He said he was present because of his desire to maintain a close relationship with the communities he represents. The legislature is in recess and legislation on binding arbitration is pending. He has been opposed to it from the outset, and will make Mansfield's Board's position publicly known. He referred to the Governor's veto of about 31 million in local aid and hopes the veto will be overridden; action has been deferred until after the pri- maries. There was some discussion on raising the drinking age to 21, which Senator Locke favors, and discussion on the "Happy Hour" controversy; Sen. Locke predicts the end of it. Public Hearing - Yellow Cab of Mansfield The hearing opened with the Clerk reading the advertisement for the hear- ing as printed in the August 2, 1984 Mansfield News. The Clerk then re- viewed the background, as presented at the August 1, 1984 informal hear- ing. Mario Faria was then asked to address the Board and report on his action and intentions concerning the license suspension. Mr. Faria advised the Board that both cabs are now in Taunton and he intends to repair them and paint the one; he has no drivers at present. He repeated many of the statements made at last week's meeting concerning reasons for the dis- crepancies in Mansfield's service over the past 2 or 3 months, and explained that it is very difficult to keep drivers because they don't make enough; he has kept his fares low. Again, he hopes to be allowed to dispatch out of Taunton whereby he hopes to have better supervision of the phones, cars and drivers, and he said either he or his son would come to Mansfield once a day. He is looking for a place to park the cabs overnight; during the day they sit at the train station and bus station. A resident from Newton Street said she had heard there was an application for a zoning variance for Newton Street; this concerned her. No one knew of such an application. Two residents from the Foxboro Senior Citizens Court were present and implored the Board to allow Yellow Cab to continue operation, stating there is no other way "to get out of Foxboro ". Selectman D'Onofrio then went over each violation as listed, asking Mr. Faria if he intended to correct each one, and then stated he questioned whether continuation of operation would be in the best interest of Mans- field. Selectman Dunn said he has concern for running an operation not based in Mansfield. Pauline Pisani then asked to clarify a couple of the points listed in the Police inspection of the vehicles which, she said, had been corrected while the police were there and the Police had said would be "scratched" from their report. The hearing was declared closed at 9:12 P.M. Selectman D'Onofrio then sug- gested a motion allowing for a continued suspension of operation of the cabs until the violations are addressed satisfactorily, with such viola- tions subject to verification. * MOTION: For a five -day suspension and a resolution that the Board make further five -day suspensions until the violations are addressed satisfactorily. D'Onofrio /McNair No vote taken. BOARD OF SELECTMEN MINUTES OF MEETING AUGUST 8, 1984 PAGE 3 Selectman Dunn said he is opposed to further suspension. He feels the licenses should be revoked because as things stand now it is not conform- ing; at a later date Mr. Faria could reapply. Selectman McNair stated he doesn't like to put anyone out of business, so supports the suspension if the violations are cleared up. Selectman Levine expressed a need to learn if dispatching from Taunton would be allowed. Chairman Wills said he feels Mr. Faria has made no statement that he intends to comply with the regulations and that the only.way to convince him is to revoke the licenses. MOTION: For a 5 -day suspension Chairman Wills then advised Mr. he could call the Town Manager. field without a dispatch office turn with a complete package fo rD'Onofrio /McNair VOTED: 3 -2 Dunn and Wills opposed Faria that if he had any further questions, The legality of operating out of Mans - is to be checked, and Mr. Faria is to re- resolving the violations as cited. WORKSHOP - Public Safety Facility The Town Manager reviewed the information as contained in his August 6, 1984 Memorandum to the Board of Selectmen covering the need for a new facility, suggested solution, and alternatives. Design of the present police facility did not allow for expansion; the same is basically true for the fire station. There is no room for expan- sion or additional apparatus, and the present space is inadequate for re- placement equipment in some instances. The growth pattern of Mansfield in recent years is greatest in the East Mansfield area and needs better fire protection coverage. The suggested solution is to develop a new combination facility for Fire and Police on one of three municipal owned sites on Rt. 106 in East Mans- field. In this instance, the Town Hall facilities could then be extended to include the Police Station, the central Fire Station could be disposed of by a competitive bid process, or possibly used by the Drop -in Center. An alternative suggestion is development of a combined Tom Hall /Police Department /Fire Department facility with utilization of the existing Town Hall as a new Library. This would meet all the municipal building needs of the community which are presently projected. The Police Chief and Fire Chief were present and discussion followed. 8.
