The Town Manager said he has no further information other than it has priority listing with the State; he will follow up on it. b) Selectman Levine reported that the corner of Ware and Short Streets is no longer a puddle, it is a swimming hole! The Town Manager advised that there is a need to obtain an easement from property owners to handle the drainage, and the developer has been most cooperative in trying to obtain the easement, but the property owners are not responding. Tom Dwyer said he expects to have the new Town Engineer look at the situation for a pos- sible different solution. 10. He said he is happy to recommend Board approval. He went on to say funding is available from Free Cash Reserve balance, but it will need to be appro- priated at the next Town Meeting. MOTION: To approve the Police Contract. Tartufo /Levine VOTED: 4 -0 Markt abstained BOARD OF SELECTMEN MINUTES OF MEETING NOVEMBER 2, 1988 PAGE 4 Chairman Harrington again thanked the Town Manager, saying it is the third contract the new Town Manager has put through. 12. Camp Dresser & McKee /Sewer Extensions Bill Mackey was present for discussion of CDM's recommendations concerning sewer extensions in both West and East Mansfield. The Town Manager reviewed financing; $400,000 is available now, the other $600,000 is contingent upon approval of a 221 Override for the School Street extension. Bill Mackey reviewed the CDM first proposal - School Street Interceptor. Phase I would be to prepare plans and specifications to extend the Spring Street - School Street sewer from School Street to the existing pumping station on Forbes Blvd. This extension would eliminate the need for the pumping sta- tion and form a basic trunkline for sewer extensions in west Mansfield. The second phase would be authorized when a definite commitment to construct is made and would consist of soil borings, easement plans and applications for permits and licenses required. CDM's proposal for sewering East Mansfield was to provide a letter report outlining the options for extension of the existing sewer system. The re- port would update the recommendations presented in the 1976 Wastewater Facil- ities Plan. Consideration would be given to both existing developed lots and proposed developments. A third CDM proposal reviewed by Bill Mackey covered consulting services for development of financing alternatives for extension of sewer lines. Costs for Phase I for the School Street extension is not to exceed $33,000; for the East Mansfield report not to exceed $9,700. Selectman Tartufo questioned the costs, saying he would like to see developers pay for the costs of the studies since they will benefit; Selectman Dunn seemed to agree. At this point the Town Manager introduced the Town Engineer, Bob Swanson, who had just arrived. Bill Madan, from the Planning Board, was also pre- sent for this discussion. The Town Manager said there are two or three de- cisions for the Board to make. One, to authorize proceeding with Phase I of the School Street-project. * MOTION: To proceed with Phase I of the School Street sewer extension with cost not to exceed $33,000. Levine /Dunn Selectman Tartufo opposed because he does not want to spend Town capital to find out how to collect it from somebody else; why not do it in the reverse? Selectman Dunn replied that it has already been appropriated. Selectman Levine said she feels the cost can be recovered from the developers when they want to connect to the line. VOTED: 3 -2 Markt & Tartufo opposed BOARD OF SELECTMEN MINUTES OF MEETING NOVEMBER 2, 1988 PAGE 5 A second decision is the $9,700 for an update and evaluation of East Mans- field sewer options, and $14,000 for sewer option alternatives. The Town Manager said there is funding for these two right now. * MOTION: To table both proposals until the next meeting. Tartufo / Markt Selectman Tartufo said we have a Planning Director who has been working on this with private developers to implement sewer lines, and Selectman Tartufo would like developers to spend their money for these extensions. The Town Manager reported that Mike LaCasse, the Planning Director, feels that each developer is interested in his own property /development only; the Town has "global perspective" Selectman Tartufo asked if there is a lead developer to garner the others. Selectman Dunn said the Town has to take the leading role. FAILED: 4 -1 Tartufo for MOTION: To accept the evaluation of sewer fees cost recovery options. Levine /Dunn VOTED: 4 -1 Tartufo opposed ( 13. Trowbridge Woods Sewer Extension Selectman Dunn excused himself from this discussion. The Clerk read a Memorandum from Acting Town Engineer Bob Powers concern- ing David Welch's request to extend sewer from Lancelot Lane in "Camelot Estates" to "Trowbridge Woods (off Tremont Street). Bob Powers was advised by Bill Mackey, of CDM, that there is a good deal more capacity in the af- fected line than this development would need, and Town Counsel advised that there is presently a court case involving the status of a sewer easement crossing private property; however, the Judge has determined that the case will have no bearing on the public use of the sewer line. Bob Powers rec- ommended allowing the developer to construct the sewer system, etc. This is a small subdivision, but the developer should be required to obtain a letter from the owner of the sewer line that they have no problem. Chairman Harrington said he would like something in writing about the legal case not affecting the Town. * MOTION: To approve the recommendations as outlined by the Acting Town Engineer with the proviso that the current-owner provide a letter autboniz3ngz0e,connection.- Markt /Tartufo Selectman Levine said she would like the owner to come back with plans showing more detail and ability for the line to go on up Tremont Street, etc. FAILED: 3 -1 Tartufo for MOTION: To endorse the concept. New Business a) The Town Manager had prepared an authorization for Board approval re- garding a grant anticipation. Tartufo /Markt VOTED: 4 -0 b) Tom reported that he had received a petition from some 200 residents concerning the "proposed land taking of the North Common ". The Chair- man commented that there seem to be rumors in town about this and Libera- tore Square; however, the Board of Selectmen has made no decision about either. c) Selectmen Tartufo advised that Albertini Square is in deplorable condi- tion after some work was done in the area. He said there is a resident who is willing to have it repaired and pay for it. Selectman Levine voiced her strong belief that if the Town wrecked it the Town should fix it. After brief discussion the consensus was to have the Town and the resident work together and make it better. 15. Old Business a) Selectman Dunn reported that grant monies will become available for towns interested in recycling projects very soon. He said from the solid waste point of view, recycling is very important. The State has put on hold trash -to- energy plans for one year. If all plants now pro- posed go on line the State would be burning 88% of the state's solid waste; the State plans approximately 50 %. He said DEQE is planning to hold an informational meeting in town at some time. b) Chairman Harrington asked about progress on the Charter revision com- mittee. He suggested asking for volunteers to do the work under Sel- ectman Levine's direction. c) Chairman Harrington said he is proud of the budget process in Mansfield; nothing happens in this town that is not open for everybody. He then reminded everyone that Tuesday is the Presidential Election Day and he asked everyone to get out and vote. 16. Adjournment * MOTION: To adjourn (at 10:10 P.M.).
