Ed Rosenberg, Chairman of the Board of Health, Scott Leite, Health Agent
and a member of the Board of Health, Michael Van Splinter were present, as
well as John Drew, Sherman Wolf and Bruce Montgomery of Great Woods, Inc.
Chairman Harrington opened the meeting by explaining that the Board of Health
had been working on sound problems and their enforcement of same. The Select-
men felt it would be worthwhile to have the Board of Health and Great Woods
officials meet with the Board of Selectmen to discuss the issues.
Ed Rosenberg said most complaints regarding noise from Great Woods concerts
came from West Mansfield. He said Scott has researched existing State laws,
and powers of Boards of Health to regulate noise. A Board of Health can
write and pass any reasonable regulations. Scott said noise is a nuisance
or can be something that deprives someone of their usual amount of peace.
He went on to say he has put together a proposed Noise Regulation; this does
not require Town Meeting approval and it has not been put in final form yet.
First, the Board would order an abatement of the noise; second would be an
order for the noise to cease; after a deligent effort, it could require a
fine and, finally, court. They expect to also stipulate a Special Permit
under certain conditions. Ed Rosenberg said this proposed regulation is not
specifically directed at Great Woods.
Selectman D'Onofrio questioned exemption under Mass. General Law Chapter
138. John Drew expressed concern that this is the first time they have
heard of this and they will have to seriously consider it now. Bruce Mont-
gomery addressed what they have already done, to the tune of $280,000+
spent in an effort to prevent excess noise. The Town Manager pointed out
that regulation of noise is very difficult. Selectman D'Onofrio was con-
cerned that he, as a member of the sub - committee on Great Woods, had not
been advised of this earlier. The Chairman then opened discussion to the
people in the audience. The Board of Health was then thanked for their par-
ticipation this evening.
Selectman D'Onofrio then brought up the issue of the Entertainment License
for Great Woods Performing Arts Center. He said he had reviewed their sched-
ule of events, the report from the Police Chief, and heard the Board of
Health tonight. He feels the Board of Health should go ahead with their

thing, and the Selectmen should approve the Entertainment Licenses.
* MOTION: To grant the Entertainment License for Sunday and Weekdays.
D'Onofrio /Dunn VOTED: 3 -0
John Drew thanked the Board and said they will do all they can to work
with the Board of Health and their regulation and the Selectmen. Chairman
Harrington asked that when Bruce Montgomery explains Great Woods require-
ments to their performers' managers that Great Woods then follow up on what
is specified..
9. Old Business
a) The Tosco Manager went over the order for the Town Meeting Warrant Art-
icles and asked for approval or any change desired. Selectman D'Onofrio
said he would like to move the Capital Improvement budget article up to
No. 10, then the rest follow as listed. The Town Manager advised that
the Board of Health non - criminal article needs alot more work before
being presented; also the article covering contract settlements is not
needed since that is being included in the Reserve Fund.
* MOTION: To approve the list of Town Meeting Warrant Articles as sug-
gested.
D'Onofrio /Dunn VOTED: 3 -0

Also that night, at 6:30 P.M., he and Selectman Dunn will be presenting
