MINUTES OF MEETING
AUGUST 22, 1984 CLERK
PRESENT: Chairman Wills; Selectmen D'Onofrio, McNair; Town Manager; Selectman
Levine arrived at 7:30 P.M.
1. The meeting was called to order at 7:10.P.M. and the Flag was saluted.
2. Fire ADDaratus
The Fire Chief, Chairman of the Finance Committee, Thomas Markt, Town Ac-
countant, Barbara Hagg and David Demers of Demers Associates, Inc. were pre-
sent for this discussion.
The Chairman opened by stating that an emergency meeting was held on Sunday,
August 19th, to discuss the fire apparatus situation, and the Town Manager
was asked to come back with further information for this evening's meeting.
The Town Manager then reviewed the existing problem of Mansfield's two front-
line pumpers being out of service due to mechanical failures, and the re-
serve pumper is out of service for major repairs. He then asked David
Demers to explain his evaluative report, copy of which had been distributed
prior to meeting tonight. Mr. Demers feels the trouble goes back to inher-
ent design deficiencies; that the two pumpers never complied with Federal
Motor Vehicle safety standards. He said the trucks are unsafe and recom-
mends replacing Engine 1, but there are options for Engine 2, which were
listed in his report. Discussion for repairing Engine 3 covered the fact
that parts are difficult to find now. His recommendation is based on main-
taining two Class A pumpers and one reserve pumper.
Selectman D'Onofrio asked about used equipment; any available are old and
in poor shape. Chief Sliney reviewed what he has done to date, contacting
many communities and reported that at present the Town of Morton and Attle-
boro are covering Mansfield, and just today he had acquired a 1000 GPM
pumper from Dartmouth, on loan for a two week period.
The Town Manager advised that to solve the problem Town Meeting action is
required, and that the Board's first action should be to set a date for a
Special Town Meeting, recommending September 10, 1984. Second, the Board
should declare an emergency situation in order to give the Fire Chief and
Town administration a greater latitude in dealing with State and local fire
officials in this matter, particularly in obtaining interim apparatus. If
the Special Town Meeting is called, Demers Associates would be asked to pre-
pare specifications,, and definitive cost estimates would be available at.the
Special Town Meeting, to be used as the basis for the appropriation. Sug-
gested Articles for the Special Town Meeting Warrant were given, as well
as various options for resolving the problem.
At this point the Chairman declared the scheduled 8:00 Public Hearing open
and then announced its postponement until 8:15.
The Town Accountant then briefly reviewed the financial impact of the vari-
ous suggested options concerning the fire apparatus, drawn from a table she
had prepared and distributed to the members of the Board.

taken the Board will be kept informed; he -was assured.6f this by
the Town Manager.

D'Onofrio /McNair VOTED: 4 -0
Selectman Levine questioned the possibility of reversing a vote, taken at
the Annual Town Meeting, concerning additional fire apparatus, if it was
deemed unnecessary due to present circumstances. This will be looked into.
Public Hearing /Great Woods, Inc. Beer & Wine License
The Hearing was opened at 8:30 P.M. The Clerk read the Notice of Public
Hearing, and'the Chairman advised those present that any action taken this
evening would simply be a commitment for issuance of the license at a
future date. John Drew, President of JDC, Inc. then outlined the purpose
and features of the proposed Great Woods Performing Arts Center. He said
the Planning Board has given their approval and he will meet with the Con-
servation Commission for a third time next week. The Chairman then asked
members of the Board for any questions and /or comments. Selectman Levine
asked about run -off and received a detailed description of design plans to
handle it, which include retention basins with oil.trap mechanisms.
The Norton Board of Selectmen was present; Chairman Leonard Silvia voiced
concern for oil going into the ground, if the entire parking area is not
paved. John Drew explained that the non -paved area is not approved yet,
but if it is approved, the number of times such an area would have vehicles
parked on it would be only a few, for a few hours, so it should not be a
problem. To not pave the entire parking area requires a variance from
the Zoning Board of Appeals. There was considerable concern expressed by
Norton residents and South Main Street residents about traffic after a per-

formance, and the need for an exit ramp south to Rt. 495. Chairman Wills
advised that the State will not consider the ramp until at least a year
after the Center is open and operating and they see "the works ". John
Drew introduced Mr. Ching of H.W. Moore Associates, Inc., engineers for
the project, who elaborated on the plans for handling exiting traffic -
number of lanes, police,.waiting cars will be within the Center grounds,
it will occur at minimum traffic times on Rt. 140. Some residents voiced
concern for safety which John Drew addressed also.
Turning to the sale of beer and wine, Selectman Levine asked how it will
be handled. She was advised that they plan three places for sale of food
and drinks, all within the fenced confines of the Center; beer and wine
will be sold by the glass; if hard liquor is brought in, it will be con-
fiscated. There will be a.maintenance.crew, and -the facility will be
cleaned up the same night as the entertainment, or-the next day.
Discussion for the Entertainment License was opened by Selectman Levine
explaining that the names of the entertainers . for the season will be pre-
sented to the Board for review prior to issuance of the license. Chairman
Wills expressed a desire to stipulate that no entertainer appealing ex-
clusively to an audience under the age of 25 be permitted; John Drew pre-
fers to not have an age attached. Selectman D'Onofrio suggested seasonal
licenses for both beer and wine and entertainment; suggested -that the Town
consider a noise control by -law for adherence-, if passed in the future;
similar to one adopted by the Town of Stockbridge, where Tanglewood is
located; the alcoholic beverage section needs to be tightened, and would
like to see Town Counsel involved in license approval. He also recommended
a joint Board meeting with the Norton Board of Selectmen. He expressed
a need for developing some latitude between total control by the Town or
developer, a safety valve, and feels caution and control are necessary ele-
ments to protect the townspeople of Mansfield. One resident asked if there
would be a public hearing for the approval of suggested entertainers; Chair-
man Wills felt this was worth consideration.
The Norton Planning Board Chairman, Richard Owen, was present and asked
Mr. Drew if he would meet with his Board; it was decided that the Planning
Board would be present when JDC.meets with the Norton Board of Selectmen
on September 6th. Barbara Tarsa, of South Main Street, Mansfield, ques-
tioned the possibility of her neighborhood tying into the Great Woods force
main. H.W: Moore's engineer offered details and reasons why.it would not
be reasonable.
The Hearing closed at 10:50 P.M.
