Letter from Board of Certification of Operators re: Bob Morrison is temporarily certified as the operator for the water department. 8:00 P.M. Public Hearing - DJ's Pub Liquor License Violation Present were Officer Martin, Chief Earls, Town Counsel Dwyer, Grace Langille Atty. Hartwell. Clerk Mahana read notice of hearing. Officer Martin read police report on serving 17 year old minor at Daggs. Attorney Hartwell noted that Mrs. Langille was not contesting the violation on the serving to a minor, but that she has had the license for 15 years and this is the first offense since 1967. She did not think it would be reasonable to take the license away on the first violation. It was noted.that the police call to Dagg's was an anonomous call. Town Counsel Dwyer noted that usually for a first offense a 1 -3 day suspension is given as it is very difficult to take a license away until after the 3rd or 4th offense has occurred. If it was revoked at this time, and was appealed, the ABCC would probably let them have it back. Mrs. Langille also noted that changes are being made and that she is the owner and manager of Dagg's. They would also be happy to cooperate with the Police in anyway that they can to help get rid of some of the problems there recently. She noted that they will not have bands this summer and will probably shut down earlier to help solve some of the problems. Chairman McNair mentioned that he checked with other towns and they usually have a 1 -3 day suspension on first offenses. Selectman May felt that a written warning should be issued at this time for the business. Chief Earls noted that regarding minors, the bartenders and waitresses, waiters are responsible to make sure no minors are being served. Their track record is good and he recommended a one day suspension. Bartenders should be put on notice that they will be responsible in the future if something happens. * MOTION: To give Dagg's Uounge a written warning on the offense of serving a minor as it is the first in 15 years and changes are being made to correct the problems. May / Mahana VOTED: 3 -1 Levine opposed. In favor of one day suspension. Town Counsel Dwyer spoke briefly on the carnival. It is his opinion that since the carnival is a non - profit organization that the granting of the Board of Selectmen for a carnival at the DPW garage, a special use is not required. This happens all the time with churches, etc. having events BOARD OF SELECTMEN MINUTES OF MEETING June 16, 1982 Page 3 with liquor licenses and not being in the correct zone. fie will get a list of provisions that should be adhered to on carnivals, etc. for the Board. 8:33 P.M. ASM Enterprises - Underground Storage Tanks License Present were Matt Starcher from DOW Chemical, Paul Fernandes from ASM and Fire Chief Tom Leonard. The application is for a license at 35 County Street for 2 underground storage tanks for Class C and A flammables. Each tank holds 30,000 gallons. Class C, Voranol 5103 in one tank and Class A DER-521-A80-Resin in the other tank. Mr. Starcher noted that the Voranol is used for making insulation, foam padding, etc. It is a thick substance. Selectman Mahana asked if it would seep into the water if there was a spill. Mr. Starcher noted that it would lay on top of the water, but cut off oxygen supply to the fish. Sawdust is usually used for a spill as it soaks it up very well. They also keep nitrogen as a gauge and -the flash point is 650F. There are 3 tanks there, but will be using only 2. The 3rd will be taken out and moved. MOTION: To approve the application for 2 - 30,000 gallon storage tanks of Voranol and Class A -Resin at ASM Enterprises, 35 County Street. Mahana /Colella VOTED: 4 -0. Fire Chief also had a transfer request #19 for Fire Department Salaries. Two accounts overdrawn are fire calls and sick leave. Total of transfer request #19 is $23,508.67. He noted that they pay for sick leave, injuries and personal days out of the sick leave account. A total of 6 months of leave .lost due to on the job injuries. About 100 sick days have been taken and 5 men have the maximum amount of sick leave accumulated. Regarding fire calls, Bristol Arms, Sheraton and Bicentennial Court are problems. They estimated $5700 in time to calls to Bristol Arms not including trucks and on duty call. Injuries are not related to these calls. Chief Leonard noted that he would like to see Town Counsel about charging these business for false alarms. Board would like a report in two weeks on this. It was asked if additional men would help, and it would not. The sick leave account is hurting them. If someone is on vacation and goes to a fire, they get paid time and a half as vacation time is vested time and he gets it anyway. MOTION: To grant Transfer Request #19, Fire Department Salaries for $23,508.67. Levine /Colella VOTED: 4 -0. Town Manager has been reviewing accounts with the departments to determine which ones are over the budget. He is waiting for the bills to come back on the snow expenses and it should be about $30,000.and does not include time during the normal workday, just overtime, hourly rate and equipment rental. There might be a transfer for police department salaries because of court time and sick leave. Also, a request may be needed for cruiser repairs. Blue Cross /Blue Shield will need a transfer because of the increase in rates. There is also a bill from Murphy Lamere & Murphy for labor negotiations for the Police Dept. Another account is town hall expense for postage and telephone that may need a transfer. Town Manager noted that he has received a letter from Whitaker on the roof for the town hall. There was a request about funds under GATRA being incumbered. He suggested a selection committee of other police chiefs to screen selection of Mansfield's police chief: He also spoke about a high tech firm looking to locate in southeastern Mass. Should send a letter to representatives and Gov. King requesting them to con- sider Mansfield for this firm. Selectman Levine asked about lots on Balcom Street. Lots will meet State sanitary code-and finished grade will be 6' higher than the grade. It.was asked if a wetland hearing was held with the Con Com. Selectman BOARD OF SELECTMEN MINUTES OF MEETING June 16, 1982 Page 7 Mahana noted that he spoke to the builder who told him the lot perked in the back, not the front but the houses were put near the street in case Balcom Street gets town.sewerage. They did not put the septic system where it was perked. It was suggested to write a letter to the ConCom on the wetland hearing and Board of Health on the septic system where it was perked.
