D'Onofrio /McNair VOTED: 4 -0 7. 8:00 P.M. Public Hearing - Hidden Country, Inc., d /b /a Titus' The Clerk read the Public Hearing Notice; the Owner, Gilbert Stuart and Manager, Wendy Goyea were present. The Chairman briefly reviewed the pre- vious meeting and the concern of the Board which prompted the hearing; i.e. the influx of people coming from other establishments which close at 1:00 A.M. and the Board's desire to provide consistency of a closing hour in Town. Mr.Stuart said they would very much like to keep the 2 o'clock license; he feels the business brings business into town which contributes to the Town, and he feels there is no grounds for changing the closing hour. Wendy Goyea again spoke about the changes they instituted in September, which she feels BOARD OF SELECTMEN MINUTES OF MEETING DECEMBER 28, 1983 PAGE 3 have virtually eliminated the problems. They are locking their doors at 12:45 and have eliminated the last "set ", played by the bands; these changes have cost them about 20% of their business. They only use the 2 o'clock license on Friday and Saturday, but have a much larger capacity, so that it takes longer to empty the premises. They are concerned for patrons who drink too much, will offer rides home or call a taxi. They do not admit people who are not dressed properly, do not have proper ID. They have a parking lot attendant on Friday and Saturday, and a man at the door every night of the week. She said they are residents of the town and want to keep on good terms with everyone, but to lose that last hour would mean a loss of $300 to $400 a night. They hope to have a new, efficient air condition- ing system installed before summer; this will eliminate open windows and doors which allowed noise to disturb neighbors. Considerable discussion followed, back and forth, from supporters and those opposed to the 2 o'clock license. The hearing closed at 9:07 P.M. MOTION: To leave the license at 2:00 A.M. McNair /D'Onofrio Selectman Levine said if there are more problems, then there can be another hearing. Chairman Dunn stated that he was originally against the 2 o'clock closing, but from this hearing he has learned they are trying to correct the problems; his main concern was the influx of people which caused the biggest problem, which has now been corrected. Selectman D'Onofrio said licensure is a privilege and requires fairness, equity and good management practices. He feels good management practices have been instituted, and the owner and manager have been honest and forthright in attempting to meet the problems expressed by neighbors; any change in operating hours should only be made after proof to warrant such action. He tends to support the motion. Selectman McNair advised his support from the beginning. VOTED: 4 -0 8. Old Business - Town Manager a) Town Manager reviewed his Memo covering the Intermunicipal Agreement with the Town of Foxboro for the wastewater treatment plant. Brian Jeans of the State was present at a meeting December 1, acting as a mediator, and offered a proposal which it is felt Foxboro has not followed. Town Man- ager suggests that the Board plan a meeting with the Foxboro Board of Selectmen. Tuesday, January 17, 1984 was the date picked. b) The Town Manager reviewed a Memo from the Town Engineer, to the Town Man- ager, concerning his recent field visit to the Michael - Angela Estates Sub- division. He sees no problem with the excavation and fill work and the exposed material is all good gravel. There are no homes built as yet. In Selectman D'Onofrio's words, then Mansfield's acquifer is being pro- tected. The DPW Director stated he would continue to check this subdi- vision from time to time. BOARD OF SELECTMEN MINUTES OF MEETING DECEMBER 28, 1983 PAGE 4 c) Reviewed a Memo to the Board of Health from the DPW Director as a Lime Treatment Update. A bid has been awarded for the lime handling and injection equipment; this equipment will handle permanent lime feeding installations at 5 locations in town. The DPW is acting as general con- tractor on the project and is presently building structures to house the new equipment. If the equipment is delivered on schedule, the water pro- duction from Cate Springs will be receiving treatment by March 1984; this is 60% of the total daily production of the Town. 9. Old and New Business - Selectmen a) Selectman McNair advised that he had received another phone call from Mrs. Sheehan about the security light. b) Selectman McNair spoke of icey conditions on Route 106. c) Selectman McNair asked about a plaque for Paul Boyden, who has given 13 years service to the Town. d) Selectman Levine asked to caution the Board about New England Telephone promises and predictions and advised them to listen carefully at the January meeting with Mr. Colement and definitely record the meeting. e) Chairman Dunn brought up the matter of a salary increase for the Town Accountant. An annual salary increase of $1,000, by agreement, is due January 1, 1984. Selectman D'Onofrio felt Barbara Hagg has come through in shining fashion. * MOTION: To grant the salary increase of $1,000 to the Town Accountant. Levine /D'Onofrio VOTED: 4 -0 f) Chairman Dunn brought up his concern for research into computers; par- ticularly one that all departments can utilize and agree on. The dis- cussion led to the function of the Electric Advisory Committee's purpose and accomplishments; there is some confusion as to whether they were sup - posed to come up with recommendations concerning computers, and whether they have the know -how to make such a judgment, etc. The general opin- ion seemed to be that the Advisory Committee was as a resource for rec- ommendations, pros and cons, of issues. * 10. MOTION: To adjourn the meeting at 10:25 P.M. McNair /Levine VOTED: 4 -0
