PRESENT: Chairman Wills; Selectmen Levine, Dunn, D'Onofrio, McNair; Town
Manager
1. Meeting Called To Order at 7:23 P.M.
* MOTION: To go into Executive Session to discuss information regarding
Police and Fire Department negotiations.
Levine /Dunn The Board was polled: 5 -0
2. The Board came out of Executive Session at 8:20 P.M.; the Flag was saluted.
* MOTION: To accept the negotiations for the Fire Department as presented.
Levine /D'Onofrio
The Town Manager then summarized the agreement, stating that if
the Board votes for this, it will still require ratification by
the Union as well as approval of the Town Meeting. The contract
calls for a two year contract with a 5% wage increase for each
year, beginning July 1, 1983. The EMT allowance will be increased
$300, beginning July 1, 1983, and an additional $200 beginning
July 1, 1984, making the total EMT allowance $1,200. Beginning
July 1, 1984 the Cleaning /Clothing Allowance for each men would
be increased $50, making a total of $250 per year. The contract
will be amended to provide an addition relative to sick leave,
concerning abuse of said sick leave.
A letter of understanding will be entered into with the Union
whereby the Fire Chief will endeavor to provide for officers to
work at least one tour of duty in the ambulance during a normal
42 hour work week. This will not be a part of the contract, how-
ever.
The fiscal impact for FY -84 is $27,765 over the appropriation for
FY -83; for FY -85 $27,290. The second year will include `L addi-
tional men, and the Town Manager advised that the line item for
Firefighters is less than the FY -84 actual appropriation because
of changes in personnel and the non - filling of certain positions.
The overall percentage increase for two years is 10.5 %.
VOTED: 5 -0
Selectman Levine left the meeting at 8:30 P.M. Chairman Wills asked the
Board if they were willing to delay the order of business and go to the
scheduled visitors who had been waiting. It was agreed.
3. Tony Durbano
Mr. Durbano appeared before the Board to seek help in solving his water in
the basement, which he has had for two years, and he feels is a result of
the resurfacing of Ware Street, done in 1982, which raised the level of the

street. Previously the water ran to the road and puddled there; he showed
pictures substantiating his complaint. He said he has talked to the DPW
Director who is considering an easement across to the property on the other
side. He said he has also talked to a lawyer, but no action has been taken.
The Town Manager advised the Board that they should be very careful, because
there are many homes in Mansfield with water problems. Icing, which occurs
at Mr. Durbano's property, is a problem the Town should take care of, and
will. He feels that if this does not take care of Mr. Durbano's problem,
it will not then be the Town's problem. The Board asked the Town Manager
to have the DPW Director set a date to have this work done. Mr. Durbano
was satisfied with this.
At 8:40 P.M. Selectman Dunn left the meeting.
4. Francis Gay / GATRA
Mr. Gay was present to discuss the leasing of Mansfield's train station,
presently owned by the MBTA. Mr. Gay has been talking with MBTA, and GATRA
will be putting $50,000 of State funds into the station for improvements;
work is expected to begin within the next month and will include upgrading
the parking facilities, as well as improving the platform and the station
building. Selectman D'Onofrio expressed his feeling that Mr. Gay and the
Town Manager have been prime movers in this whole development aspect and
should be commended for their efforts for the Town of Mansfield and sur-
rounding communities. Chairman Wills asked if the design for the existing
station and platform will allow for local input. The Town Manager reviewed
a table he had prepared comparing Mansfield Control vs. GATRA Control of
the Station and these items were discussed.
Mr. Gay does not think the Town will be able to charge parking fees.
Selectman D'Onofrio felt the Conrail property should be considered also.
Chairman Wills wants something in the contract saying if there is not proper
maintenance, we can go in and do it and then bill GATRA for it. The ques-
tion was raised as to what the Town will do, with GATRA controling the sta-
tion, when the assessment becomes too much for the Town to handle. Chair-
man Wills asked, can criteria for future assessments be written into the
contract; Mr. Gay said yes. The question was raised, if GATRA controls
the station, will the Winthrop Street parking lot be included. If the Town
leases the station, all maintenance and utilities will be included in the
assessment.
9:05 P.M. Selectman Dunn returned to the meeting.
Selectman D'Onofrio pointed out that if the Town does not have control of
the property, then it cannot complain if conditions do not suit. It was
established that the length of the lease would be based on "useful life"
of the paving - probably ten years. Selectman Dunn said he feels it will
be a financial benefit to the Town to allow GATRA to handle the Station.

* MOTION: That we solicit Mansfield residents' opinions on the advisability
of leasing or allowing GATRA to lease that property, and also seek
resident opinion for improvements to the property.

P.M.

Selectman D'Onofrio then reviewed his Memo concerning a telephone call he
had received from Rep. Vernon indicating that he was in receipt of a letter
from the Mass. DPW advising that Mansfield could not restrict parking in
the Winthrop Street lot under the terms of the DPW grant. D'Onofrio is
concerned, feeling that this indicates in accepting such a grant the Town
loses the right to control and regulate its own property; his Memo sug-
gested four courses of action he recommends. Selectman Dunn suggested
first contacting the DPW in hopes of clarifying what action the Town may
take to be in accordance with the DPW Grant, yet maintain right to regu-
late the property; then follow D'Onofrio's recommendations, if necessary.
It was then pointed out that since the Board, nor any Town department, has
not yet received such a letter, no action is required.
* MOTION: To table this item until the Board receives a letter.

to $1,061,638. CDM canvassed the bids and recommends awarding the bid
to Barletta Co., Inc., Roslindale, MA, for $396,900. Since this is
an EPA project for which the Selectmen have responsibility, Town Man-
ager recommended awarding the bid to Barletta Co., Inc.

b) Selectman McNair asked the Town Manager if he knew whether anything
had been done concerning the mailbox replacement request, resulting
from the snow plow. Discussion followed regarding Town policy and
responsibility. The general consensus was that if residents' property
is damaged during Town maintenance operations, the Town will make re-
pairs as soon as practical. Chairman Wills stated, however, that if
a minor damage or loss, the Town would appreciate the residents taking
care of it themselves. The Town Manager then asked the DPW Director
to come in, who explained he had spoken with the resident concerning
this mailbox and that the DPW Department would take care of it as soon
as practical.

cept the surcharge, although they would not be required to before Jan-
uary 1,1986. The assessment will not start until January 1, 1987.
Industries which do not use the 339 exchange will also be charged;
it will be the Town's responsibility to notify them of this fact.
The industry developer will handle it. The surcharge will be only
on New England Telephone use charges.
