining a 4 -acre parcel from
Richard Morse; it is wetlands. Selectman Tartufo suggested it may be obtainable
through a restrictive easement. The Town Manager suggested acquiring it by
eminent domain, which must be done by Town Meeting. A 400 foot radius is
needed for a well; Selectman Tartufo reminded members Richard Morse's parcel is
a stump dump. It was noted that tubular wells will yield better draw.

CALL FIREFIGHTERS - The Town Manager reported that he and the Fire Chief had
met with the Call Firefighters last night for consideration of the proposal for
them; they did not endorse it. They want health insurance, retroactive pay and
several other points. Now they will try to get what they want from the Board of
Selectmen. The question is whether the Board wants to stick by policy pre-
sented or have the Town Manager go back to negotiate with them.
Selectman Harrington said he supports salary increase restroactive to July 1,
1988; health and disability are the big problem. They are asking for protection
equal to the permanent firefighters, arguing they are risking their life the
same as the permanent firefighters. Selectman Harrington suggested having a
Selectman sit in for the next negotiating session. The Town Manager advised retro-
active pay would equal approximately $16,000.
The two year schedule was agreed to, which they wanted, phased in over two
years. Health insurance would require a Town Meeting vote and opens it up to
all. $4,000 per firefighter is the cost for health insurance; disability is
given, permanent disability is not required. The Call Firefighters want the
same coverage as the permanent firefighter if they are hurt on the job because
they are doing the same thing as a permanent firefighter.
The Town Manager said this is not "collective bargaining" and the Board does not
have to agree with their demands. There is temporary and permanent disability;
the wages, but not retroactive, show a 33% increase.
Selectman Levine referred to #1 and #2 in the Town Manager's Memorandum, saying
paying them more than they make is ludricous, but she agrees with retroactive
pay. They are not regular firefighters; pay at the lowest level (step 1) if tey
are injured and they have to be paid disability; permanent disability if they
are injured on the job.
MOTION: To accept their request for retroactive pay and to establish the rate
of pay if disabled at Step 2 of first year permanent firefighter's
contract.
AMENDED MOTION: To endorse the policy as put forth by the Fire Chief with the
exception of setting the rate of pay at the firefighter's first
year Step 2, adopting retroactive pay subject to funding from
Town Meeting or transfer.
Levine /Harrington
Selectman Markt did not agree with retroactive pay.
The decision was then to make the motion on the policy in open meeting.

Chairman Tartufo said the Board wishes to review their secretary's job descrip-
tion to make sure it will incorporate "Executive Secretary" title. The Town
Manager passed around the changed description, advising there were two places
within the context requiring the change.
Other than that change, the Town Manager said he had made only two changes in

MINUTES OF EXECUTIVE SESSION
JULY 5, 1989
PRESENT: Selectmen Harrington, Sarro, Markt; Town Manager
The Town Manager explained that a problem had arisen with the sale of the Spauld-
ing School; it concerned the underground heating oil storage tank buried on the
site. He said he had met with the prospective purchasers of the property, Donald
and Mary Steele, their attorney, Joseph Hannon, and their builder, Peter Fontan-
ini, as well as Town Counsel, Max Volterra. The Steeles had raised four issues:
1) The underground storage tank
2) Need for "21E" environmental review pursuant to State law
3) New requirement authorized by the 1989 Annual Town Meeting for a
sprinkler system
4) 1989 zoning by -law requiring buffering of the Spaulding School lot if
on -site parking were to be provided..
The Town Manager said that he had reached a conceptual agreement with the Steeles
on a resolution of these matters. Selectman Harrington;,ddViised, however,, that the
Steeles had apparently reconsidered their position over the weekend and were no
longer in agreement with the proposed resolution. Board members discussed vari-
ous ways to resolve the matter, ultimately indicating it would be prepared to
do the following:
1) Authorize the Steeles to remove the underground storage tank at their
initial expense; however, should it be determined that the Town failed
to properly abandon the tank, pursuant to the requirement in effect at
the time of abandonment (late 1:9706 early 1980s), then the Town would try
to reimburse the Steeles for the expense of that removal. The Board
recognized that funds are not immediately available for reimbursement
and could not be pledged to the Steeles in other than a good faith ef-
fort to reimburse their expense. If the tank was properly handled at
the time of abandonment, the Steeles would not be reimbursed for any
cost associated with the removal.
Furthermore, the Steeles would be given the right to terminate the pur-
chase agreement for the property if it was determined that any environ-
mental damage had resulted from the Town's failure to abandon its tank
appropriately. Under any other conditions the Steeles would forfeit
their deposit towards the purchase of the property.
2) The Steeles would perform the "21E" study at their own expense.
3) The Steeles would determine on their own their liability for the sprink-
ler system after further meetings with the Town's Fire Department offi-
cials and the State fire officials, as appropriate.
Selectman Sarro asked the Town Manager to convey to the Steeles his be-
lief that the building should be sprinklered in any event.
4) The Steeles will pursue on their own initiative a- wajiver- request -to the
Zoning Board of Appeals'of: the new by =law dealing ii.itii'bufforing- require-
ments for on- site - parking: TheiToWn'nwillisupport that effort through the
Board and Town Manager.

PRESENT: Chairman Tartufo; Selectmen Dunn, Harrington, Sarro, Markt; Town
Manager
The Board was polled to go into Executive Session for the purpose of discussing
strategy and possible litigation.
Selectman Sarro left for this discussion; Town Counsel, Max Volterra was pres-
ent.
Town Counsel explained that Daniel Bortolussi of Great Woods Chrysler - Plomouth,
Inc. at 515 South Main Street, still owns the property. He said the deal for
transfer of ownership did not go through. Mansfield Chrysler - Plymouth, Inc. re-
ceived licenses but did not receive ownership (Mr. DeBaise) and the two parties
are fighting over a $25,000 deposit.
Selectman Harrington asked if the Board could vote to revoke the Mansfield
Chrysler - Plymouth, Inc. licenses. Max recommended revoking them for the reason
that they have no place to operate their licenses and /or they have no franchise
to operate; also to advise Mr. Bortolussi to pick up his licenses immediately.

The Town Manager called the session to update the Selectmen on the Clerks' Asso-
ciation status. He advised them mediation is coming up next week; everything
seems to be acceptable/ in agreement except wages. The cost to the Torun would
have been over 8% to give them what they are asking or. He said the percentage
increments are approximately 5 %; the union figuresXhe other contracts are 6 % /612%
(with steps). With what the Clerks are asking for, it puts theirs up to 11 %.
The Town Manager said his concern is if the Clerks goes up to 11 %, what will this
do to the Police, Fire and DPW? He would like to keep the Clerks to 9 %.
Discussion follwed concerning step increments; steps are 5% which the Town
Manager feels is too much.

Vacant building next to Fire Station - The Town Manager said not much can be
done until closing of the Spaulding School sale for funding of this property.
Mr. Giordani, contacted Tom; he feels the property is worth half a million.
Tom said the Town has $225,000 authorized by Town Meeting, this with the build-
ing demolished. Tom said he will try to negotiate, rather than use the adver-
sarial eminent domain. There was then discussion regarding having an appraisal
done. Tom feels it is a touchy matter because of the Building Inspector and
Fire Chief warnings about condition of the building, etc. The Town Manager was
directed to continue with his approach and to have an appraisal done.
Bird Road - The Board questioned Attorney Gellerman's letter indicating disposal
of the pending litigation by reporting the case settled by agreement, then work
with the abutters who intend to sue Bertarelli for breach of agreement. By the
time the suit is settled the road will be completed. The only alternative is to
go back and sue for breach of agreement.
Selectman Sarro brought up drainage tie -in for some of the proposed subdivi-
sions off Bird Road; that is a separate issue.
The Town Manager was directed to have Attorney Gellerman negotiate by holding
to the original agreement which includes paving the road.
Selectman Dunn suggested reviewing the real estate value after a year's time
and thereby taking further lots as the bond and give them a year's extension.
Ladonna Restaurant Parking K §I; - The Town Manager had a suggested layout for
the Paine School parking lot which indicated 27 lots. The Board felt it appro-
priate for the Chairman and Town Manager to negotiate the parking spots. The
Board indicated it does not care about having the lot black- topped or the paint-
ing of windows, etc. of the school; it would rather have cash payments. The
Chairman suggested using the restaurant dumpster, removing the Paine School one,
which would make one or two more parking spaces.
Discussion of the charge for parking led to decision to investigate what is a
normal rate, possibly $5.00 per space.
The Chairman advised that the contractor on the job has some granite which he is
willing to donate to block off Paine Road. The Board did not decide to accept
this at present. (Selectman Dunn left room for this discussion).

Property Next to Fire Station - The Town Manager advised that the appraisal on
this property is 196,000; with the building still on the property $182,600.
The $225,000 Town Meeting authorization gives flexibility so that there may be
money to improve the lot. Discussion indicated the Board would like to see the
present owner take the building down. Also discussed was the possibility of an
environmental site assessment (so called '21E') in light of the removal of the
fuel storage tanks several years ago; this would protect the Town and present
owner. Chairman Tartufo suggested discussing this with Town Counsel.
Carla Foley Restaurant - (Selectman Dunn left for this discussion)
Chairman Tartufo reported that he and the Town Manager had met with Carla Foley
concerning a lease for her use of the Paine School parking lot last Friday. He
gave each Selectman a copy of proposed terms for such a lease. One point which
was not included was snow removal; the Town Manager said the Town would take care
of it during regular working hours, but not weekends. Chairman Tartufo said he
figured $15 /sq.ft, everyone agreed. Painting of the Paine School trim should

The Town Manager reported that he has a tentative settlement of the Clerks
Union contract, contingent upon support of the Board and Clerks Association
and Town Meeting for funding. He distributed a copy of the pertinent facts
in a Memorandum of Understanding for each Selectman. He explained that the need
for funding by Town Meeting may not be necessary and, if so, it won't be a very
large amount. The Town Manager said he doesn't recommend the Board's ratifica-
tion until after the Clerks meeting. He outlined the most important factors
included.
9.1% first year, 9.4% second year. They would not go for a three -year contract.
He tried to reduce the step increments, but that was not acceptable. There is
not a uniform percentage increase in the steps. The provision prohibiting the
Town from sub - contracting work was deleted. Movement to the top step would be
aggrievable. There is a tuition program with the Town paying up to $900.00;
job descriptions must be updated and the clerks may make comments on them.
Clerks presently have a 15 minute morning break and 15 minute afternoon break
with a 30 minute lunch. That has been changed to a 15 minutes morning break and

Johnna Gill /Williams Street Property -
Bob Mangiaratti, of Town Counsel's office, was present and advised that the
Johnna Gill Williams Street property received final judgment May 23, 1989, and
the Town now owns the land. Mrs. Gill, however, is still on the property and
owes approximately $$30,000 in back taxes; there is no mortgage on the property.
Her son has stepped into the picture, and he was advised that if he could come
up with the money, then he would ask the court to vacate the judgment. The son's
attorney was going to loan Mrs. Gill the money and then take title to the prop-
erty.
The Town Manager reported that Mrs. Gill is moving her stuff out to a mobile
home behind the house. Bob Mangiaratti said he has an execution from the court
that says she has to get out; Chairman Tartufo said he does not want to do that.
The Town Manager advised that the Town has insured the property. Selectman
Harrington said he would like the Town Manager to go talk to Mrs. Gill to be sure
she understands what is happening. Selectman Sarro felt it is Town property and
the Town obligation is to the townspeople now. Bob Mangiaratti said Mrs. Gill
has one year to petition the court to vacate the decree, after that it is up to

reasonable efforts will be made to try to establish it earlier ". It is for
their 20% of the health benefits so it comes out before taxes instead of after,
which reduces payroll deductions. The Town Manager said he is working with the
Superintendent on premium conversion. The Town Manager would like to extend
this plan to all non -union employees in Town Hall and schools. It would be a
bargaining chip for union contracts. It would be a third party administration
which would cost the employee approximately 75 per month.

The Town Manager reported that he had met with Johnna Gill this morning; she
preferred to meet him in Town Hall. Treasurer, Joan Cutillo, was present for
the meeting. Mrs. Gill is 48; she seemed very rational and reasonable, and
seemed to understand what is going on. She was distressed about the eviction
but thought Eric Wood (her son's roommate) was working it out; Eric is 28 years
old. Her son is Francis and works for Eric Wood in tree removal. $30,000 is
coming from Eric's father. Mrs. Gill also has a 19 year old daughter, Stephanie,
who manages at Lane Bryants. Francis talked with the Town Manager and was upset
that he had to go to an attorney which costs him money. Mrs. Gill works at
Hyde Park Academy, just recently as a "procurer" for $500 a week (the Treasurer
had this confirmed). The motor home on Mrs. Gill's property belongs to her
daughter's girl friend. The Town Manager said he felt Mrs. Gill is enamored with
her children.
Selectman Harrington suggested sending her a letter stating suggestions he and
Joan Cutillo made to her today - option of acquiring a lot or selling her prop-

Raymond Hayes at Mansfield Cooperative Bank to see if there is anything a bank

Manager
Police Chief, Jesse Earls, was present; the Town Manager reviewed the police
work with the County task force, seizing property, etc.
Selectman Harrington said he had a concern with a statement in one of the
papers, "Mansfield does not have a serious drug problem ", and mentioned the
house across from the main fire station, a house on Fulton Pond; then said if
that is not true, do we have enough manpower and budget money to address the
problem seriously? He asked Jesse for his opinion and for budgeting, etc.
Jesse said "Yes, we do have a very serious problem, so do other towns. No, he
does not have enough money; drugs are an expensive operation. Cocaine is the
drug of choice right now, and he needs at least $5,000." He said the District
Attorney reviews all expenses in connection with drug enforcement; undercover
people come from the task force.
Selectman Harrington said, personally he would like to see the Town Manager
give high priority for drug enforcement ($4,000 - $5,000). The Town Manager said
the Town needs a very good civil liability policy, which Mansfield does have.
He advised that Jesse has a program which will be in this year's budget for a
DARE program which will place a police officer in the schools. Selectman Har-
rington said he would like to see the most active program possible placed in town
(funds and ability). Jesse said he needs approval to accept some "gifts"
